Whether the judgement should be reported in the digest?\n\nM.M KUMAR, J.\n<\/pre>\n<p>           The petitioner has approached this Court with a prayer for<\/p>\n<p>issuance of direction to the respondent to grant licence under the<\/p>\n<p>name and style of Golden Enclave at Village Dhandra Thakarwal,<\/p>\n<p>Tehsil and District Ludhiana on land measuring 49.55 acres.<\/p>\n<p>           In response to notice of motion, respondents have filed a<\/p>\n<p>written statement.     When the matter came up for further<\/p>\n<p>consideration on 7.11.2008, it transpired that the petitioner was<\/p>\n<p>issued a letter dated 11.10.2006 (incorrectly mentioned in the last<\/p>\n<p>order as 8.11.2006) requiring him to comply with the conditions<br \/>\n<span class=\"hidden_text\"> CWP No. 2813 of 2008                                            2<\/span><\/p>\n<p>mentioned therein. In the written statement, the stand taken is that<\/p>\n<p>there is revised policy and accordingly further conditions are required<\/p>\n<p>to be complied with. Learned counsel for the petitioner had argued<\/p>\n<p>that at no stage compliance of additional requirements was intimated<\/p>\n<p>and therefore, there was no legal obligations caste on the petitioner<\/p>\n<p>to comply with the same.\n<\/p>\n<p>             Accordingly we had issued directions to the counsel for<\/p>\n<p>the respondents to obtain instructions as to when the requisite<\/p>\n<p>licence could be issued to the petitioner.        In response to the<\/p>\n<p>aforementioned direction, Sh. Balwinder Singh learned counsel for<\/p>\n<p>the respondents, has placed on record a copy of the licence dated<\/p>\n<p>12.11.2008 showing that the licence has been issued to the<\/p>\n<p>petitioner. The same is taken on record as Mark `A&#8217;. Mr. Tushar<\/p>\n<p>Sharma, learned counsel for the petitioner has stated that the instant<\/p>\n<p>petition has been rendered infructuous and the petitioner should be<\/p>\n<p>given liberty with regard to Clause No.10 because a separate letter is<\/p>\n<p>sought to be issued by the respondents regarding payment of CLU<\/p>\n<p>charges, external development charges and licence fee.<\/p>\n<p>             In view of the above, the instant petition is dismissed as<\/p>\n<p>having been rendered infructuous.
