Pevtitioner a member of the 2113 1’espondent–<\/p>\n
Coooerative Housing Society registered under the<\/p>\n
”  Viiarnataka Cooperative Societies Act, 1959, for short the<\/p>\n
 ‘Act’, is claiming to be an aliottee of site No.2302\/A<\/p>\n
measuring 80′ X 50′ and on payment of the full vaiue of<\/p>\n
the site was conveyed by execution of a registered sale<\/p>\n
I\ufb01ix<\/p>\n
-3-<\/span><\/p>\n
deed dt. 21.3.1996 by the Housing society an.dv_d:e1ivery<\/p>\n
of possession. According to the petitioner,_.–+\u00a7he’ site <\/p>\n
one among the several sites formed on””ian7_dsV”‘acquired.p’ <\/p>\n
by the 2nd respondent~society7.after~ i’-layout<\/p>\n
plan sanction from the ‘*-._1S’ A’respondeIit’~’Ba\ufb01ga1oreL’<\/p>\n
Development Authority “a_nd_.ntherefoijehthere is no
\nimpediment for the”   to issue a katha
\ncerti\ufb01cate Vin’ .r_esp_’ect’ ‘  y_  property. The<\/p>\n
rejected -~ on the premise that site
\nNo.203u2\/A doesi\u00e9wriioteiigure in the approved Iayout plan,<\/p>\n
 condit’ion___._’3.of the work order issued on 3.3.2001<\/p>\n
‘ Tbifurcating any sites, the action of the 2nd<\/p>\n
.’  society in bifurcating site No.2032 and<\/p>\n
assigning site No.2032\/A was subject matter of<\/p>\n
  cliziri\ufb01cation. In response to the Ietter dt. 15.2.2005 of<\/p>\n
 the BDA, the I Housing Society submitted a revised<\/p>\n
layout plan showing site i\\io.2032\/A, conveyed to the<\/p>\n
petitioner.\n<\/p>\n

\n for Site No.2032\/A.\n<\/p>\n
   hlan sanctioned for forming
\nthe layout .  respondent-i~iousing Society<\/p>\n
 a si’te.h.earing N’o.2032. The conditions in the<\/p>\n
‘ .v.Viyorkv.,4oi*dez:4″impose a fetter on the Housing Society to<\/p>\n
it sites, therefore bifurcation of site No.2032 into<\/p>\n
two Iaortions, by assigning site No.2032\/A, cannot but<\/p>\n
V’  the Society biameworthy and as a consequence the<\/p>\n
rejection of the petitioners request to reiease the site<\/p>\n
bi<\/p>\n
and issue a katha, by the endorsement dt. 3.8.2005,<\/p>\n
cannot be faulted.\n<\/p>\n
4. Even otherwise, it is  <\/p>\n
petitioner has valid title to thebifurcated\u00e9ll :. <\/p>\n
so as to claim a right to be registered as _Aa–.1;athle’d_ai*:of<\/p>\n
the said site for the recordspjlof ythe’BDA.,_1\n<\/p>\n
5. Undoubtedly  respo,nderit–Housing<\/p>\n
Society, it is  submitted  revised plan on<\/p>\n
1.8.2005 shovfing thteieibifnrcated site bearing No.2032\/A
\nailottedliaand  to the petitioner over which no<\/p>\n
 is taken\u00ab….__.If\u00ab”that is so, it is for the society a Body<\/p>\n
‘.v.l’corpo_r’atev. having common seal and perpetual<\/p>\n
.’ isli1cce_s.sli’o_:1′,’ constituted under Section 9 of the Act to<\/p>\n
initiate action over the alleged indolence of the BDA and<\/p>\n
V’ , blydhence a member of the Society, in his \/ her individual<\/p>\n
 capacity cannot question the inaction of the BDA as is<\/p>\n
done by the Petitioner. The petitioner is not entitled to<\/p>\n
the relief of writ of mandamus to direct the BDA to<\/p>\n

adviced to initiate  legalwaction, permissible in law,
\nin terms’ of ‘the-fcontract; against the Society and not<\/p>\n
