The details of such inspection and copy of the report prepared after such inspection by the officer.\nC. The details of the officers date wise who have handles the representations of the applicant\n      submitted in the compliance with the direction of Hon'ble L.G.\nD. The complete noting with the individual remarks of the technical officers who have dealt with the\n      said representations.\nE. the details who were the competent officers including their ranks who were competent to\n      comment for taking a decision on said representation.\nReply of PIO:\nNot mentioned.\n\nGrounds for the First Appeal:\nNo response\/ reply to RTI application has been received within 30 days of submission of application\n\nOrder of the First Appellate Authority (FAA):\nIssued directions\/ orders to the PIO to furnish the information sought for in the RTI application within\none week.\n\nGround of the Second Appeal:\nThe Respondent did not comply the orders of the FAA inspite of lapse of considerable period no\nresponse to the order has been received.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Vinod Kumar Kedia;\n<\/p>\n<p>Respondent: Mr. Sushil Kumar, PIO &amp; SE;\n<\/p>\n<p>       The respondent admits that no information was sent to the Appellant until 09\/08\/2011. This has<br \/>\nnot been received by the Appellant but the photocopy is being given before the Commission. The PIO<br \/>\n is directed to provide information if any record exist of any action being taken or communication<br \/>\nbeing made with respect to representation of the Appellant as sought in query-C.\n<\/p>\n<p>The respondent states that the person responsible for providing the information was Mr. K. K.<br \/>\nKaushik, JE(B). The RTI application had been given to him on 25\/02\/2011. The respondent also states<br \/>\nthat the order of the FAA was also sent to Mr. Kaushik on<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The PIO is directed to provide the information on query-C to the Appellant<br \/>\nbefore 20 August 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\ndeemed PIO Mr. K. K. Kaushik, JE(B) within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it appears that the deemed PIO Mr. K. K. Kaushik, JE(B)is<br \/>\nguilty of not furnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the RTI Act. He has further refused to obey the<br \/>\norders of his superior officer, which raises a reasonable doubt that the denial of information may also<br \/>\nbe malafide. The First Appellate Authority has clearly ordered the information to be given.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>Mr. K. K. Kaushik, JE(B) will present himself before the Commission at the above address on<br \/>\n08 September 2011 at 4.30pm alongwith his written submissions showing cause why penalty should<br \/>\nnot be imposed on him as mandated under Section 20 (1). He will also submit proof of having given<br \/>\nthe information to the appellant.\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the Appellant the<br \/>\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before<br \/>\nthe Commission with him.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                    Shailesh Gandhi<br \/>\n                                                                                          Information Commissioner<br \/>\n                                                                                                     11 August 2011<br \/>\n         (In any correspondence on this decision, mention the complete decision number.
