Therefore, the same is required to be<br \/>\n\tquashed and set-aside and the Municipal Valuation Appeal<br \/>\n\tNo.15750\/1992 be restored and remanded to the files of the learned<br \/>\n\tJudge, Small Causes Court, Ahmedabad for deciding the same afresh<br \/>\n\tafter giving ample opportunity of leading the evidence to both the<br \/>\n\tparties strictly in accordance with law.\n<\/p>\n<p>Though<br \/>\n\tthe respondent is duly served, he elected not to remain present<br \/>\n\tbefore the Court.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by Mr.Bhaskar Tanna,<br \/>\n\tlearned senior counsel for the appellant. On perusal of the impugned<br \/>\n\torder, it is seen that the same is on the printed form and only the<br \/>\n\tblanks are filled up without assigning any reason. Therefore, the<br \/>\n\timpugned order deserves to be quashed and set-aside by allowing this<br \/>\n\tAppeal and thereby restoring and remanding the Municipal Valuation<br \/>\n\tAppeal No.15750\/1992 to the files of the learned Judge, Small Causes<br \/>\n\tCourt, Ahmedabad for deciding the same afresh after giving ample<br \/>\n\topportunity of leading the evidence to both the parties strictly in<br \/>\n\taccordance with law.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Appeal succeeds and accordingly it is<br \/>\n\tallowed. The order impugned in the Appeal is quashed and set-aside.<br \/>\n\tThe Municipal Valuation Appeal No.15750\/1992 is restored and<br \/>\n\tremanded to the files of the learned Judge, Small Causes Court,<br \/>\n\tAhmedabad for deciding the same afresh after giving ample<br \/>\n\topportunity of leading the evidence to both the parties strictly in<br \/>\n\taccordance with law.
