include\u00a0only\u00a0one\u00a0cluster\u00a0i.e.\u00a0Dhanbad\u00a0in\u00a0the\u00a0State\u00a0of\u00a0Jharkhand\u00a0and\u00a0not\u00a0the \u00a0<br \/>\n      Barajamada\u00a0industrial\u00a0cluster\u00a0where\u00a0the\u00a0iron\u00a0ore\u00a0crusher\u00a0of\u00a0the\u00a0petitioner\u00a0is \u00a0<br \/>\n      located.\n<\/p><\/blockquote>\n<blockquote><p>      10.\u00a0 It\u00a0is\u00a0submitted\u00a0that\u00a0the\u00a0notification\u00a0dated\u00a027.7.2010\u00a0issued\u00a0by\u00a0Forest\u00a0and \u00a0<br \/>\n      Environment \u00a0 Department, \u00a0 Govt. \u00a0 of \u00a0 Jharkhand, \u00a0 Ranchi \u00a0 is \u00a0 not \u00a0 in \u00a0 consonance \u00a0<br \/>\n      with\u00a0O.M.\u00a0dated\u00a013.1.2010\u00a0issued\u00a0by\u00a0the\u00a0Ministry\u00a0of\u00a0Environment\u00a0&amp;\u00a0Forest.&#8221;\n<\/p><\/blockquote>\n<blockquote><p> \u00a0The\u00a0State\u00a0of\u00a0Jharkhand\u00a0has\u00a0issued\u00a0a\u00a0direction\u00a0dated\u00a027th\u00a0 July,\u00a02010, \u00a0<br \/>\n<span class=\"hidden_text\">                                          2.<\/span><br \/>\nwhich\u00a0has\u00a0been\u00a0referred\u00a0in\u00a0the\u00a0aforesaid\u00a0paragraph\u00a0nos.\u00a09\u00a0and\u00a010\u00a0of\u00a0the\u00a0<br \/>\ncounter\u00a0affidavit,\u00a0mainly\u00a0relying\u00a0upon\u00a0the\u00a0office\u00a0memorandum,\u00a0issued\u00a0by\u00a0<br \/>\nthe\u00a0Central\u00a0Government\u00a0dated\u00a013th\u00a0January,\u00a02010.\u00a0Thus,\u00a0it\u00a0appears\u00a0that\u00a0the\u00a0<br \/>\ndirection\u00a0issued\u00a0by\u00a0the\u00a0State\u00a0Government\u00a0dated\u00a027th\u00a0 July,\u00a02010\u00a0is\u00a0based\u00a0<br \/>\nupon \u00a0 some \u00a0 misinterpretation \u00a0 or \u00a0 misreading \u00a0 of \u00a0 the \u00a0 office \u00a0 memorandum,\u00a0<br \/>\nissued\u00a0by\u00a0the\u00a0Central\u00a0Government\u00a0dated\u00a013th\u00a0January,\u00a02010.\u00a0Therefore,\u00a0the\u00a0<br \/>\nsubsequent\u00a0order,\u00a0issued\u00a0by\u00a0the\u00a0Jharkhand\u00a0State\u00a0Pollution\u00a0Control\u00a0Board\u00a0at\u00a0<br \/>\nAnnexure\u00ad2\u00a0to\u00a0the\u00a0memo\u00a0of\u00a0this\u00a0petition\u00a0is\u00a0also\u00a0sailing\u00a0in\u00a0the\u00a0same\u00a0boat,\u00a0<br \/>\nbecause\u00a0this\u00a0order\u00a0at\u00a0Annexure\u00ad2\u00a0has\u00a0been\u00a0passed\u00a0in\u00a0August,\u00a02010,\u00a0based\u00a0<br \/>\nupon\u00a0the\u00a0direction,\u00a0issued\u00a0by\u00a0the\u00a0State\u00a0of\u00a0Jharkhand\u00a0dated\u00a027th\u00a0July,\u00a02010.\u00a0\n<\/p><\/blockquote>\n<p>Thus, \u00a0 there \u00a0 is \u00a0 a \u00a0 prima \u00a0 facie \u00a0 case \u00a0 in \u00a0 favour \u00a0 of \u00a0 the \u00a0 present \u00a0 petitioner.<br \/>\nMoreover, \u00a0 looking \u00a0 to \u00a0 the \u00a0 requirement \u00a0 of \u00a0 Section \u00a0 21(4), \u00a0 if \u00a0 there \u00a0 is \u00a0 any\u00a0<br \/>\nbreach\u00a0of\u00a0any\u00a0of\u00a0the\u00a0conditions\u00a0upon\u00a0which,\u00a0the\u00a0consent\u00a0was\u00a0given\u00a0by\u00a0the\u00a0<br \/>\nPollution\u00a0Control\u00a0Board,\u00a0then\u00a0the\u00a0State\u00a0Pollution\u00a0Control\u00a0Board\u00a0can\u00a0refuse\u00a0<br \/>\nfurther \u00a0 consent \u00a0 after \u00a0 expiry \u00a0 of \u00a0 the \u00a0 earlier \u00a0 consent. \u00a0 In \u00a0 the \u00a0 facts \u00a0 of \u00a0 the\u00a0<br \/>\npresent\u00a0case,\u00a0in\u00a0advance,\u00a0the\u00a0State\u00a0has\u00a0declared\u00a0its\u00a0intention\u00a0not\u00a0to\u00a0grant\u00a0<br \/>\nconsent\u00a0or\u00a0not\u00a0to\u00a0renew\u00a0the\u00a0consent,\u00a0without\u00a0pointing\u00a0out,\u00a0any\u00a0breach\u00a0of\u00a0<br \/>\nany\u00a0of\u00a0the\u00a0conditions.