3 -Respondent(s)\n \n\n=======================================================\nAppearance : \nMR\nCB DASTOOR for Petitioner(s) : 1, \nMR PRANAV DAVE AGP for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n4. \n======================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/06\/2011\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent petition has been filed under Articles 226, 14, 19 and 21 of<br \/>\nthe Constitution<br \/>\nof India for the prayer that appropriate writ,<br \/>\norder or direction may be issued to the respondents to remove the<br \/>\nillegal encroachment made on the agricultural land bearing Survey<br \/>\nNo.134 of Village : Totaniyana, Taluka : Valabhipur, District :<br \/>\nBhavnagar.\n<\/p>\n<p>\tLearned<br \/>\ncounsel, Mr.Dastoor for the petitioner referred to the representation<br \/>\nat Annexure-D dated 30.05.2011 addressed to the Collector and<br \/>\nsubmitted that DLR has made report, for which, map is produced at<br \/>\nAnnexure-C showing the illegal construction and, therefore, their<br \/>\nrepresentation may be directed to be decided.\n<\/p>\n<p>\tLearned<br \/>\nA.G.P., Mr.Dave, who appears on advance copy, submitted that the DDO<br \/>\nwould be an appropriate authority.\n<\/p>\n<p>\tLearned<br \/>\ncounsel, Mr.Dastoor has stated that if appropriate direction may be<br \/>\ngiven to the Collector\/DDO to decide his representation in accordance<br \/>\nwith law on the basis of the report of the DILR and other records<br \/>\nwithin reasonable period, it would fulfill his grievance.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, it is directed that the representation dated<br \/>\n30.05.2011 at Annexure-D addressed by the petitioner to the Collector<br \/>\nshall be decided by the Collector\/DDO whosoever competent authority<br \/>\nin accordance with law on the basis of material and evidence<br \/>\nincluding the map at Annexure-C or the report of DILR within a period<br \/>\nof one month from the date of receipt of the copy of the order after<br \/>\nproviding opportunity to all concerned.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe present petition stands disposed of with aforesaid observation.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>(RAJESH<br \/>\nH.SHUKLA, J.)<\/p>\n<p>\/patil<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Jorubhai vs State on 23 June, 2011 Author: Rajesh H.Shukla, Gujarat High Court Case Information System Print SCA\/7681\/2011 2\/ 2 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SPECIAL CIVIL APPLICATION No. 7681 of 2011 ======================================================= JORUBHAI AALABHAI KHACHAR &#8211;
