And Others\nPetitioner Counsel :- M.D. Mishra\nRespondent Counsel :- C.S.C.,Arun Kumar,R.S.Misra\n\nHon'ble Shishir Kumar,J.\n<\/pre>\n<p>Heard Sri M.D. Mishra, learned counsel for the petitioner and Sri<br \/>\nArun Kumar, learned counsel for respondent no.3.\n<\/p>\n<p>This writ petition has been filed for quashing the order impugned<br \/>\ndated 28.6.2003 passed by respondent no.2, Annexure-2 to the writ<br \/>\npetition. It appears that the petitioner was appointed on 21.1.1990<br \/>\nas a Class-IV employee in the institution on a non-sanctioned post<br \/>\nin a non-aided institution in the Science Department. The claim set<br \/>\nup by the petitioner in the present writ ptition was that petitioner<br \/>\nwas working and he was having a legitimate expectation that his<br \/>\nservices will be regularised on a substantive vacancy in future.<br \/>\nOne Sri Surendra Prasad Mani retired on 30.6.1998 and on that<br \/>\npost another person was appointed and his services have already<br \/>\nbeen regularized. The petitioner made a representation to that<br \/>\neffect but it was not decided, then he filed a writ petition before<br \/>\nthis Court and this Court decided the writ petition and directed the<br \/>\nauthority concerned to decide the representation-vide its order<br \/>\ndated 8.2.1999.\n<\/p>\n<p>It appears that on the basis of the directions issued by this Court<br \/>\nthe relevant authority has recorded a finding that the appointment<br \/>\nof the petitioner was on a non-sanctioned post and from the record<br \/>\nof the institution, it appears that he was ever appointed on a<br \/>\nsanctionedpost. In such a situation the District Inspector of<br \/>\nShcools has recorded a finding that as no prior approval for<br \/>\nmaking an appointment was ever sought by the institution and if<br \/>\nany appointment has been made on a non-sanctioned post without<br \/>\nfollowing the proper procedure, no consideration can be made for<br \/>\nconsidering his appointment either as valid or invalid.\n<\/p>\n<p>Sri M.D. Mishra, learned counsel for the petitioner submits that in<br \/>\na similar circumstance another person has been given appointment<br \/>\nand his services have been regularised, therefore, the petitioner is<br \/>\nalso entitled for the same relief.\n<\/p>\n<p>On the other hand, Sri Arun Kumr, learned counsel for the<br \/>\nrespondents submitted that appointment of Sri Chhangur Prasad<br \/>\n Sharma was made on a clear vacancy in 1998 after following the<br \/>\nproper procedure, therefore, his appointment has been approved<br \/>\nand now he has been regularised. Therefore, the petitioner cannot<br \/>\nclaim any pairty or similarity with the appointment of Sri<br \/>\nChhangur Prasad Sharma.\n<\/p>\n<p>I have considered the submissions made on behalf of the petitioner<br \/>\nand the respondents. Once a finding has been recorded by the<br \/>\nrelevant authority that appointment of the petitioner was made on a<br \/>\nnon-sanctioned post and there was no prior approval as provided in<br \/>\nthe rules, a person cannot claim that he may be considered for<br \/>\nregularization on a particular post for which sanction or approval<br \/>\nhas never been granted to that appointment.\n<\/p>\n<p>As regards the regularization of the petitioner in Writ Petition No.<br \/>\n2496 of 2000, in my opinion, his claim is not similar to the<br \/>\npetitioner, therefore, no relief can be granted to the petitioner in<br \/>\nview of the fact of the finding recorded that his appointment was<br \/>\nnot proper and was not in accordance with law.\n<\/p>\n<p>The writ petition is devoid of merit and is dismissed.
