Phukan, J.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>RAJENDRA BABU, J. :\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>    By\tan order made on July 6, 1996, this Court  finalised<br \/>\nthe  scheme  of\t rehabilitation\t of  Ashok  Paper  Mills  in<br \/>\nDarbhanga in State of Bihar.  However, that scheme could not<br \/>\nbe  given effect to due to one reason or the other and\tthis<br \/>\nCourt  on  April 26, 1999 considered various aspects of\t the<br \/>\nmatter\tand  made  an order on I.A.No.13 in  W.P.   (C)\t No.<br \/>\n174\/91.\n<\/p>\n<p>    After  considering the various circumstances, this Court<br \/>\ndirected  that State of Bihar should stand guarantee for the<br \/>\nsupply\tof four diesel generating sets to the tune of  three<br \/>\ncrores\tso  that the difficulty in getting the power  supply<br \/>\nwould  stand  obviated\tand  the  company  should  give\t the<br \/>\nproposal  to  the State of Bihar in that regard\t upon  which<br \/>\nappropriate  orders should be passed by the Government.\t  It<br \/>\nwas  specifically noticed that the petitioner union,  though<br \/>\nwas  all along prepared to enter into the agreement but some<br \/>\nhow it could not be done but subsequently another registered<br \/>\nunion,\tviz.,  Ashok  Paper Mills  Mazdoor  Panchayat  Union<br \/>\nentered\t into  an  agreement.\tThis  Court  stated  on\t the<br \/>\nagreement  entered  into  with\tthe   latter  Union  in\t the<br \/>\nfollowing terms :\n<\/p>\n<p>    ..\t Without delving into the question as to  whether<br \/>\nthe  Kamgar  Union  itself  did\t  not  participate  in\t the<br \/>\nproceedings and did not enter into an agreement or the Union<br \/>\nwas prevented by some other process since a registered Union<br \/>\nhas already entered into an agreement and the such Union has<br \/>\nmembership  of 243, we think it appropriate to hold that the<br \/>\nsaid  agreement would be valid agreement for the purpose  of<br \/>\nimplementation of the scheme.  But at the same time, we also<br \/>\ngrant  an  opportunity\tto  Kamgar Union to  enter  into  an<br \/>\nagreement with the same terms which has already been entered<br \/>\ninto  by  the other Mazdoor Panchayat Union and this may  be<br \/>\ndone within a period of four weeks from today and if such an<br \/>\nagreement  is entered into within this period then this will<br \/>\nbe in accordance with the terms of the scheme itself.\n<\/p>\n<p>    If,\t however,  Kamgar  Union  does not  enter  into\t any<br \/>\nagreement  within  four\t weeks from today then\tthey  cannot<br \/>\ncomplain  of  other  union having already entered  into\t the<br \/>\nterms  with  the Company and the individual members  of\t the<br \/>\nUnion  those who are interested in abiding by the  agreement<br \/>\nalready\t entered into by the other Union can do so on  their<br \/>\nown  and  this should be also in accordance with the  scheme<br \/>\nthat has been approved by this Court.\n<\/p>\n<p>    Thereafter\ta review petition was filed questioning\t the<br \/>\ncorrectness  of\t this order.  However, that review  petition<br \/>\nstood dismissed.\n<\/p>\n<p>    It\tis  the contention of the Petitioner that under\t the<br \/>\nscheme finalised by this Court on 6.7.96, clause 1.4 has not<br \/>\nbeen  implemented  in  the true spirit\tthereof;   that\t the<br \/>\ntake-over,  though was originally stated to be from 18.8.97,<br \/>\nsubsequently  the monitoring committee fixed the date to  be<br \/>\n26.12.1997,  even  so  within six months thereof,  the\twork<br \/>\nforce  has  not\t been absorbed by NCFL nor  entered  into  a<br \/>\ntripartite  agreement between the workers union, Government<br \/>\nof Bihar and NCFL much less any of the past liabilities have<br \/>\nbeen  discharged;   that the NCFL has also not paid  workers<br \/>\ntheir  monthly\tsalary @ 50% of their last earned salary  of<br \/>\nthe  month  when production was not terminated;\t that,\tShri<br \/>\nUmadhar\t Prasad Singh informed that he was agreeable to sign<br \/>\nthe  agreement\tprovided some changes are made in the  draft<br \/>\ntripartite agreement;  that the suggestions made by him were<br \/>\ndiscussed   by\tthe  monitoring\t  committee,  