0?.O2.2DO’?, on a II Ciass ticket and”whiie-‘_;trat}eii.i’;f:d ihjthe V’<\/p>\n
train, the deceased was thirsty   <\/p>\n
was aiighting from the  .dr\u00abi._nk-._trteww\ufb01ki\/a’te’t ate<\/p>\n
Kodaganur Raiiway Sta’t.izdn, w\u00a7”1ete’-hie’-\u00bbfe|l ddwn. and died at
\nthe spot. According td”he’r,t’he train moved
\non her son, vxihetdil-ed   <\/p>\n

AW1 haisstated  to alight at Davangere and<\/p>\n
thetmcidenti o\u00bbc,cu”r’red’V’at.Kodaganoor, where the train was<\/p>\n
 stdbpeidi:’Afo:Vr”a.b0ut  3 minutes. Sgidghas further deposed<\/p>\n
 the_t,.iA son getting down from the train, even<\/p>\n
thdt:gh__”she” was sitting in her seat and after drinking<\/p>\n
  water,”her son boarded the train and due to the jerk of the<\/p>\n
“;t’r’aih:, he siipped and feti down and thereafter she shouted<\/p>\n
 ” ~~ehd the train was stopped and that, she gave a complamt<\/p>\n

ran over by the train on .;o’r’f” of””p!_atform and he
\nwent to the spot and_f.ou_n~d one maie”~-dead body, aged<\/p>\n
about 25 yeaiisy’eutintogtx\u00e9io”bie’Ces’:*aridtying on the side of
\nthe piatforhn   taken by him with
\nregarddvtoivhagyiingiviysent and a case being
\nregistered. –  report has been marked as<\/p>\n
Ex.RV–_lu. RW3 Vhasdadrn_itte’d that, he was not an eyewitness<\/p>\n
*’~..,_to  \u00a7_n:<:idr_ent tyhieh–\u00ab'occurred on 07.02.2007 and that he<\/p>\n
 \u00ab::am.e t-oV4'i<n:o.yii"'of the incident when he was informed by the<\/p>\n
.g*i:e'r.d th're.:\u00a7gh:=.yyaikie–takie.<\/p>\n
 RW~2; Syed Mukhtar, passenger guard in train<\/p>\n
0'   from Arsikere to Hubii on 07.02.2007, has deposed<\/p>\n
.\u00ab:_yV_t_hat, the train ieft Arsikere at 5:30 hours and reached<\/p>\n
Kodaganur at 8:39 hours and the scheduie stoppage of the<\/p>\n

train is one minute. Due to ASP in Coach  _<\/p>\n
he got down from the train immediateiy   <\/p>\n
ACP and peopie came running anti\u00bb info,rn’i:e”cio_t’hat-.one~-.,_\u00a3:o:;{oit<\/p>\n
had faiien on the off side. He _found–.tfje
\ndied on the spot, which he  to the
\nStation Master through beiinov told by
\nthe Station Master to  started at
\n8:49 hours. journal. In the
\ncross~examii\u00a7ati’o_hH.he”‘has’:’aoVn1’itt’eo”\u00a7th’at, he came to know
\nof the  train taking motion.\n<\/p>\n
He has adtnitted’  not an eyewitness to the<\/p>\n
incident _Vand4″‘th_eit=hve is  a technician. He has also<\/p>\n
:_f’S”admi’tte4d:,,,thathe havsmnot given any statement before the<\/p>\n
i3oii’:;ef’<\/p>\n
 B3\/referring to ,oara~117 of E><,A-2, the Ttihunai<\/p>\n
 =heAidVV'that, the deceased has committed suicide by<\/p>\n
.'.scoi*n:ing"AAacross train No.283, as he was disgusted in iife, as<\/p>\n

16. In my opinion, the Tribunal has erred. in<\/p>\n
holding that the applicants are not entitled <\/p>\n
compensation under S.124A of the Act.  ”<\/p>\n

under S.2(2.9)’l’e.f   ithe purpose of 8.12-4A<\/p>\n

\nvery uncommon on Indian trains is not the same thing
\nas a criminal act mentioned in clause (C) to the previso
\nto section 124A. A criminal act envisaged under Clause<\/p>\n
