(C) No. 8452 OF 2009\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 25th day of June, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>          Petitioner is a farmer having an extent of<\/p>\n<p>149.90 Ares of land in different survey numbers in<\/p>\n<p>Anakkara Village, Idukki District. He holds some wet land<\/p>\n<p>which is used for paddy cultivation. He had approached<\/p>\n<p>this court, complaining of unauthorized mining of sand<\/p>\n<p>from paddy field and wet land in Anakkara and<\/p>\n<p>Chakkupallam Villages in Idukki District.<\/p>\n<p>     2.   Subsequent to the filing of the writ petition<\/p>\n<p>additional respondents 14 to 30, were impleaded on the<\/p>\n<p>allegation that they are also indulging in unauthorized<\/p>\n<p>mining of sand from paddy fields and wet land.<\/p>\n<p>     3.   A counter affidavit has been filed by the second<\/p>\n<p>respondent, Geologist.           Respondent 10to 13 have also<\/p>\n<p>filed a Counter Affidavit.            According to them they are<\/p>\n<p>mining sand only from dry lands, on the strength of the<\/p>\n<p>WPC.No. 8452 OF 2009<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>permit issued in this behalf by the Geologist.<\/p>\n<p>     4.    Section 11 of the Kerala Conservation of Paddy<\/p>\n<p>lands and Wet lands Act read as follows:<\/p>\n<blockquote><p>     11. Prohibition on reclamation of wetland:-\n<\/p><\/blockquote>\n<blockquote><p>         On and from the date of commencement of this<br \/>\n     Act, the wetlands of the State shall be maintained as<br \/>\n     such and there shall be a total prohibition on<br \/>\n     reclamation of such wetland and removal of sand<br \/>\n     therefrom:\n<\/p><\/blockquote>\n<blockquote><p>          Provided that nothing contained in this section<br \/>\n     shall effect the removal of slurry and mud to maintain<br \/>\n     the ecological condition of such wetland.<\/p><\/blockquote>\n<p>     5.    In so far as mining sand from paddy lands are<\/p>\n<p>concerned, though the aforementioned Act does not bring<\/p>\n<p>about a complete prohibition of sand from paddy fields, it<\/p>\n<p>cannot be done except on the strength of a specific<\/p>\n<p>permission granted in that behalf by the competent<\/p>\n<p>authority.     Obviously, the revenue Divisional Officer<\/p>\n<p>cannot grant permit to dig sand from paddy lands except<\/p>\n<p>for specified purpose. It shall not be granted to enable<\/p>\n<p>the holder of the land or the applicant to Commercially<\/p>\n<p>exploit the same.        The features highlighted by the<\/p>\n<p>WPC.No. 8452 OF 2009<br \/>\n<span class=\"hidden_text\">                              : 3 :<\/span><\/p>\n<p>petitioner requires emergent and serious consideration by<\/p>\n<p>the Revenue Divisional Officer. He shall therefore cause<\/p>\n<p>an enquiry tobe conducted as to whether there is removal<\/p>\n<p>of sand from Paddy land or wet land by any of the<\/p>\n<p>respondents or any other person, within his jurisdiction.<\/p>\n<p>If he finds that sand is being removed from wet land he<\/p>\n<p>shall proceed to take action as contemplated by Section<\/p>\n<p>23 of the Act. By filing a report stating that an offence<\/p>\n<p>has been committed by the concerned person as<\/p>\n<p>contemplated by Section 23 and 25 of the Act. He shall<\/p>\n<p>also take action to see that no sand is removed from<\/p>\n<p>paddy land except that an authority granted on that<\/p>\n<p>behalf by an officer not below the rank of the Revenue<\/p>\n<p>Divisional Officer and that only for an appropriate<\/p>\n<p>utilisation of the land for any commercial exploitation.<\/p>\n<p>      6.   Learned counsel for the petitioner submits that<\/p>\n<p>the respondents 1 to 6 had prohibited the use of Motor<\/p>\n<p>pumbs for sand mining.        Learned Government Pleader<\/p>\n<p>WPC.No. 8452 OF 2009<br \/>\n<span class=\"hidden_text\">                             : 4 :<\/span><\/p>\n<p>submits that use for sand mining has been completely<\/p>\n<p>prohibited. The Revenue Divisional Officer shall ensure<\/p>\n<p>them such prohibition enforced strictly. Learned counsel<\/p>\n<p>for respondents 10 to 13 refers to R10(f) and point out<\/p>\n<p>that their application for renewal of permit granted<\/p>\n<p>directing the pendency of the writ petition. Needful shall<\/p>\n<p>be done within one month from the date of receipt of a<\/p>\n<p>copy of this judgment.\n<\/p>\n<p>     7.    Now the writ petition is disposed of.
