Case No.5 of 2011 registered at Bhiloda Police Station, Dist.<br \/>\nSabarkantha for the offence punishable under Sections 363, 366,<br \/>\n506(2) and 376 of the Indian Penal Code and Section 3(2)5 of the<br \/>\nScheduled Castes and the Scheduled Tribes (Prevention of Atrocities)<br \/>\nAct.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate for the applicant and Mr H.L. Jani, learned APP for<br \/>\nthe State at length and in great detail. Having considered the rival<br \/>\nsubmissions and on perusal of the role attributed to the applicant as<br \/>\nreflected in the FIR, police papers, provisions of Sections 363, 366,<br \/>\n506(2) and 376 of the Indian Penal Code and Section 3(2)5 of the<br \/>\nScheduled Castes and the Scheduled Tribes (Prevention of Atrocities)<br \/>\nAct, quantum of punishment, etc., I am of the view that the applicant<br \/>\ndeserves to be enlarged on bail as there is no direct allegation<br \/>\nagainst the applicant, for the offences as alleged. At this stage of<br \/>\nbail, this Court is not discussing the evidence in detail.\n<\/p>\n<p>3.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith M. Case No. 5 of 2011 registered at Bhiloda Police Station,<br \/>\nDist. Sabarkantha on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] with one surety of the like amount to the satisfaction<br \/>\nof the Trial Court and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[f]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>4.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>5.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>6.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>7.\tRule<br \/>\nis made absolute to the aforesaid extent.
