Bhatt for petitioner and learned<br \/>\n\tAdvocate Mr. UT Mishra appearing for respondent workman.\n<\/p>\n<p>In<br \/>\n\tthis petition, petitioner &#8211; Shihor Nagarpalika through its<br \/>\n\tChief Officer has challenged award passed by Labour Court, Bhavnagar<br \/>\n\tin Reference (LCB) NO. 379 of 1999  Exh. 31 dated 27.10.2010. Labour<br \/>\n\tCourt has set aside termination order and granted reinstatement in<br \/>\n\tfavour of workman with 20% back wages of interim period and also<br \/>\n\tgranted continuity of service in favour of workman.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by both learned Advocates.<br \/>\n\tConsidering it, question involved and raised in this petition would<br \/>\n\trequire detailed examination. Hence, Rule. Ad-interim relief in<br \/>\n\tterms of para 18-b on condition that petitioner shall have to comply<br \/>\n\twith provisions of section 17-B of Industrial Disputes Act, 1947<br \/>\n\tfrom date of award, 27.10.2010. Today, learned Advocate Mr. Mishra<br \/>\n\tappearing for respondent workman has served copy of unemployment to<br \/>\n\tlearned advocate Mr.Gaurang H. Bhatt for petitioner, therefore, same<br \/>\n\taffidavit is taken on record for compliance of section 17-B of ID<br \/>\n\tAct, 1947.
