The<br \/>\npetitioner is facing the trial for offences punishable under Sections<br \/>\n7, 13 (1) and 13 (2) of the Prevention of Corruption Act, 1988 and he<br \/>\nhad made the application at Exh.85, at the fag end of trial, for<br \/>\nordering further investigation under the provisions of Sub-section<br \/>\n(8) of Section 173 of the Criminal Procedure Code.\n<\/p>\n<p>2.\tIt<br \/>\nwas argued before learned Special Judge and reiterated before this<br \/>\nCourt that since the original complainant had complained about demand<br \/>\nof additional sum of Rs.50\/- for releasing the vehicle of the<br \/>\ncomplainant and that police officer was not joined as an accused<br \/>\nperson the petitioner was prejudiced in his defence; and further<br \/>\ninvestigation was required to be carried out for identifying the<br \/>\nofficer, who has alleged to have instructed the complainant to pay<br \/>\nadditional sum on the next date.  It was further submitted by learned<br \/>\ncounsel, Mr.Kanara, that the particular officer having been<br \/>\nidentified only after deposition of the investigating officer on<br \/>\n29.4.2006, the petitioner&#8217;s application could not be treated as<br \/>\ndeliberately delayed.\n<\/p>\n<p>3.\tAs<br \/>\nagainst that learned APP, Mr.Kartik Pandya, supported the impugned<br \/>\norder and pointed out the peculiar facts and circumstances of the<br \/>\ncase in which further investigation could serve no purpose at all.<br \/>\nIt was clear from the facts stated in the impugned order that the<br \/>\ncharge sheet against the petitioner was filed in the year 1999 and<br \/>\nthe case against the petitioner could have been gathered from the<br \/>\npapers of the charge sheet.  Thereafter the original complainant had<br \/>\npassed away even before his deposition could be recorded in the<br \/>\ncriminal case.  Then there remained no evidence about identity of any<br \/>\npolice officer, who was alleged to have instructed the complainant to<br \/>\npay additional sum on the next date for releasing his vehicle.  Thus,<br \/>\nin short the trial Court had rightly come to the conclusion that<br \/>\nfurther investigation was unlikely to serve any purpose.\n<\/p>\n<p>4.\tLearned<br \/>\ncounsel, Mr.Kanara, however, relied upon judgment of this Court in<br \/>\n <a href=\"\/doc\/1208487\/\">Valiben, W\/o. Vitthalbhai Narsinhbhai and Others v. State of<br \/>\nGujarat<\/a> [2006 (2) GLH<br \/>\n354] to<br \/>\nsubmit that it was the bounden duty of the investigating agency to<br \/>\ncollect such material and place it on record as may be essential for<br \/>\nfinding the truth in the case.  He also relied upon recent judgment<br \/>\nof the Supreme Court in  <a href=\"\/doc\/1234689\/\">Manoj Narain Agrawal v.<br \/>\nShashi Agrawal<\/a> etc.<br \/>\n[2009 (2) GLH 782]<br \/>\nto submit that further investigation can be directed under Section<br \/>\n173 (8) even after an order taking cognizance and at any stage.<br \/>\nHowever, as seen earlier and as discussed in the impugned order,<br \/>\nfurther investigation was unlikely to serve any purpose and the<br \/>\nessential material for finding the truth in the case was already<br \/>\nplaced before the Court.  Therefore, the application of the<br \/>\npetitioner appears to be an attempt at delaying the conclusion of<br \/>\ntrial and to identify and bring in one more accused person, which<br \/>\ncould not be said to be in furtherance of defence of the petitioner.<br \/>\nTherefore, in the peculiar facts and circumstances, neither any<br \/>\nillegality nor any impropriety could be found in the impugned order<br \/>\nand accordingly present application is dismissed.
