           It   is   true  that   the  appellant\/writ  petitioner  is<\/p>\n
working   as   Upper   Primary   School   Assistant<\/p>\n
(Malayalam)   since   16.10.2000   in   the   Upper   Primary<\/p>\n
School managed by the 6th respondent.  It is also true<\/p>\n
that   a   vacancy   of   High   School   Assistant   (Malayalam)<\/p>\n
had occurred on 1.6.2004.  It is also an admitted case<\/p>\n
that B.Ed. is an essential qualification for appointment<\/p>\n
as High School Assistant.   Language teachers working<\/p>\n
in   Upper   Primary   Schools   are   entitled   to   claim<\/p>\n
promotion   to   the   post   of   High   School   Assistant,<\/p>\n
provided   they   are   qualified.     It   is   submitted   that   the<\/p>\n
appellant\/writ petitioner had acquired B.Ed. degree in<\/p>\n
W.A.No.63 of  2007<\/p>\n
                                                       :: 2 ::\n<\/p>\n
the   year   1995   from   Manonmaniam   Sundaranar<\/p>\n
University   Thirunelveli,   Tamil   Nadu.   But   as   is<\/p>\n
revealed   by   Ext.R5(a)   Government   Order   dated<\/p>\n
5.3.2004,   B.Ed   degree   from   Manonmaniam<\/p>\n
Sundaranar   University,   which  is   a  week  end  degree<\/p>\n
course,   shall   not   be   accepted   as   an   equivalent<\/p>\n
qualification to regular B.Ed degree course conducted<\/p>\n
in   the   State   for   the   purpose   of   appointment   to<\/p>\n
teaching posts.\n<\/p>\n<\/p>\n
                  2.  Going by  the provisions in Chapter XXXI<\/p>\n
Kerala   Education   Rules,   the   qualification   prescribed<\/p>\n
for the post of High School Assistant is B.Ed degree<\/p>\n
conferred   by   any   of   the   Universities   in   Kerala   or<\/p>\n
recognised as an equivalent.   Ext.R5(a) order dated<\/p>\n
5.3.2004 reveals that the B.Ed degree possessed by<\/p>\n
the   appellant\/writ   petitioner   did   not   have   any<\/p>\n
recognition   or   equivalence   with   the   B.Ed   degree,<\/p>\n
which   is   made   mandatory   in   terms   of   the   Rules   in<\/p>\n
W.A.No.63 of  2007<\/p>\n
                                                       :: 3 ::\n<\/p>\n
Chapter   XXXI   of   the   Kerala   Education   Rules.<\/p>\n
Necessarily, Ext.R5(a) shall have to be applied, when<\/p>\n
the vacancy arose on 1.6.2004, in this case, is to be<\/p>\n
filled up.\n<\/p>\n<\/p>\n
                  Necessarily,   the   finding   of   the   authorities<\/p>\n
and the learned single Judge, that in terms of Ext.R5<\/p>\n
(a), the appellant\/writ petitioner was not qualified for<\/p>\n
promotion is perfectly justified and it does not call for<\/p>\n
any interference.\n<\/p>\n<\/p>\n
                  Appeal fails, dismissed.\n<\/p>\n<\/p>\n
