Dabhi, learned Additional Public Prosecutor waives service<br \/>\nof notice of rule for respondent No.1 ?  State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\nregard to the facts of the case, with the consent of the learned<br \/>\nadvocates for the parties, the matter is taken up for hearing today.\n<\/p>\n<p>3.\tBy<br \/>\nthis petition, the applicants seek quashment of the First Information<br \/>\nReport being City Police Station, Vadodara City I C.R. No.4\/08 qua<br \/>\nthe present applicants.\n<\/p>\n<p>4.\tThe<br \/>\napplicants No.1 and 2 are the original accused No.2 and 3 and the<br \/>\napplicant No.3 is the original complainant.\n<\/p>\n<p>5.\tIt<br \/>\nappears that subsequent to filing of the complaint, the present<br \/>\napplicants have settled the dispute between them and the applicant<br \/>\nNo.3, who is the daughter-in-law of the applicants No.1 and 2, has<br \/>\nstarted residing with the applicants No.1 and 2 and therefore, does<br \/>\nnot desire to pursue the present complaint any further. The applicant<br \/>\nNo.3 Jayshree Chauhan has filed an affidavit dated 25th<br \/>\nMarch, 2008, wherein it has been specifically averred that the<br \/>\ndispute has been amicably settled and therefore, she does not wish to<br \/>\ncontinue with the criminal complaint initiated by her against her<br \/>\nhusband namely, Kalpeshbhai Chauhan (who is arrayed as accused No.1<br \/>\nin the criminal complaint), her father-in-law and her mother-in-law.\n<\/p>\n<p>6.\tMr.\n<\/p>\n<p>P.P. Majmudar, learned advocate for the applicants has submitted that<br \/>\nin the background of the facts noted hereinabove, considering the<br \/>\nfact that the applicants have settled the dispute between them and<br \/>\nthe applicant No.3 who is the daughter-in-law of the applicants No.1<br \/>\nand 2, has started residing with the applicants No.1 and 2 at their<br \/>\nresidence, continuation of the present proceedings would amount to an<br \/>\nabuse of the process of Court. It is submitted that considering the<br \/>\nfact that this is a matrimonial dispute which has been amicably<br \/>\nsettled between the parties, this Court has ample power to quash the<br \/>\ncomplaint in question in exercise of its inherent jurisdiction.<br \/>\nReliance is placed upon a decision of the Supreme Court in the case<br \/>\nof B.S. Joshi v. State of Haryana, AIR 2003 SC 1386. It is<br \/>\nsubmitted that in the circumstances, the complaint in question is<br \/>\nrequired to be quashed in the interest of justice.\n<\/p>\n<p>7.\tIn<br \/>\nthe case of  B.S. Joshi v. State of<br \/>\nHaryana, the Supreme Court has held as follows:-\n<\/p>\n<p>?S13.\n<\/p>\n<p>The observations made by this Court, though in a slightly different<br \/>\ncontext, in <a href=\"\/doc\/116781\/\">G. V. Rao v. L.H.V. Prasad and others<\/a> ((2000) 3 SCC 693)<br \/>\nare very apt for determining the approach required to be kept in view<br \/>\nin matrimonial dispute by the Courts, it was said that there has been<br \/>\nan outburst of matrimonial disputes in recent times. Marriage is a<br \/>\nsacred ceremony, the main purpose of which is to enable the young<br \/>\ncouple to settle down in life and live peacefully. But little<br \/>\nmatrimonial skirmishes suddenly extent which often assume serious<br \/>\nproportions resulting in commission of heinous crimes in which elders<br \/>\nof the family are also involved with the result that those who could<br \/>\nhave counselled and brought about rapprochement are rendered helpless<br \/>\non their being arrayed as accused in the criminal case. There are<br \/>\nmany other reasons which need not be mentioned here for not<br \/>\nencouraging matrimonial litigation so that the parties may ponder<br \/>\nover their defaults and terminate their disputes amicably by mutual<br \/>\nagreement instead of fighting it out in a Court of law where it takes<br \/>\nyears and years to conclude and in that process the parties lose<br \/>\ntheir &#8220;young&#8221; days in chasing their &#8220;cases&#8221; in<br \/>\ndifferent Courts.\n<\/p>\n<p>14.<br \/>\nThere is no doubt that the object of introducing Chapter XX-A<br \/>\ncontaining Section 498A in the Indian Penal Code was to prevent the<br \/>\ntorture to a woman by her husband or by relatives of her husband.<br \/>\nSection 498A was added with a view to punishing a husband and his<br \/>\nrelatives who harass or torture the wife to coerce her or her<br \/>\nrelatives to satisfy unlawful demands of dowry. The hyper-technical<br \/>\nview would be counter productive and would act against interests of<br \/>\nwomen and against the object for which this provision was added.<br \/>\nThere is every likelihood that non-exercise of inherent power to<br \/>\nquash the proceedings to meet the ends of justice would prevent women<br \/>\nfrom settling earlier. That is not the object of Chapter XXA of<br \/>\nIndian Penal Code.\n<\/p>\n<p>15.<br \/>\nIn view of the above discussion, we hold that the High Court in<br \/>\nexercise of its inherent powers can quash criminal proceedings or FIR<br \/>\nor complaint and Section 320 of the Code does not limit or affect the<br \/>\npowers under Section 482 of the Code.??\n<\/p>\n<p>8.\tConsidering<br \/>\nthe facts of the present case in the light of the decision of the<br \/>\nSupreme Court cited hereinabove, it is an undisputed position that<br \/>\nthe applicants i.e. the original complainant and original accused<br \/>\nNo.2 and 3 have settled the dispute amicably between them, pursuant<br \/>\nto which the applicant No.3 has started residing with her in-laws<br \/>\ni.e. the applicants No.1 and 2, at their residence. In the<br \/>\ncircumstances, this Court is of the view that the interest of justice<br \/>\nwould best be served if the complaint in question is quashed, so that<br \/>\nthe parties can live together peacefully. Besides, continuance of<br \/>\ninvestigation pursuant to the complaint would not allow the applicant<br \/>\nNo.3 to reside comfortably with her in-laws and may therefore, result<br \/>\nin creating problems for her in future. In the circumstances keeping<br \/>\nin view the interest of the applicant No.3, this Court is of the<br \/>\nopinion that this is a fit case for exercise of powers under section<br \/>\n482 of the Code of Criminal Procedure, 1973.\n<\/p>\n<p>9.\tFor<br \/>\nthe foregoing reasons, the petition succeeds and is accordingly<br \/>\nallowed. The First Information Report being City Police Station,<br \/>\nVadodara City I C.R. No.4\/08, is hereby quashed.
