(2) 689\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORDER\n<\/p>\n<p>1.This\tspecial\t leave\tpetition arises\t out  of  and  is<br \/>\ndirected  against an interlocutory order dated 10-5-1994  of<br \/>\nthe High Court of Madras made in WMP No. 13629 of 1994 in WP<br \/>\nNo. 8973 of 1994.\n<\/p>\n<p>2.In the said writ petition, a political party contesting<br \/>\nthe   two   bye-elections   in\tthe   State   assailed\t the<br \/>\nconstitutional validity of Order No. 3\/8\/94-J.S.II dated 13-<br \/>\n1-1994,\t made  by the Election Commission  imposing  certain<br \/>\nrestrictions  on  the duration for the use  of\tloudspeakers<br \/>\nmounted on mobile vehicles for the election campaigns.\t The<br \/>\nrelevant and operative part of the Commission&#8217;s order  which<br \/>\nis in paragraph 3 reads :\n<\/p>\n<blockquote><p>\t      &#8220;3.  After  considering  all  aspects  of\t the<br \/>\n\t      matter,  the Commissioner, in exercise of\t its<br \/>\n\t      powers   conferred  by  Article  324  of\t the<br \/>\n\t      Constitution and all other powers enabling  it<br \/>\n\t      in this behalf, hereby DIRECT that the use  of<br \/>\n\t      loudspeakers  at\tfuture\telections  shall  be<br \/>\n\t      strictly regulated as follows :\n<\/p><\/blockquote>\n<blockquote><p>\t      (i)The   use  of\tloudspeakers  fitted   on<br \/>\n\t      vehicles\t of   any   kind   whatsoever\t for<br \/>\n\t      electioneering  purposes\tduring\tthe   entire<br \/>\n\t      election\tperiod\tstarting from  the  date  of<br \/>\n\t      announcement  of election and ending with\t the<br \/>\n\t      date   of\t declaration-of\t result\t  shall\t  be<br \/>\n\t      permitted\t  only\t between  08.00\t  a.m.\t and<br \/>\n\t      07.00p.m.\t No  moving  loudspeakers  shall  be<br \/>\n\t      permitted\t to  be used before  8.00  a.m.\t and<br \/>\n\t      after 7.00 p.m. in any area.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">\t      691<\/span><\/p>\n<blockquote><p>\t       (ii) If for the purpose of any public meeting<br \/>\n\t      or  processions  any  loudspeakers  which\t are<br \/>\n\t      fully  static are to be used beyond  the\tsaid<br \/>\n\t      hours specific prior written permission  shall<br \/>\n\t      be  obtained from the  Government\t authorities<br \/>\n\t      concerned&#8230;&#8230;\n<\/p><\/blockquote>\n<blockquote><p>\t       3.  The\tfollowing  reasons are\tset  out  as<br \/>\n\t      justification  for the promulgation  of  these<br \/>\n\t      restrictions :\n<\/p><\/blockquote>\n<blockquote><p>\t      &#8220;All  political parties, candidates and  their<br \/>\n\t      workers,\t supporters  and  sympathisers\t use<br \/>\n\t      loudspeakers    for    their    electioneering<br \/>\n\t      campaigns.   These loudspeakers are  not\tonly<br \/>\n\t      used   from  fixed  rostrums  but\t also\tused<br \/>\n\t      mounted\/fitted   on  vehicles   like   trucks,<br \/>\n\t      tempos,  cars,  taxies,  vans,  three  wheeler<br \/>\n\t      scooters, cycle-rickshaws etc.  These vehicles<br \/>\n\t      move on all roads, streets and lanes and\talso<br \/>\n\t      go   around   villages,\tbasties,   mohallas,<br \/>\n\t      colonies,\t localities  with  the\tloudspeakers<br \/>\n\t      broadcasting  at\tvery  great  volume.\tThis<br \/>\n\t      results  in  serious  &#8216;noise  pollution&#8217;\t and<br \/>\n\t      causes  great  disturbance to  the  peace\t and<br \/>\n\t      tranquillity  of\tthe  general  public.\t The<br \/>\n\t      student\tcommunity,   in\t  particular,\tgets<br \/>\n\t      seriously disturbed as their studies are badly<br \/>\n\t      hampered\t because  the\tloudspeakers   start<br \/>\n\t      blaring  from very early hours in the  morning<br \/>\n\t      and  continue to do so throughout the day\t and<br \/>\n\t      till  extremely  late  hours  ill\t the  night.<br \/>\n\t      (emphasis supplied)\n<\/p><\/blockquote>\n<p> 4.  On\t an interlocutory application for stay made  in\t the<br \/>\nwrit petition, the High Court was persuaded to the view that<br \/>\nthere  was  a  prima  facie  case  made\t out  and  that\t  an<br \/>\ninterlocutory order of stay of the operation of the impugned<br \/>\norder was required to be passed.  The Election Commission of<br \/>\nIndia  seeks  special leave to appeal against the  order  of<br \/>\nstay.\n<\/p>\n<p>5.We  have heard Shri R.K. Garg, learned  Senior  Counsel<br \/>\nfor the Election Commission of India, and Shri A.K. Sen\t and<br \/>\nShri  Ashok  H.\t Desai,\t learned  Senior  Counsel  for\t the<br \/>\nrespondents.  We grant special leave.\n<\/p>\n<p>6.   In\t support of the order of the High Court,  Shri\tA.K.<br \/>\nSen and Shri Ashok H.