Justice S.S.SATHEESACHANDRAN\n\n Dated :28\/06\/2010\n\n O R D E R\n<\/pre>\n<p>          Thottathil B.Radhakrishnan<\/p>\n<p>                       &amp;<\/p>\n<p>           S.S.Satheesachandran, JJ.\n<\/p>\n<p>= = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>           W.P.(C)No.18834 of 2010-S<\/p>\n<p>= = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>     Dated this the 28th day of June, 2010.<\/p>\n<p>                   Judgment<\/p>\n<p>Thottathil B.Radhakrishnan, J.<\/p>\n<p>The  trump-card  of  the   petitioner&#8217;s  case  in<\/p>\n<p>challenge to the impugned order of the Central<\/p>\n<p>Administrative Tribunal is Annexure-A8 in Ext.P3.<\/p>\n<p>He  tries  to   show  that  on   14.12.1989,  the<\/p>\n<p>Executive  Engineer\/Constn.,   Palayamkottai  got<\/p>\n<p>issued  that  communication  to   the  petitioner<\/p>\n<p>stating inter alia that adverting to the order<\/p>\n<p>dated   7.9.1989   issued   by   the   CAT,   the<\/p>\n<p>petitioner&#8217;s  service   particulars   have   been<\/p>\n<p>advised to DRM(P)\/TVC for inclusion of his name<\/p>\n<p>in the seniority list of project labourers of<\/p>\n<p>pre.1-1-81 list as per the letter referred to in<\/p>\n<p>that Annexure-A8 and to consider the petitioner<\/p>\n<p>for re-engagement according to his turn as and<\/p>\n<p><span class=\"hidden_text\">WPC18834\/10            -: 2 :-<\/span><\/p>\n<p> when vacancy arises. The fact of the matter<\/p>\n<p> remains    that  thereafter,    the petitioner and<\/p>\n<p> others filed O.A.1795\/1991. The petitioner was<\/p>\n<p> the 26th applicant in that case.        Though the<\/p>\n<p> matter was remitted by the Apex Court for re-<\/p>\n<p> consideration by the Tribunal, it was ultimately<\/p>\n<p> dismissed    as  per  Annexure    A10  order  dated<\/p>\n<p> 30.4.1998. Ten years thereafter, the original<\/p>\n<p> application from which this writ petition arises,<\/p>\n<p> was filed. The Tribunal came to the conclusion<\/p>\n<p> that the claims are nothing but repetitions of<\/p>\n<p> the claims made earlier in O.A.1795\/1991 and<\/p>\n<p> subsequent original applications and also matters<\/p>\n<p> before this Court. The petitioner appears to<\/p>\n<p> raise controversy as to the identity of one<\/p>\n<p> Sri.K.Mani    referred     to  in   the  order  in<\/p>\n<p> O.A.192\/2008, a portion of which is quoted in the<\/p>\n<p> impugned    order  issued     by  the  Tribunal in<\/p>\n<p> O.A.18\/2008. It is the case of the petitioner<\/p>\n<p> that different judgments directly binding the<\/p>\n<p> parties on facts have been issued by this Court<\/p>\n<p> and also by the Tribunal and all such materials<\/p>\n<p><span class=\"hidden_text\">WPC18834\/10           -: 3 :-<\/span><\/p>\n<p> have not been considered by the Tribunal.<\/p>\n<p> Perusing   the  materials,    we  find   that   the<\/p>\n<p> applicant(writ petitioner) had not placed all<\/p>\n<p> those materials before the Tribunal. At the first<\/p>\n<p> blush, we are not impressed by the argument that<\/p>\n<p> the finality of the judgment in O.A.1795\/1991 to<\/p>\n<p> which the petitioner was a party, does not stare<\/p>\n<p> at him. With this, the learned counsel for the<\/p>\n<p> petitioner sought leave to withdraw this writ<\/p>\n<p> petition   with liberty     to move  the   Tribunal<\/p>\n<p> seeking review of the impugned order.
