{"id":137529,"date":"2011-05-12T00:00:00","date_gmt":"2011-05-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/vasant-vs-state-on-12-may-2011"},"modified":"2016-05-10T01:08:29","modified_gmt":"2016-05-09T19:38:29","slug":"vasant-vs-state-on-12-may-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/vasant-vs-state-on-12-may-2011","title":{"rendered":"Vasant vs State on 12 May, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Vasant vs State on 12 May, 2011<\/div>\n<div class=\"doc_author\">Author: J.B.Pardiwala,&amp;Nbsp;<\/div>\n<pre>   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nCR.MA\/6274\/2011\t 3\/ 3\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nCRIMINAL\nMISC.APPLICATION No. 6274 of 2011\n \n\n \n \n=========================================================\n\n\n \n\nVASANT\nBHIKHABHAI PATEL - Applicant(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT - Respondent(s)\n \n\n=========================================================\n \nAppearance : \nHL\nPATEL ADVOCATES for Applicant(s) : 1, \nMR RC KODEKAR APP for\nRespondent(s) :\n1, \n========================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP, Mr.R.C.Kodekar, waives service of notice of rule on<br \/>\nbehalf of State.\n<\/p>\n<p>\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nJ.P.Road Police Station, Vadodara vide C.R.No.II-64 of 2011 for the<br \/>\noffences punishable under Sections 20, 29 and 58 of the Narcotic<br \/>\nDrugs and Psychotropic Substances (NDPS) Act, 1985.\n<\/p>\n<p>\tIt<br \/>\nappears from the case of the prosecution that some individuals were<br \/>\ncharge-sheeted for having found in possession of Narcotic Drugs.<br \/>\nSubsequently, Investigating Agency came out with a case that the<br \/>\npersons who have been charge-sheeted were wrongly framed up by the<br \/>\naccused-applicant herein by surreptitiously placing small quantity of<br \/>\nGanja\u00a0in their premises.\n<\/p>\n<p>Accordingly, accused-applicant<br \/>\nis now facing prosecution for offence punishable under Section 20, 29<br \/>\nand 58 of NDPS Act.\n<\/p>\n<p>\tParties<br \/>\nhave not pressed for reasoned order.\n<\/p>\n<p>\tIt<br \/>\nis evident from the case of the prosecution itself that this is a<br \/>\ncase of the small quantity and that of Ganja.\n<\/p>\n<p>\tAs<br \/>\nper Section 20 of the Act, in contravention relating to sub-clause\n<\/p>\n<p>(b) of Section 20 involving small quantity would be punishable for<br \/>\nrigorous imprisonment for a term  which may extend to six months, or<br \/>\nwith fine, which may extend to ten thousand rupees, or with both;\n<\/p>\n<p>\tIn<br \/>\nthe same manner, Section 58 (2) which makes a person who willfully or<br \/>\nmaliciously gives false information, and so causing an arrest or a<br \/>\nsearch being made under this Act shall be punishable with<br \/>\nimprisonment for a term which may extend to two years or with fine or<br \/>\nwith both.\n<\/p>\n<p>\tHaving<br \/>\nregard to the nature of offence, the allegations levelled against the<br \/>\naccused-applicant the position of law, more particularly, keeping in<br \/>\nmind Section 37 of the Act which is not applicable in the present<br \/>\ncase, I am persuaded to exercise my discretion in favour of<br \/>\nthe accused-applicant. Under the circumstances, accused-applicant is<br \/>\nordered to be enlarged on regular bail in<br \/>\nconnection with offence registered with J.P.Road Police Station being<br \/>\nC.R.No.II-64 of 2011 on his executing a bond in the sum of<br \/>\nRs.25,000\/- (Rupees twenty five thousand only) with one surety of the<br \/>\nlike amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 2nd<br \/>\n\tand 4th Sunday of every month between 10:00 am to 2:00 pm<br \/>\n\ttill the completion of the trial;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