found  to\t  be<br \/>\nreasonable   and  should  be   included\t in  the  tripartite<br \/>\nagreement;   that no such agreement was entered into but  on<br \/>\nthe  other  hand  an agreement has been\t entered  into\twith<br \/>\nanother\t union;\t that a secret letter was sent by the Labour<br \/>\nCommissioner  on  May  4, 1998 stating that  the  said\tShri<br \/>\nUmadhar\t Prasad Singh, President of the Petitioner union has<br \/>\nbeen  adopting an attitude of non-cooperation and was taking<br \/>\nan  aggressive\tstand, though there was merit in  the  claim<br \/>\nmade  by him in regard to fixation of wages which should  be<br \/>\ncovered\t by  the prescribed norms of industry based  on\t the<br \/>\nlength\t of   service,\t experience,  technical\t  knowledge,<br \/>\nacquisition of skills and if unskilled then the knowledge of<br \/>\nthe  work which the worker had acquired during the course of<br \/>\nwork;  that a memorandum of tripartite agreement was arrived<br \/>\nat by NCLF and, on behalf of the workmen, by the Ashok Paper<br \/>\nMills  Mazdoor\tPanchayat Union on May 20, 1998\t had  almost<br \/>\nsurrendered  their  normal claims of workmen for  which\t the<br \/>\nPetitioner union has been fighting all along;  that the said<br \/>\nagreement was entered into by maneuvers of the management of<br \/>\nNCLF and, therefore, we should not take note of the same but<br \/>\ngive  effect  to clause 1.4 of the scheme finalised by\tthis<br \/>\nCourt independently.\n<\/p>\n<p>    Whether  there is any merit or none in the arguments  on<br \/>\nbehalf of the applicant in I.A.No.13, it is not possible for<br \/>\nus  to go back on the order made by this Court on  26.4.1999<br \/>\nand  the  order\t made on the review  petition.\t Though\t Ms.<br \/>\nIndira\tJaising,  learned senior counsel appearing  for\t the<br \/>\napplicant,  very  strenuously and forcefully submitted\tthat<br \/>\nthe  order  made  by  this Court on  26.4.1999\tis  only  an<br \/>\ninterlocutory  order,  we  do  not think that  it  would  be<br \/>\ncorrect to state so because the specific manner in which the<br \/>\nscheme\thad  to be implemented has been considered  by\tthis<br \/>\nCourt  in the aforesaid order.\tThe very arguments  advanced<br \/>\nbefore\tus  now had been raised in the review  petition\t but<br \/>\nrejected.   Therefore,\twe  reject   this  contention\ttoo.<br \/>\nHowever,  we make it clear that any of the workman who is  a<br \/>\nmember of the Petitioner union may also be permitted to join<br \/>\nthe  work  in  the NCFL on the terms and  conditions  stated<br \/>\nunder  the  memorandum\tof  tripartite\tagreement  to  which<br \/>\nreference has been made by this Court in the orders adverted<br \/>\nto above, if such claim is made within a period of one month<br \/>\nfrom the date of this order.\n<\/p>\n<p>    Interim  Application  No.\t8\/2000 in I.A.Nos.3 &amp;  5  in<br \/>\nInterlocutory  Application  No.\t  13  has  also\t been  filed<br \/>\nseeking\t to  restrain  Shri  Umadhar Prasad  Singh  and\t his<br \/>\nassociates  and\/or agents from interfering or obstructing in<br \/>\nthe  reopening\/rehabilitation of Ashok Paper Mills Ltd.\t and<br \/>\nfree  ingress  and  egress  of personnel  of  the  Mill\t and<br \/>\nmovement of goods inside and outside of the mill and to give<br \/>\ndirection  to all the persons and concerned agencies for the<br \/>\nimplementation\tof  the\t scheme.  It is now brought  to\t our<br \/>\nnotice\t that  the  mills   have  started  functioning\tand,<br \/>\ntherefore,  it is not appropriate to pass any order on\tthis<br \/>\nrelief at this stage.  So far as the other relief sought for<br \/>\nas to co-operation of other agencies is concerned, it is not<br \/>\nclear  as to what relief the applicant wants and in  respect<br \/>\nof  whom,  without  which no appropriate  direction  can  be<br \/>\ngranted\t by this Court.\t Therefore, this relief also  cannot<br \/>\nbe granted at this stage and in the manner sought for.\tThis<br \/>\napplication shall stand disposed of accordingly.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ashok Paper Mills Kamgar Union vs Union Of India &amp; Anr on 1 September, 2000 Author: R Babu Bench: S.
