Basheer, J.\n<\/p>\n<p>                &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>                  Crl.Appeal No. 1432 of 2003-C<\/p>\n<p>                &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>             Dated this the 26th day of March, 2008.\n<\/p>\n<p>                           Order of Reference<\/p>\n<p>      This appeal which is at the instance of the complainant in a<\/p>\n<p>prosecution under Section 138 of the Negotiable Instruments Act is<\/p>\n<p>directed against the order of acquittal passed by the trial court.<\/p>\n<p>      2. The case of the complainant was that the accused had<\/p>\n<p>issued Ext.P1 cheque dated June 4, 1999 for a sum of Rs.4,61,400 in<\/p>\n<p>discharge of a debt. Shortly thereafter the complainant received a<\/p>\n<p>sum of Rs.2,26,400 from the accused as part payment. Thus,<\/p>\n<p>according to the complainant himself, the balance amount due from<\/p>\n<p>the accused was only Rs.2,35,000. But since the accused failed to<\/p>\n<p>pay the said balance amount, the complainant presented the cheque<\/p>\n<p>for encashment which was dishonoured due to insufficiency of funds<\/p>\n<p>in the account of the accused .             After completing the statutory<\/p>\n<p>formalities, the complainant prosecuted the accused for the offence<\/p>\n<p>punishable under Section 138 of the Act. The trial court acquitted<\/p>\n<p>the accused holding that Ext.P1 cheque did not represent &#8220;the<\/p>\n<p>amount which was legally recoverable and that the cheque had not<\/p>\n<p>been issued for a legally enforceable debt or liability&#8221;.<\/p>\n<p>      3. While assailing the above judgment of acquittal, learned<\/p>\n<p>counsel has invited my attention to an unreported decision of a<\/p>\n<p>learned single Judge dated March 19, 2003 in <a href=\"\/doc\/1368080\/\">R.Gopikuttan Pillai<\/p>\n<p>v. Sankara Narayanan Nair<\/a> in Crl.A.No.270 of 1997. In the said<\/p>\n<p><span class=\"hidden_text\">Crl.A.1432\/03                        2<\/span><\/p>\n<p>decision the learned Judge held that &#8220;&#8230;&#8230;.. the expression &#8220;the said<\/p>\n<p>amount of money&#8221; appearing in clause (b) and (c) of the proviso to<\/p>\n<p>Section 138 of the Negotiable Instruments Act must certainly refer to<\/p>\n<p>the amount of money due under the cheque less amounts, if any, paid<\/p>\n<p>already towards the liability. At any rate the payment contemplated<\/p>\n<p>under clause (c) of the proviso must certainly include payments if any<\/p>\n<p>made towards the liability after the issue of the cheque and before the<\/p>\n<p>cheque is presented for encashment as also payments made after the<\/p>\n<p>receipt of the notice.&#8221;\n<\/p>\n<p>      4.     However, learned counsel for the accused has invited my<\/p>\n<p>attention to a decision reported in <a href=\"\/doc\/1362853\/\">Supply House v. Ullas<\/a> (2006 (3)<\/p>\n<p>KLT 921). In the said decision another learned single Judge of this<\/p>\n<p>Court held thus:\n<\/p>\n<blockquote><p>            &#8220;&#8230;In order to deem that one had<\/p>\n<p>            committed offence under S.138, the<\/p>\n<p>            amount covered by the cheque shall be<\/p>\n<p>            either in discharge of the liability<\/p>\n<p>            incurred by the drawer, either in full or<\/p>\n<p>            in part.   It cannot in any way be in<\/p>\n<p>            excess of the liability incurred. Unless<\/p>\n<p>            the complainant proves that the liability<\/p>\n<p>            to be settled is to the tune of the amount<\/p>\n<p>            covered by Ext.P1, he could not have<\/p>\n<p>            made use of that cheque for such<\/p>\n<p>            liability.&#8221;\n<\/p><\/blockquote>\n<p>Learned counsel has also invited my attention to a decision of the<\/p>\n<p><span class=\"hidden_text\">Crl.A.1432\/03                     3<\/span><\/p>\n<p>Madras High Court in Angu Parameshwari Textiles v. Sri.Rajam &amp;<\/p>\n<p>Co. (2001 DCR 648) wherein it has been held that &#8220;if the cheque is<\/p>\n<p>more than the amount of the debt due, &#8230;.. Section 138 cannot be<\/p>\n<p>attracted.&#8221;   Learned counsel has raised a further contention that the<\/p>\n<p>decision of the learned single Judge in Gopikuttan Pillai&#8217;s case may not<\/p>\n<p>have been correctly decided in view of the decision of the Apex Court<\/p>\n<p>in <a href=\"\/doc\/72800\/\">Suman Seth v. Ajay K. Churinal<\/a> (2000 Criminal 172).<\/p>\n<p>       5. Having heard learned counsel for the parties and having<\/p>\n<p>considered the materials placed before me I am of the view that there is<\/p>\n<p>an apparent conflict in the views taken by this Court in the two<\/p>\n<p>decisions referred to above. Therefore it may be appropriate that the<\/p>\n<p>appeal is heard by a Division Bench .\n<\/p>\n<p>       Registry shall place the matter before the Hon&#8217;ble the Chief<\/p>\n<p>Justice for appropriate orders.\n<\/p>\n<\/p>\n<p>                                                    A.K.