\t Desai\tstrenuously urged  that\t the<br \/>\nessential  question  is not whether these  restrictions\t are<br \/>\nsalutary  and beneficial and promote the comfort,  happiness<br \/>\nand  well-being of the citizens in the locality\t but  really<br \/>\nwhether\t the  Election\tCommission  even  with\tthe   widest<br \/>\namplitude  of  the  reservoir of  its  powers  contained  in<br \/>\nArticle\t 324  of the Constitution, could be said to  be\t the<br \/>\nauthority  to promote and ensure these otherwise  well-meant<br \/>\nmeasures of public comfort and well-being.  It is urged, for<br \/>\ninstance,  that\t respecting the facilities for\tthe  student<br \/>\ncommunity  to  pursue  studies\tin  a  quiet  and   tranquil<br \/>\natmosphere  etc., however laudable and desirable they  might<br \/>\notherwise  be,\tthe  question  is as to\t the  power  of\t the<br \/>\nElection  Commission to appropriate to itself  these  police<br \/>\npowers\tand constitute itself the guardian of these  values.<br \/>\nThe argument, in short, which, prima facie, commended itself<br \/>\nto  the High Court, is that there is no nexus between  these<br \/>\nrestrictions  imposed with a view to promoting\tpublic\tgood<br \/>\nwith  the objects and purposes of empowerment under  Article<br \/>\n324  of the Constitution.  It is urged that  these  measures<br \/>\nrestricting the use of loudspeakers mounted on vehicles\t are<br \/>\nmatters\t covered by existing laws such as the provisions  in<br \/>\nthe Police Act and do not fall within the ambit of what\t can<br \/>\nreasonably  be construed as matters  touching  &#8220;supervision,<br \/>\ndirection  and control&#8221; of elections vested in the  Election<br \/>\nCommission.\n<\/p>\n<p><span class=\"hidden_text\">692<\/span><\/p>\n<p>7.On a consideration of the matter, we are, prima  facie,<br \/>\nof   the  view\t and  we  abstain  from\t making\t any   final<br \/>\npronouncement  one way or the other in view of the  pendency<br \/>\nof the writ petition  that though the specifications in\t the<br \/>\npreamble  of the grounds for the need and justification\t for<br \/>\nthe  restrictions are stated in a manner susceptible to\t the<br \/>\ncontentions  advanced for the respondents, the plenitude  of<br \/>\nthose  powers under Article 324 in the matter of conduct  of<br \/>\nfair  and  free\t elections,  however,  cannot  put  out\t  of<br \/>\nconsideration the element of public inconvenience caused  by<br \/>\nthe  election  campaigns.  This, prima facie,  is  an  area,<br \/>\nperhaps, of overlapping powers.\n<\/p>\n<p>8.Indeed,  it was argued that the model code  of  conduct<br \/>\nitself\tdoes not refer to this area.  That again is  a\tmoot<br \/>\npoint whether Part 1(5) of the model code may not take\tthis<br \/>\nmatter also in its sweep.  This, of course, will have to  be<br \/>\nconsidered at the appropriate stage of final hearing of\t the<br \/>\nwrit  petitions.  For the present, we are persuaded  to\t the<br \/>\nview  that the interlocutory intervention of the High  Court<br \/>\ncannot\tbe  supported.\t The prima facie  position  and\t the<br \/>\nbalance of inconvenience seem to be in favour of the  aspect<br \/>\nof  public  good  in a matter which cannot  be\tsaid  to  be<br \/>\nunrelated  to  the  area  of  the  powers  of  the  Election<br \/>\nCommission under Article 324.\n<\/p>\n<p>9.   The  interlocutory\t order dated 10-5-1994 made  by\t the<br \/>\nHigh  Court, accordingly, requires to be and is\t hereby\t set<br \/>\naside.\n<\/p>\n<p>10.But, then, we cannot brush aside granting, prima facie,<br \/>\nthe  existence of the power of the Election  Commission\t the<br \/>\nargument  as to the somewhat excessively restrictive  nature<br \/>\nand  scope of the exercise of that power.  Shri\t R.K.  Garg,<br \/>\nafter some discussion on what might in the circumstances  be<br \/>\nreasonable  restrictions  on the use  of  loudspeakers\tfrom<br \/>\nmobile\tvehicles, fairly suggested the\ttime-restriction  in<br \/>\npara  3(1) of the impugned order which prohibits the use  of<br \/>\nloudspeakers on mobile vehicles between 7 p.m. and 8 a.m. be<br \/>\nmodified  to  read &#8220;10 p.m. and 6 a.m.&#8221; The  impugned  order<br \/>\ndated  13-1-1994 of the Election Commission, shall  be\tread<br \/>\naccordingly.\n<\/p>\n<p>11.The first sentence of para 3(ii) of the impugned  order<br \/>\nof  the\t Election Commission, it was urged,  should  not  be<br \/>\nenforced  against the Chief Minister of the State  of  Tamil<br \/>\nNadu,  as the perception of whose security requirements\t are<br \/>\nquite important and serious.  Shri R.K. Garg, again,  fairly<br \/>\nstated\tthat the Chief Minister of the State of\t Tamil\tNadu<br \/>\nwho is under the &#8216;Z Plus&#8217; category of security, shall remain<br \/>\nexempt\tfrom the restrictions contained in the said part  of<br \/>\npara  3(ii),  and  that she shall  be  entitled\t to  address<br \/>\nelection  meetings  beyond  the restricted  hours  from\t the<br \/>\nstationary  vehicles equipped with loudspeakers without\t the<br \/>\nrequirement of prior permission.  The said para 3(ii) of the<br \/>\nimpugned order shall be construed accordingly.\n<\/p>\n<p>12.
