\nRakesh Kumar,J.              The    sole      petitioner,    while     invoking<\/p>\n
                  inherent     jurisdiction       of    this     Court     under<\/p>\n
                  Section 482 of the Code of Criminal Procedure,<\/p>\n
                  has   prayed     for   quashing      of   an   order    dated<\/p>\n
                  5.1.1998 passed by Smt. Rita Mishra, Judicial<\/p>\n
                  Magistrate, Patna. By the said order, learned<\/p>\n
                  Magistrate      has    taken   cognizance      for     offence<\/p>\n
                  under Section 406 of the Indian Penal Code in<\/p>\n
                  Complaint Case No.1297 of 1997.\n<\/p>\n
                             2.    Short fact of the case is that the<\/p>\n
                  complainant, who claims to be nephew of one<\/p>\n
                  Binod   Kumar,        had    hired   a    double       storied
\n                  -2-<\/span><\/p>\n
building from Binod Kumar and thereafter, he<\/p>\n
established a Poly-clinic in the name and style<\/p>\n
of     Banarsi     Das       Parasram              House,     which       is<\/p>\n
commonly known as B.P. Hospital. It was alleged<\/p>\n
in the complaint petition that the petitioner,<\/p>\n
who was a doctor by profession, was employed on<\/p>\n
the     salary     basis           in        the     said     hospital.<\/p>\n
Subsequently,           after           the        hospital        started<\/p>\n
running smoothly, the petitioner got his wife<\/p>\n
and son employed in the said hospital and after<\/p>\n
the hospital was fully established and started<\/p>\n
showing huge earning the petitioner took over<\/p>\n
possession of entire account and record of the<\/p>\n
hospital.     It       was   alleged          by     the    complainant<\/p>\n
that    the   petitioner           committed          an    offence       of<\/p>\n
criminal breach of trust and due to which the<\/p>\n
complainant        was       put        to     a     loss     of        about<\/p>\n
Rs.50,000\/-. It was further alleged that the<\/p>\n
petitioner illegally took forceful control over<\/p>\n
the instruments and equipments of the hospital<\/p>\n
in question and virtually, he started to enjoy<\/p>\n
all the benefits of the hospital in question<\/p>\n
independently. It was alleged that it was a<\/p>\n
case    of    criminal        breach          of     trust.        It    was<\/p>\n
alleged that offence under Sections 201, 341,
\n                   -3-<\/span><\/p>\n
380, 409, 452 and 120B of the Indian Penal Code<\/p>\n
was     committed        by     the    petitioner.           The    said<\/p>\n
complaint was filed on 13.11.1997.<\/p>\n
             3.         After      filing      of    the     complaint<\/p>\n
petition, the complainant was examined on S.A.<\/p>\n
and     in   support          of      the      complaint,          three<\/p>\n
witnesses     were       also      examined         and    thereafter,<\/p>\n
the     learned     Magistrate          by     its        order    dated<\/p>\n
5.1.1998 took cognizance of the offence under<\/p>\n
Section 406 of the Indian Penal Code.<\/p>\n
             4.          Shri         Naresh        Dikshit,learned<\/p>\n
counsel appearing on behalf of the petitioner<\/p>\n
firstly submits that in the entire complaint<\/p>\n
petition, there is no allegation of entrustment<\/p>\n
to the petitioner. He further submits that in<\/p>\n
the complaint petition even the complainant had<\/p>\n
not alleged commission of offence under Section<\/p>\n
406 of the Indian Penal Code. It appears that<\/p>\n
in complaint petition under the heading nature<\/p>\n
of    offence,          mechanically           and        ornamentally<\/p>\n
sections were mentioned as 201, 341, 380, 406,<\/p>\n
452 and 120B of the Indian Penal Code. Learned<\/p>\n
counsel for the petitioner has further referred<\/p>\n
to Annexure-2 to the petition, which was an<\/p>\n
order     passed        by      S.D.M.,      Patna         whereby     a
\n                  -4-<\/span><\/p>\n
proceeding       under       Section    107    of    Cr.P.C.          was<\/p>\n
