Mr. Joshi waives service of the Rule on<br \/>\n     behalf of respondent.\n<\/p>\n<p>     The parties have produced the consent terms and<br \/>\n     it has been submitted that a sum of Rs.30,000\/- is to be<br \/>\n     paid by Ashima Syntex Ltd. to the respondent Y.B.Solanki\n<\/p>\n<p>     &#8211; in lieu of full and final settlement of all the claims,<br \/>\n     rights   and   disputes regarding wages or any other<br \/>\n     consequential benefits raised by the respondent whether<br \/>\n     arising out of the Award dated 10.12.95 passed by the<br \/>\n     Labour Court,Kalol in Reference (LCK) No.281 of 1988 or<br \/>\n     otherwise. The consent terms dated 5.5.97 duly singed by<br \/>\n     Y.B.Solanki-respondent and his counsel G.M. Joshi, by<br \/>\n     B.H. Jani-General Manager (Legal) and his counsel Mr.<br \/>\n     Vyas are reproduced as under and this document containing<br \/>\n     the consent terms shall remain on record as part of this<br \/>\n order.\n<\/p>\n<p>&#8220;1. Ashima Syntex Ltd. (hereinafter referred to<br \/>\nas the &#8216;petitioner Company&#8217;) agrees to pay an amount of<br \/>\nRs.30,000\/- to the respondent herein by way of a full and<br \/>\nfinal settlement of all the claims, rights and disputes<br \/>\nregarding wages or any other consequential benefits<br \/>\nraised by the respondent, whether arising out of the<br \/>\nAward dated 10.12.1995 passed by the Labour Court, Kalol<br \/>\nin Reference (LCK) No.281 of 1988 or otherwise.\n<\/p>\n<p>2.The respondent herein agrees and undertakes to<br \/>\naccept an amount of Rs.30,000\/- by way of full and final<br \/>\nsettlement of all claims and disputes, including the<br \/>\nclaim regarding the wages of any other consequential<br \/>\nbenefits either with regard to the service rendered by<br \/>\nthe respondent in the petitioner company or otherwise,<br \/>\nwhether arising out of the Award passed by the Labour<br \/>\nCourt,Kalol dated 10.12.1995 or otherwise.\n<\/p>\n<p>3.The respondent further agrees and undertakes that<br \/>\nno other claim or dispute,including       the   aforesaid<br \/>\nbenefits against the petitioner company whether arising<br \/>\nout of Award passed by the Labour Court, Kalol or<br \/>\notherwise,   would   survive in light of the present<br \/>\nsettlement and if there is any,then the same is deemed<br \/>\nand treated as foregone and waived.\n<\/p>\n<p>4.The respondent agrees and undertakes to accept<br \/>\nthe amount of Rs.30,000\/- by way of full and final<br \/>\nsettlement   of   all   his claims, dues, rights etc.<br \/>\nincluding reinstatement in service, back wages,bonus,<br \/>\ngratuity,   other   allowances,   leave   or    any other<br \/>\nconsequential benefits, whether arising out of the Award<br \/>\npassed by the Labour Court, Kalol or otherwise.\n<\/p>\n<p>5.It is agreed upon by and between the parties and<br \/>\naccepted and undertaken by the respondent that the<br \/>\npresent settlement is a full and final settlement of all<br \/>\nthe claims or disputes of the respondent against the<br \/>\npetitioner   company   and   the respondent agrees and<br \/>\nundertakes to withdraw all other proceedings which might<br \/>\nhave been initiated by him or on his behalf or at his<br \/>\ninstance against the petitioner company or otherwise<br \/>\nbefore any court or any other authority.&#8221;\n<\/p>\n<p>On the request of both the sides, the matter has<br \/>\nbeen decided on the basis of these consent terms. This<br \/>\nSpecial Civil Application is allowed and the impugned<br \/>\nAward dated 10.11.95 is modified accordingly.      The<br \/>\nrights, duties and obligations of the parties shall,<br \/>\n therefore, be governed by these consent terms instead of<br \/>\nthe impugned award and the impugned award shall stand<br \/>\nmodified accordingly. It is also stated that the amount<br \/>\nsettled and agreed between the parties has already been<br \/>\npaid by the petitioner to the respondent and that is the<br \/>\nend of the whole controversy.
