This  “seeking enhancement of
\ncompensation  son in a motor vehicle
\n the  of convenience, the parties are<\/p>\n

 S’m_tu.’;_Si.1bhadra Parasharam Patii is the mother of<\/p>\n
‘:P.a19a~sharam Patii who died in a motor Vehicle accident.<\/p>\n
it aged about 28 years on the date of his death. On<\/p>\n
11.03.2001 deceased Gadigeyya Shiddayya Mathapati:’wifas<\/p>\n
driving KSRTC bus bearing No. KA\u00ab22F\/767 <\/p>\n
towards Dharwad. The deceased Datta.  it<\/p>\n
a passenger in that bus. When he came  Eishgmi; <\/p>\n
at Unakal, a truck bearing No.KA;2.$’;’..A–3009_ driirenu”ini”’a’rash 00 0<\/p>\n
and negligent manner by it–s__driV.er’ opposite
\ndirection and dashed against  accident,
\nDatta Parasharam   and died at
\nthe spot. He V.-person prior to the
\naccident.  shop. He was
\nearning Rs.6,V000’\/-0  the claimant preferred a
\nclaim petition \/– as compensation. After<\/p>\n
service _of n”oticie~,.p_ the respondents entered appearance.<\/p>\n
 Stateinaent piofiifolojections are filed contesting the claim.<\/p>\n
V’VV..i9lo’v:fever, “‘<\u00abthe..__"accident was not disputed as well as the<\/p>\n
 coverage to the truck. In fact the legal<\/p>\n
 of the driver of the KSRTC bus and the<\/p>\n
 cor-Jud'u"c'tor who was injured in the accident have also<\/p>\n
It\/…\n<\/p>\n
preferred claim petitions. All these cases were <\/p>\n
together. The Tribunal has framed three issues\ufb02ii <\/p>\n
has been examined as PW–1. They l’j;a\\fe’pr’oduced’:vthiirteielii<\/p>\n
documents which are at exhibits–Pl to <\/p>\n
respondents no oral evidence wasvTii::adduced,_i’ by
\nconsent of parties, insuranc”e.__policyiwapsiipirnarkediias’iexhibit–
\nR1. The Tribunal on consideration’oiffioraj:’a;rrd’_’..docurnentaIy
\nevidence on record   on account of
\nthe rash and   and claimant has
\nestablished    to the income of
\nthe deceased,iiiit.VV_heldi  no convincing evidence to
\nshow that   working as a T.\\\/. repairer and<\/p>\n
was “business and earning Rs.6,000\/– p.m.<\/p>\n
 T hereforergitpiit’oio3\u00ab::_tl1ie-income as Rs.70\/– per day deducted SO<\/p>\n
 cent to—wa:_’ds~vhis personal expenses, took the age of the<\/p>\n
T  as_.thei”criteria for applying the multiplier, applying 12<\/p>\n
 i_the”‘._in1’t’1ltip1ier and awarded a sum of Rs.1,4-4,000\/-<\/p>\n
iii’i”‘:__toward’s”loss of dependency. To that it added Rs.5,000\/-<\/p>\n
it\/T<\/p>\n
towards funeral expenses, Rs.5,000\/– towards lossptpoft<\/p>\n
and Rs.2,000\/- towards transportation and  <\/p>\n
conveyance, in all a sum of Rs,’1”,S’550QQ\/–.;< <\/p>\n
-compensation. Aggrieved by the said award, <\/p>\n
in appeal.\n<\/p>\n
3. Learned counsel  the
\nimpugned judgment avirard deceased was
\nworking as T.\\\/fl     labour. Merely
\nbecause no  showthe income of
\nRs.6,000\/–,   justified in taking the
\nincome of \/– per day as the accident<\/p>\n
   Therefore, he seeks for<\/p>\n
enhancement.o\u00a3.co\ufb01:-p–ensation.<\/p>\n
:4_ Per “contra learned counsel for the respondents<\/p>\n
  the impugned award.\n<\/p>\n<\/p>\n
5. From the aforesaid material it is c1earW._that-aidtheV.<\/p>\n
deceased was aged 28 years, he was not married\ufb02iie.   V’ <\/p>\n

i";oiV\u00b0Vi1oss of deperideiiicy. We award Rs. 10,000\/– towards loss of<\/p>\n
 Rs._.10,'GCO\/– towards loss of love and affection to the<\/p>\n
Rs.10,000\/– for obsequies and transportation of<\/p>\n
Needy. Thus the claimant is in all entitled to<\/p>\n
L\/.\n<\/p>\n
Rs.2,64,000\/–. To that extent the appeal succeeds. Henceltsye
\npass the following order: l<\/p>\n