initiated. He submits that since the petitioner<\/p>\n
has proceeded with the said case, the present<\/p>\n
complaint    was       filed     by    the     complainant.           He<\/p>\n
further, by referring to paragraph-12 of the<\/p>\n
petition, submits that the petitioner had filed<\/p>\n
a case for fixation of fair rent on 27.11.1997<\/p>\n
and said case was pending at the time of filing<\/p>\n
of the present petition.\n<\/p>\n
            5.      Sri Naresh Dikshit submits that<\/p>\n
the    complaint         petition       does        not        disclose<\/p>\n
commission of offence under Section 406 of the<\/p>\n
Indian Penal Code and he further submits that<\/p>\n
since the petitioner has filed afore referred<\/p>\n
cases,     the     present       complaint          petition          was<\/p>\n
maliciously filed by the complainant. He has<\/p>\n
also     referred       to    Annexure-3       series          to     the<\/p>\n
petition, which are typed copy of affidavits<\/p>\n
filed by some imminent doctors of Patna and<\/p>\n
said    doctors        have    stated    on     oath       that       the<\/p>\n
petitioner is Director and Proprietor of B.P.<\/p>\n
Hospital, Arya Kumar Road, Rajendra Nagar, P.S.<\/p>\n
Kadamkuan, District Patna. He further submits<\/p>\n
that the complaint petition does not indicate<\/p>\n
any    criminal     offence      but    at    best        it    can    be
\n                   -5-<\/span><\/p>\n
termed as a dispute which is civil in nature<\/p>\n
and he has relied upon a judgment of Hon’ble<\/p>\n
Supreme Court reported in A.I.R. 2006 Supreme<\/p>\n
Court   2780       (M\/S       Indian       Oil    Corporation      and<\/p>\n
another Vrs. E.P.C. India Limited and others)<\/p>\n
and 2000(2)SCC 636 (G. Sagar Suri and another<\/p>\n
Vrs.    State       of       U.P.        and     others).    He    has<\/p>\n
specifically referred to paragraph-10 of Indian<\/p>\n
Oil Corporation Case (Supra) and paragraphs 7,<\/p>\n
8, 14 and 15 of the judgment passed in G. Sagar<\/p>\n
Suri Case (Supra). In some and substance, he<\/p>\n
submits that if the court is satisfied that the<\/p>\n
dispute is purely civil in nature, then this<\/p>\n
Court even while exercising power under Section<\/p>\n
482    of    the    Code       of    Criminal       Procedure      can<\/p>\n
intervene      into          the    matter        and   quash     such<\/p>\n
proceeding.\n<\/p>\n
             6.         He    has   prayed        for   quashing    of\n\norder   of    cognizance            as    well     as   quashing    of\n\n<\/pre>\n
entire proceeding subsequent to the order of<\/p>\n
cognizance.\n<\/p>\n
             7.          Shri       Surendra        Prasad      Singh,\n\nlearned       Additional            Public        Prosecutor       has\n\n<\/pre>\n
appeared on behalf of the State. He submits<\/p>\n
that perusal of the complaint petition itself
\n                    -6-<\/span><\/p>\n
indicates commission of offence under Section<\/p>\n
406 of the Indian Penal Code. He submits that<\/p>\n
there    is    specific     averment    in    the     complaint<\/p>\n
petition that the petitioner was employed by<\/p>\n
the complaint and the records\/accounts of the<\/p>\n
hospital in question was in the possession of<\/p>\n
the petitioner and since the complainant has<\/p>\n
alleged that he had with hold the accounts as<\/p>\n
well    as    mis-appropriated        the    proceeds    earned<\/p>\n
from the hospital, it can be specifically said<\/p>\n
that there was an entrustment and commission of<\/p>\n
offence of criminal breach of trust by this<\/p>\n
petitioner. He submits that specific case of<\/p>\n
offence under Section 406 of the Indian Penal<\/p>\n
Code is made out. He further submits that the<\/p>\n
complainant was also examined on S.A. and in<\/p>\n
support       of    complaint,   three       witnesses       were<\/p>\n
examined.          They   supported    the     case     of   the<\/p>\n
complainant. He further submits that at this<\/p>\n
stage, the learned court after being satisfied<\/p>\n
with    the    materials      available      on   record     has<\/p>\n
