No.23890 of 2010 (I)\n             ---------------------------------\n             Dated, this the 11th day of August, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioners retired from service as Sub Inspectors of Police. In<\/p>\n<p>this writ petition, they challenge Ext.P5 order dated 20\/04\/2010<\/p>\n<p>passed by the 1st respondent in pursuance to the directions<\/p>\n<p>contained     in   Ext.P4    judgment     dated    09\/06\/2009       in<\/p>\n<p>W.A.No.1065\/2006.\n<\/p>\n<p>      2.    Grievance of the petitioners highlighted before the 1st<\/p>\n<p>respondent was that their juniors are getting higher pay and that<\/p>\n<p>therefore they should also be stepped up applying the principle<\/p>\n<p>equal pay for equal work.\n<\/p>\n<p>      3.    However, a reading of Ext.P5 order shows that<\/p>\n<p>consequent on the pay revision when re-options were exercised, the<\/p>\n<p>petitioners did not exercise the re-option, whereas their juniors<\/p>\n<p>exercised re-option and got fixation of pay on that basis. It is<\/p>\n<p>therefore that their juniors happened to get higher pay.<\/p>\n<p>      4.    In my view, if re-option was not exercised by the<\/p>\n<p>WP(C) No.23890\/2010<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>petitioners for reasons which are attributable to them and re-option<\/p>\n<p>was exercised by their juniors and they got the benefits thereof,<\/p>\n<p>seniors like the petitioners cannot complain that their juniors are<\/p>\n<p>getting higher pay.\n<\/p>\n<p>      Therefore, in the light of above, I do not find any merit in the<\/p>\n<p>contention raised by the learned counsel for the petitioners.<\/p>\n<p>      The writ petition fails and is accordingly dismissed.<\/p>\n<p>                                    (ANTONY DOMINIC, JUDGE)<br \/>\njg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court R.Sukumaran Nair vs State Of Kerala on 11 August, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 23890 of 2010(I) 1.
