A Pasayat<\/div>\n<div class=\"doc_bench\">Bench: Dr. Arijit Pasayat, Lokeshwar Singh Panta<\/div>\n<pre>           CASE NO.:\nSpecial Leave Petition (crl.)  1102 of 2007\n\nPETITIONER:\nState of H.P\n\nRESPONDENT:\nMushtaq Ahmad\n\nDATE OF JUDGMENT: 26\/03\/2007\n\nBENCH:\nDr. ARIJIT PASAYAT &amp; LOKESHWAR SINGH PANTA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>\tChallenge in this special leave petition is to the order<br \/>\npassed by a Division Bench of the Himachal Pradesh High<br \/>\nCourt dismissing the application filed by the petitioner-<br \/>\nState under Section 378(3) of the Code of Criminal<br \/>\nProcedure, 1973 (in short the &#8216;Code&#8217;).\n<\/p>\n<p>\tGrievance of the petitioner is that the application was<br \/>\ndismissed summarily without indicating any reason. It is<br \/>\nstated by learned counsel for the petitioner that this Court<br \/>\nhas in many cases deprecated the practice of such<br \/>\ndismissal.\n<\/p>\n<p>The High Court has not given any reasons for<br \/>\nrefusing to grant leave to file appeal against acquittal, and<br \/>\nseems to have been completely oblivious to the fact that by<br \/>\nsuch refusal, a close scrutiny of the order of acquittal, by<br \/>\nthe appellate forum, has been lost once and for all. The<br \/>\nmanner in which appeal against acquittal has been dealt<br \/>\nwith by the High Court leaves much to be desired.<br \/>\nReasons introduce clarity in an order. On plainest<br \/>\nconsideration of justice, the High Court ought to have set<br \/>\nforth its reasons, howsoever brief, in its order indicative of<br \/>\nan application of its mind, all the more when its order is<br \/>\namenable to further avenue of challenge. The absence of<br \/>\nreasons has rendered the High Court order not<br \/>\nsustainable. Similar view was expressed in <a href=\"\/doc\/107633\/\">State of U.P. v.<br \/>\nBattan and Ors<\/a> (2001 (10) SCC 607). About two decades<br \/>\nback in <a href=\"\/doc\/255944\/\">State of Maharashtra v. Vithal Rao Pritirao<br \/>\nChawan (AIR<\/a> 1982 SC 1215) the desirability of a speaking<br \/>\norder while dealing with an application for grant of leave<br \/>\nwas highlighted. The requirement of indicating reasons in<br \/>\nsuch cases has been judicially recognized as imperative.<br \/>\nThe view was re-iterated in <a href=\"\/doc\/1102028\/\">Jawahar Lal Singh v. Naresh<br \/>\nSingh and Ors.<\/a> (1987 (2) SCC 222).  Judicial discipline to<br \/>\nabide by declaration of law by this Court, cannot be<br \/>\nforsaken, under any pretext by any authority or Court, be<br \/>\nit even the Highest Court in a State, oblivious to Article<br \/>\n141 of the Constitution of India, 1950 (in short the<br \/>\n&#8216;Constitution&#8217;).\n<\/p>\n<p>Even in respect of administrative orders Lord<br \/>\nDenning M.R. in Breen v. Amalgamated Engineering<br \/>\nUnion (1971 (1) All E.R. 1148) observed &#8220;The giving of<br \/>\nreasons is one of the fundamentals of good<br \/>\nadministration&#8221;. In Alexander Machinery (Dudley) Ltd. v.<br \/>\nCrabtree (1974 LCR 120) it was observed: &#8220;Failure to give<br \/>\nreasons amounts to denial of justice&#8221;. Reasons are live<br \/>\nlinks between the mind of the decision taker to the<br \/>\ncontroversy in question and the decision or conclusion<br \/>\narrived at&#8221;. Reasons substitute subjectivity by objectivity.<br \/>\nThe emphasis on recording reasons is that if the decision<br \/>\nreveals the &#8220;inscrutable face of the sphinx&#8221;, it can, by its<br \/>\nsilence, render it virtually impossible for the Courts to<br \/>\nperform their appellate function or exercise the power of<br \/>\njudicial review in adjudging the validity of the decision.<br \/>\nRight to reason is an indispensable part of a sound<br \/>\njudicial system, reasons at least sufficient to indicate an<br \/>\napplication of mind to the matter before Court. Another<br \/>\nrationale is that the affected party can know why the<br \/>\ndecision has gone against him. One of the salutary<br \/>\nrequirements of natural justice is spelling out reasons for<br \/>\nthe order made, in other words, a speaking out. The<br \/>\n&#8220;inscrutable face of a sphinx&#8221; is ordinarily incongruous<br \/>\nwith a judicial or quasi-judicial performance. <a href=\"\/doc\/752130\/\">(See State of<br \/>\nPunjab v. Bhag Singh<\/a> (2004 (1) SCC 547).\n<\/p>\n<p>\tIn the background of what has been stated in Bhag<br \/>\nSingh&#8217;s case (supra) the grievance of learned counsel for<br \/>\nthe petitioner-State about the manner in which the<br \/>\npetition has been dismissed is unexceptionable.  But we<br \/>\nhave perused the judgment of the trial Court. Considering<br \/>\nthe nature of the findings recorded we do not consider this<br \/>\nto be a fit case where exercise of jurisdiction under Article<br \/>\n136 of the Constitution is called for.
