Justice K.T.SANKARAN\n\n Dated :12\/10\/2010\n\n O R D E R\n                  K.T.SANKARAN, J.\n          ------------------------------\n         W.P.(C).Nos.13980 &amp; 20860 OF 2010\n          ------------------------------\n      Dated this the 12th day of October, 2010\n\n\n\n                       JUDGMENT\n<\/pre>\n<p>    A.G.Hareendranath is a non vocational teacher<\/p>\n<p>in English in Kuzhikkalidavaka Vocational Higher<\/p>\n<p>Secondary     School,      Karimbinpuzha,        Kollam.<\/p>\n<p>Hareendranath was placed under suspension by the<\/p>\n<p>Manager as per the order dated 28.11.2009.           The<\/p>\n<p>Manager forwarded the papers to the Director of<\/p>\n<p>Vocational Higher Secondary Education, who granted<\/p>\n<p>permission to continue the suspension as per the<\/p>\n<p>order  dated  31.12.2009.       The   order   reads   as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>    &#8220;1.  The  action  of   the  Manager   in  having<br \/>\n        suspended Sri.Hareendranath Non Vocational<br \/>\n        Teacher in English can be approved subjected<br \/>\n        to  the  condition   that  the  disciplinary<br \/>\n        action  against   him  shall   be  completed<br \/>\n        immediately  so  as  to   reinstate  him  in<br \/>\n        service.\n<\/p><\/blockquote>\n<blockquote><p>    2.  The  action   of  the   Manager   in  having<br \/>\n        redesignated   a   Vocational   Teacher   as<br \/>\n        Principal avoiding the present HM cannot be<br \/>\n        admitted  as   this   is   against  existing<br \/>\n        Government Orders.    But the Manager can<br \/>\n        continue  disciplinary  action  against  the<br \/>\n        Principal as per rules.\n<\/p><\/blockquote>\n<blockquote><p>    3.  The  Manager can submit detailed statements<br \/>\n        if she desires so to the undersigned.&#8221;\n<\/p><\/blockquote>\n<p>W.P.(C).Nos.13980 &amp;<br \/>\n<span class=\"hidden_text\">20860 OF 2010                2<\/span><\/p>\n<p>    2. It would appear that Hareendranath submitted<\/p>\n<p>a representation to the Director of Vocational<\/p>\n<p>Higher Secondary Education, probably before the<\/p>\n<p>order dated 31.12.2009 was passed.        Hareendranath<\/p>\n<p>filed W.P.(C)No.10373 of 2010 alleging that the<\/p>\n<p>said representation was not disposed of.        W.P.(C)<\/p>\n<p>No.10373 of 2010 was disposed of as per Ext.P9<\/p>\n<p>judgment dated 26.3.2010 directing the Director of<\/p>\n<p>Vocational Higher Secondary Education to dispose of<\/p>\n<p>the  representation.       According  to   the   learned<\/p>\n<p>counsel appearing for Hareendranath, pursuant to<\/p>\n<p>the judgment dated 26th March, 2010 in W.P.(C)<\/p>\n<p>No.10373 of 2010, the Director of Vocational Higher<\/p>\n<p>Secondary    Education    conducted    a   hearing    on<\/p>\n<p>26.5.2010, but no orders were passed.<\/p>\n<p>    3. The Director of Vocational Higher Secondary<\/p>\n<p>Education passed an order dated 30.3.2010, which<\/p>\n<p>reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>        &#8220;Inviting your attention to the refs. cited,<br \/>\n         you     are    directed    to     reinstate<br \/>\n         Sri.A.G.Hareendranath, NVT in English, with<\/p>\n<p>W.P.(C).Nos.13980 &amp;<br \/>\n<span class=\"hidden_text\">20860 OF 2010              3<\/span><\/p>\n<p>         immediate  effect, upon receipt of  this<br \/>\n         letter.&#8221;<\/p><\/blockquote>\n<p>    4. Though the order dated 30.3.2010 was passed<\/p>\n<p>after the disposal of the W.P(C)No.10373 of 2010 on<\/p>\n<p>26.3.2010, it would appear that the disposal of W.P<\/p>\n<p>(C) No.10373 of 2010    was not brought to the notice<\/p>\n<p>of the Director.\n<\/p>\n<\/p>\n<p>    5.    In    WP(C)No.20860   of  2010   filed   by<\/p>\n<p>Hareendranath, the main relief sought for is to<\/p>\n<p>reinstate him with retrospective effect.         That<\/p>\n<p>prayer is on the basis of the order dated 30.3.2010<\/p>\n<p>passed by the Director.    In WP(C) No.13980 of 2010<\/p>\n<p>filed by the Manager, Omana Sreeram, the main<\/p>\n<p>relief sought for by her is to quash the order<\/p>\n<p>dated   30.3.2010   passed  by  the  Director.   The<\/p>\n<p>Manager       has     also     challenged     G.O(MS)<\/p>\n<p>No.31\/10\/Gl.Edn.    dated  24.2.2010  by  which   the<\/p>\n<p>Government was conferred the disciplinary power<\/p>\n<p>over teaching and non teaching staff of aided<\/p>\n<p>Vocational Higher Secondary Schools.<\/p>\n<p>W.P.(C).Nos.13980 &amp;<br \/>\n<span class=\"hidden_text\">20860 OF 2010              4<\/span><\/p>\n<p>    6.Sri.A.N.Rajan    Babu,  the  learned   counsel<\/p>\n<p>appearing for the Manager submitted that before<\/p>\n<p>passing the order dated 30.3.2010, the Director did<\/p>\n<p>not afford     an opportunity of being heard to the<\/p>\n<p>Manager.    This statement is not disputed either by<\/p>\n<p>the learned counsel appearing for Hareendranath or<\/p>\n<p>by the learned Government Pleader.   If that is the<\/p>\n<p>position, the order dated 30.3.2010 passed by the<\/p>\n<p>Director, which is marked as Ext.P10 in W.P.(C)<\/p>\n<p>Nos.20860 of 2010 and 13980 of 2010 is liable to be<\/p>\n<p>quashed.   I do so. The order dated 30.3.2010 passed<\/p>\n<p>by the Director is hereby quashed.<\/p>\n<p>    7. Now what remains is that the Director has to<\/p>\n<p>pass    orders     after   hearing   the    teacher,<\/p>\n<p>Hareendranath, and the Manager.     The Director of<\/p>\n<p>Vocational Higher Secondary Education shall hear<\/p>\n<p>both parties and pass appropriate orders within a<\/p>\n<p>period of two months from the date of receipt of a<\/p>\n<p>copy of the judgment.\n<\/p>\n<p>W.P.(C).Nos.13980 &amp;<br \/>\n<span class=\"hidden_text\">20860 OF 2010             5<\/span><\/p>\n<p>    8. As stated earlier, the Manager has also<\/p>\n<p>challenged in the Writ Petition filed by her, the<\/p>\n<p>Government    Order  dated  24.2.2010.     Advocate<\/p>\n<p>Sri.Rajan Babu submitted that since the order dated<\/p>\n<p>30.3.2010 passed by the Director is quashed, this<\/p>\n<p>contention raised by the Manager challenging the<\/p>\n<p>Government Order can be relegated to be raised at<\/p>\n<p>the appropriate stage in appropriate proceedings.<\/p>\n<p>The petitioner is permitted to do so.<\/p>\n<p>    9.