taken cognizance of the offence and case is at<\/p>\n
very initial stage. He submits that it is not<\/p>\n
advisable for this Court to intervene into the<\/p>\n
matter that too, while exercising power under
\n                   -7-<\/span><\/p>\n
Section 482 of the Code of Criminal Procedure.<\/p>\n
He submits that this power is to be exercised<\/p>\n
in     exceptional           and       rarest       of    rare        cases.<\/p>\n
Accordingly, he has prayed for rejection of the<\/p>\n
present petition.\n<\/p>\n
             8.         In    this          case,       none    has       come<\/p>\n
forward on behalf of the opposite party no.2.<\/p>\n
             9.     I have also examined the materials<\/p>\n
available      on       record          as       well    as     complaint<\/p>\n
petition and impugned order. Only perusal of<\/p>\n
the    complaint         petition,           I     am    of    the     view,<\/p>\n
indicates      commission              of    the    alleged      offence.<\/p>\n
Submission        of     Shri      Dikshit           that      since       the<\/p>\n
petitioner and opposite party-complainant were<\/p>\n
in     litigating         term,         the        present      complaint<\/p>\n
petition     was        filed      by       the    complainant            in   a<\/p>\n
design manner has got no legal force. I have<\/p>\n
examined the materials available on record of<\/p>\n
the case. Of course, at this stage, I was not<\/p>\n
required to look into such document but with a<\/p>\n
view    to   arrive          to    a    just       conclusion         I    had<\/p>\n
cursorily perused some of the annexures, which<\/p>\n
have    been      enclosed         with           the    petition.         The<\/p>\n
Annexure-2 indicates that the order was passed<\/p>\n
on    27.11.1997.         Similarly,              statement      made          in
\n                -8-<\/span><\/p>\n
paragraph-12 of the petition indicates that the<\/p>\n
petitioner had filed a case for fixation of<\/p>\n
rent    on    27.11.1997.           It    appears      that     after<\/p>\n
filing of the present complaint petition, which<\/p>\n
was filed on 14.11.1997, the petitioner after<\/p>\n
being advised, had taken such steps only with a<\/p>\n
view to create a defence in the present case.<\/p>\n
So far as Annexure-3 series are concerned, this<\/p>\n
further      indicates         that      evidences      are     being<\/p>\n
created by the petitioner in support of his<\/p>\n
defence. Moreover, while hearing this petition,<\/p>\n
I am not recording any opinion on any of the<\/p>\n
enclosures including Annexure-3 series to this<\/p>\n
petition.\n<\/p>\n
             10.         In     view      of    the     facts       and\n\ncircumstances,       I     am    of      the   view    that     while\n\npassing      order       of     cognizance,           the     learned\n\nMagistrate         has        committed        no     error        and,\n\n<\/pre>\n
accordingly, there is no merit in the present<\/p>\n
petition and petition stands rejected.<\/p>\n
             11.         On     20.3.1998,          while     issuing<\/p>\n
notice to opposite party no.2 in the present<\/p>\n
case,   this       Court      had     directed       that     in   the<\/p>\n
meantime, further proceeding in Complaint Case<\/p>\n
No.1297 of 1997 pending in the court of Smt.
\n                                  -9-<\/span><\/p>\n
                   Rita Mishra, Judicial Magistrate, Patna shall<\/p>\n
                   remain stayed. Subsequently, on 11.8.1998, the<\/p>\n
                   petition was admitted for hearing and it was<\/p>\n
                   directed that till final hearing of the case,<\/p>\n
                   interim order dated 20.2.1998 shall continue.<\/p>\n
                   In   view    of     rejection     of   present     petition,<\/p>\n
                   interim     order    of    stay    stands    automatically<\/p>\n
                   vacated.\n<\/p>\n
                               13.      Let   a    copy   of   this   order   be<\/p>\n
                   communicated to the court below forthwith.<\/p>\n
