                              DATE  :      22ND SEPTEMBER, 2009.\n      \n\n\n    ORAL ORDER :\n   \n\n\n\n      1.Mrs.Sharmila        Kaushik      states        that         she        has\n\n\n\n\n\n        given    consent     to     another     lawyer          Mr.Michael\n\n        D Souza      and    hence    she   may        be      discharged.\n\n        Mrs.Sharmila        Kaushik      stands        discharged                as\n\n\n\n\n\n<\/pre>\n
        Mr.Michael D Souza has filed Vakalatnama.\n<\/p>\n
      2.These    are    applications       filed        under         section<\/p>\n
        482     of   the    Criminal       Procedure              Code         for<\/p>\n
        quashing       of   the     private        complaint              cases<\/p>\n

       instituted by the respondent no.2 for offence<\/p>\n
       u\/s.138 of the Negotiable Instrument Act (for<\/p>\n
       short   the Act ).\n<\/p>\n
     3.It is not necessary to elaborately set out<\/p>\n
       the case put forth by the respondent no.2-\n<\/p>\n
       (complainant) in both the complaints.\n<\/p>\n
     4.Suffice    it    to     say       that     according             to       the<\/p>\n
       respondent   ig no.2,    certain          amount          was      placed<\/p>\n
       with the applicant (original accused no.2).\n<\/p>\n
       The applicant assured to repay that amount to<\/p>\n
       the respondent no.2 alongwith interest that<\/p>\n
       would fall due on the date of payment.                                    The<\/p>\n
       applicant delivered a cheque which was issued<\/p>\n
       by the original accused no.1, who is not a<\/p>\n
       party     to    the      application,                alongwith                a<\/p>\n
       covering       letter     issued          by        the        original<\/p>\n
       accused no.3, who had signed the cheque as an<\/p>\n
       authorized      signatory.               The        cheuqes             were<\/p>\n
       dishonoured when presented to the Bank.                                   The<\/p>\n
       respondent no.2 issued demand notice to the<\/p>\n
       applicant      and    other       accused         persons.                The<\/p>\n

       demand       notice     was       not      complied               with.\n<\/p>\n
       Consequently,         the        criminal          cases            were<\/p>\n
       instituted      vide        C.C.No.        S-698\/1998                 and<\/p>\n
       C.C.No. 697\/S of 1998.\n<\/p>\n
     5.The      applicant      would        submit            that           the<\/p>\n
       prosecution cannot withstand against it due<\/p>\n
       to the fact that the cheques were never drawn<\/p>\n
       on account of the applicant nor the applicant<\/p>\n
       can    be    regarded       as    drawer        of       the        said<\/p>\n
       cheques.      The     applicant         submits         that          the<\/p>\n
       process issued against the applicant-Company<\/p>\n
       is bad in law. The applicant further submits<\/p>\n
       that   the    applicant       had   no    domain          over        the<\/p>\n
       bank account of the original accused nos. 1 &<\/p>\n
       3. The applicant urged to quash the criminal<\/p>\n
       cases for the reason that no offence is made<\/p>\n
       out even if the averments in the complaints<\/p>\n
       are taken as they stand.\n<\/p>\n
     6.Heard learned counsel for the applicant and<\/p>\n
       learned APP. None appeared for respondent no.\n<\/p>\n

     7.On going through the averments made in the<\/p>\n
      complaints,           it         is        manifest            that           the<\/p>\n
      transactions          were            allegedly           between             the<\/p>\n
      respondent no.2 and the applicant, yet the<\/p>\n
      cheques in question were not issued on the<\/p>\n
      account of the applicant nor the applicant or<\/p>\n
      any representative of the applicant was the<\/p>\n
      signatory      of
\n                     ig     the        cheques.              The       applicant<\/p>\n
      merely handed over the cheuqes signed by the<\/p>\n
      original accused no.3 as authorized signatory<\/p>\n
      of    the    original        accused         no.1,         namely           M\/s.\n<\/p>\n
      Sinca       Fibers,        the        proprietory            concern            of<\/p>\n
      which Shri Balaram is shown as a Proprietor.\n<\/p>\n
      The    averments       made           in   the     complaints               show<\/p>\n
      that the description of the accused no.1 is<\/p>\n
      given as one Shri Balaram (Original Accused<\/p>\n
      No.1),       who    was          the       Sole       Proprietor                of<\/p>\n
      M\/s.Sinca Fibres, a proprietory concern.\n<\/p>\n
     8.What can be gathered from the averments in<\/p>\n
      the complaints, as such, is that to discharge<\/p>\n
      the financial liability of the applicants, a<\/p>\n

     third party i.e. the original accused no.2<\/p>\n
     issued     the    cheques       in       question.                    The<\/p>\n
     respondent no.2 may avail civil remedy for<\/p>\n
     recovery of the amount due.                 Still, however,<\/p>\n
     for the purpose of Section 138 of the Act,<\/p>\n
     criminal action could be taken only against<\/p>\n
     the drawer of the cheque.             The sub-clause (c)<\/p>\n
     of the proviso appended to section 138 of the<\/p>\n
     Act would also make it amply clear that the<\/p>\n
     offence would be completed when the drawer of<\/p>\n
     the cheque fails to make the payment of the<\/p>\n
     amount of money to the payee or to the holder<\/p>\n
     in due course, within 15 days of the receipt<\/p>\n
     of the demand notice.              Obviously, unless it<\/p>\n
     is shown that the applicant could be treated<\/p>\n
     as drawer of the cheuqe in the eye of law, no<\/p>\n
     criminal    action      can   be     instituted              against<\/p>\n
     him.     It follows that the averments in the<\/p>\n
     complaint    do   not    make      out     any       case         which<\/p>\n
     would    show     prima       facie,         the         necessary<\/p>\n
     ingredients of the offence punishable u\/s.138<\/p>\n

       of the Act.     In this view of the matter, the<\/p>\n
       process issued against the applicant is quite<\/p>\n
       unsustainable and they may amount to abuse of<\/p>\n
       the process of the court.\n<\/p>\n
     9.In the result, the applications are allowed.\n<\/p>\n
       The   private   complaint   cases        bearing            nos.\n<\/p>\n
       698\/S of 1998    & 697\/S of 1998 to the extent<\/p>\n
       of the applicant herein are quashed and the<\/p>\n
       applicant stands discharged.\n<\/p>\n