\u00a0Moreover,\u00a0as\u00a0per\u00a0the\u00a02nd\u00a0Proviso\u00a0to\u00a0Sub\u00adsection\u00a04\u00a0of\u00a0<br \/>\nSection \u00a0 21 \u00a0 of \u00a0 the \u00a0 Air \u00a0 (Prevention \u00a0 and \u00a0 Control \u00a0 of \u00a0 Pollution) \u00a0 Act, \u00a0 1981,\u00a0<br \/>\nbefore\u00a0refusing\u00a0further\u00a0consent\u00a0under\u00a0the\u00a01st\u00a0 Proviso\u00a0of\u00a0Sub\u00adsection\u00a04\u00a0of\u00a0<br \/>\nSection\u00a021,\u00a0a\u00a0reasonable\u00a0opportunity\u00a0of\u00a0being\u00a0heard\u00a0ought\u00a0to\u00a0have\u00a0been\u00a0<br \/>\ngiven \u00a0 to \u00a0 the \u00a0 petitioner. \u00a0 Prima \u00a0 facie, \u00a0 looking \u00a0 to \u00a0 the \u00a0 facts \u00a0 of \u00a0 the \u00a0 case, \u00a0 it\u00a0<br \/>\nappears \u00a0 that \u00a0 the \u00a0 State \u00a0 Government \u00a0 is \u00a0 not \u00a0 alleging \u00a0 any \u00a0 breach \u00a0 of \u00a0 the\u00a0<br \/>\ncondition \u00a0of \u00a0the \u00a0consent,\u00a0previously\u00a0 given\u00a0 by\u00a0the \u00a0respondent\u00adBoard,\u00a0nor\u00a0<br \/>\nany\u00a0opportunity\u00a0of\u00a0being\u00a0heard\u00a0has\u00a0been\u00a0given\u00a0by\u00a0the\u00a0respondent\u00adBoard\u00a0to\u00a0<br \/>\nthe\u00a0petitioner\u00a0before\u00a0issuing\u00a0the\u00a0direction,\u00a0as\u00a0stated\u00a0in\u00a0the\u00a0impugned\u00a0order\u00a0<br \/>\nin\u00a0August,\u00a02010.\u00a0\u00a0Balance\u00a0of\u00a0convenience\u00a0is\u00a0also\u00a0in\u00a0favour\u00a0of\u00a0the\u00a0petitioner\u00a0<br \/>\nas\u00a0the\u00a0petitioner,\u00a0which\u00a0is\u00a0a\u00a0working\u00a0unit,\u00a0has\u00a0never\u00a0received\u00a0any\u00a0notice\u00a0for\u00a0<br \/>\nbreach\u00a0of\u00a0any\u00a0of\u00a0the\u00a0conditions,\u00a0upon\u00a0which\u00a0the\u00a0consent\u00a0was\u00a0previously\u00a0<br \/>\ngiven \u00a0 by \u00a0 the \u00a0 respondent\u00adBoard \u00a0 and \u00a0 the \u00a0 petitioner \u00a0 has \u00a0 invested \u00a0 sizable\u00a0<br \/>\namount\u00a0towards\u00a0the\u00a0establishment\u00a0of\u00a0the\u00a0crushing\u00a0unit.\u00a0In\u00a0view\u00a0of\u00a0these\u00a0<br \/>\nfacts,\u00a0an\u00a0irreparable\u00a0loss\u00a0will\u00a0also\u00a0be\u00a0caused\u00a0to\u00a0the\u00a0petitioner,\u00a0if\u00a0the\u00a0stay,\u00a0as\u00a0<br \/>\nprayed\u00a0for,\u00a0is\u00a0not\u00a0granted.\u00a0\n<\/p>\n<p>9.\u00a0 \u00a0 \u00a0I\u00a0therefore,\u00a0stay\u00a0the\u00a0operation,\u00a0implementation\u00a0and\u00a0execution\u00a0of\u00a0the\u00a0<br \/>\nimpugned \u00a0 order, \u00a0 passed \u00a0 by \u00a0 the \u00a0 respondents\u00adJharkhand \u00a0 State \u00a0 Pollution \u00a0<br \/>\n<span class=\"hidden_text\">                                    3.<\/span><br \/>\nControl\u00a0Board,\u00a0dated\u00a021st\u00a0 November,\u00a02009,\u00a0which\u00a0is\u00a0at\u00a0Annexure\u00ad2\u00a0to\u00a0the\u00a0<br \/>\nmemo\u00a0of\u00a0this\u00a0writ\u00a0petition,\u00a0till\u00a0the\u00a0next\u00a0date\u00a0of\u00a0hearing.\n<\/p>\n<p>10.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Counsel\u00a0for\u00a0the\u00a0respondent\u00adUnion\u00a0of\u00a0India,\u00a0respondent\u00adState\u00a0and\u00a0<br \/>\nother \u00a0 respondents \u00a0 are \u00a0 seeking \u00a0 time \u00a0 to \u00a0 file \u00a0 their \u00a0 respective \u00a0 counter\u00a0<br \/>\naffidavits.\u00a0\n<\/p>\n<p>11.    Time,\u00a0as\u00a0prayed\u00a0for,\u00a0is\u00a0granted.\u00a0\n<\/p>\n<p>12.
