PUBLIC PROSECUTOR for Respondent(s) : 1, \nMR\nASHWINBHAI JAYANTIBHAI PATEL, PARTY-IN-PERSON for Respondent(s) :\n2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 06\/05\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application, applicant has prayed to modify the<br \/>\n\tCondition Nos.3 an 4 of the order dated 10th April, 2008<br \/>\n\tpassed by the learned Additional Sessions Judge, Fast Track Court<br \/>\n\tNo.3, Ahmedabad (Rural), Mirzapur, in Criminal Miscellaneous<br \/>\n\tApplication No.38 of 2008.\n<\/p>\n<p>Heard<br \/>\n\tMr.Shalin Mehta, learned counsel for Ms.Vidhi Bhatt, learned counsel<br \/>\n\tfor the applicant, Mr.H.L. Jani, learned Additional Public<br \/>\n\tProsecutor for respondent No.1 and respondent No.2, i.e.<br \/>\n\tMr.Ashwinbhai Jayantilal Patel, Party-in-Person.\n<\/p>\n<p>Mr.Mehta<br \/>\n\thas contended that the applicant is Talati-cum-Mantri of Ranpur<br \/>\n\tTaluka, which is within the Ahmedabad revenue district limit. He has<br \/>\n\tcontended that the applicant is staying in Kanbha with her father,<br \/>\n\tmother and her brother&#8217;s child, who is seven years old. The father<br \/>\n\tand mother of the applicant are old aged persons and they required<br \/>\n\tpresence of the applicant to look after them as well as the child.<br \/>\n\tHe has also contended that in the present case, charge-sheet is<br \/>\n\tfiled long back in the year 2009. By now more than two years has<br \/>\n\talready been passed and the trial is yet not proceeded. He has<br \/>\n\tfurther contended that if the condition Nos.3 and 4 of the order<br \/>\n\tdated 10th April, 2008 may be deleted, no question<br \/>\n\tregarding breach of law and peace can be arise. He, therefore,<br \/>\n\tprayed that present application may kindly be allowed by deleting<br \/>\n\tthe condition Nos.3 and 4 of the order dated 10th April,<br \/>\n\t2008.\n<\/p>\n<p>As<br \/>\n\tagainst this, Mr.Jani, learned Additional Public Prosecutor, has<br \/>\n\topposed the present application and contended that prayer as prayed<br \/>\n\tfor may not be granted.\n<\/p>\n<p>Heard<br \/>\n\trespondent No.2-Mr.Ashwinbhai Jayantilal Patel, Party-in-Person. He<br \/>\n\thas opposed the present application and contended that if the<br \/>\n\tconditions are modified, then there are chances that again the<br \/>\n\tapplicant threatened him and question of safety and security is<br \/>\n\trequired to be protected.\n<\/p>\n<p>Heard<br \/>\n\tall the parties and perused the papers produced before me. It<br \/>\n\tappears that the respondent No.2 has opposed the present application<br \/>\n\tonly because of fear. Mr.Mehta has assured that the applicant will<br \/>\n\tmaintain law and order. It also appears from the perusal of the<br \/>\n\tpapers that father and mother of the applicant are old aged persons<br \/>\n\tand suffering from old age problems. It also appears from the papers<br \/>\n\tthat the present respondent No.2 has challenged the orders dated<br \/>\n\t30th November, 2010 and 10th December, 2010<br \/>\n\tpassed by this Court before the Apex Court by way of Special Leave<br \/>\n\tPetitions (Criminal); however, the Apex Court has dismissed the said<br \/>\n\tSpecial Leave Petitions. Looking to the facts of the case and<br \/>\n\taverments made in the application, I am of the opinion that present<br \/>\n\tapplication is required to be allowed.\n<\/p>\n<p>Hence,<br \/>\n\tin view of above, present application is allowed. The Condition<br \/>\n\tNos.3 and 4 of the order dated 10th April, 2008 passed by<br \/>\n\tthe learned Additional Sessions Judge, Fast Track Court No.3,<br \/>\n\tAhmedabad (Rural), Mirzapur, in Criminal Miscellaneous Application<br \/>\n\tNo.38 of 2008 as well as condition imposed upon the applicant, viz.<br \/>\n\t&#8220;the applicant shall not enter into Kanbha and Kunjad<br \/>\n\tvillage till further orders&#8221; vide<br \/>\n\torder dated 10th<br \/>\n\tDecember, 2010 passed by this Court in Criminal Miscellaneous<br \/>\n\tApplication No.15067 of 2010 are hereby deleted.
