Siri Jagan, J.\n                =-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=-=\n                         W.P(C) No. 6248 of 2010\n                =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n               Dated this, the 5th day of August, 2010.\n\n                               J U D G M E N T\n<\/pre>\n<p>      Petitioners    are the transferee and transferor respectively of<\/p>\n<p>certain lands. They applied for mutation of land in favour of the 1st<\/p>\n<p>petitioner, who is the purchaser. Their grievance in this writ petition<\/p>\n<p>is that the respondent is refusing to effect mutation of the properties<\/p>\n<p>in the name of the 2nd petitioner. Therefore, the petitioners seek the<\/p>\n<p>following relief:\n<\/p>\n<\/p>\n<blockquote><p>      &#8220;To issue a writ in the nature of mandamus or any other<br \/>\n      appropriate writ, direction or order commanding the respondent to<br \/>\n      effect mutation of the above property in the name of the first<br \/>\n      petitioner within a specified time limit.&#8221;<\/p><\/blockquote>\n<p>      2. The learned Government Pleader, on instructions, submits<\/p>\n<p>that it was after revenue recovery proceedings were initiated against<\/p>\n<p>the 2nd petitioner that the 2nd petitioner transferred the property to<\/p>\n<p>the 1st petitioner, which is against Section 44 of the Kerala Revenue<\/p>\n<p>Recovery Act and therefore the transfer itself is not binding on the<\/p>\n<p>Government. If such transfer is not binding on the Government, an<\/p>\n<p>officer of the Government cannot be directed by a writ of mandamus<\/p>\n<p>to effect mutation in respect of the property in favour of the<\/p>\n<p>purchaser. He further submits that even going by the Transfer of<\/p>\n<p>Registry Rules, the respondent is not bound to effect mutation in<\/p>\n<p>respect of such transaction. The learned Government Pleader refers<\/p>\n<p>to clause 7(2)(ii) of the Transfer of Registry Rules, wherein there is a<\/p>\n<p>specific duty cast on the village officer to certify that the property is<\/p>\n<p>not pledged as security for loans and it has not been attached by the<\/p>\n<p>Government. For that reason also, mutation cannot be directed tobe<\/p>\n<p>effected, is the contention raised by the learned Government Pleader.<\/p>\n<p>      3. I have considered the rival contentions in detail.<\/p>\n<p><span class=\"hidden_text\">W.P.C. No. 6248\/10                   -: 2 :-<\/span><\/p>\n<p>      4. Section 44 of the Kerala Revenue Recovery Act reads thus:<\/p>\n<p>     &#8220;44. Effect of engagements and transfers by the defaulter:-<br \/>\n     (1) Any engagement entered into by the defaulter with any one in<br \/>\n     respect of any immovable property after the service of the written<br \/>\n     demand on him shall not be binding upon the Government.<\/p>\n<p>            (2) Any transfer of immovable property made by a defaulter<br \/>\n     after public revenue due on any land from him has fallen in arrear,<br \/>\n     with intent to defeat or delay the recovery of such arrear, shall not<br \/>\n     be binding upon the Government.\n<\/p>\n<p>            (3) Where a defaulter transfers immovable property to a<br \/>\n     near relative or for grossly inadequate consideration after public<br \/>\n     revenue due on any land from him has fallen in arrear, it shall be<br \/>\n     presumed until the contrary is proved, that such transfer is made<br \/>\n     with intent to defeat or delay the recovery of such arrear, and the<br \/>\n     Collector or the authorised officer may, subject to the order of a<br \/>\n     competent Court, proceed to recover such arrear of public revenue<br \/>\n     by attachment and sale of the property so transferred, as if such<br \/>\n     transfer has not taken place:\n<\/p>\n<p>            Provided that, before proceeding to attach such property,<br \/>\n     the Collector or the authorized officer shall-\n<\/p>\n<p>            (i) give the defaulter an opportunity of being heard; and<\/p>\n<p>            (ii) record his reasons therefor in writing.\n<\/p>\n<p>     Explanation:-     For the purposes of tis section, &#8220;near relative&#8221;<br \/>\n     includes husband, wife, father, mother, brother, sister, son,<br \/>\n     daughter, step son, step daughter, uncle, aunt, son-in-law,<br \/>\n     daughter-in-law, brother-in-law, nephew or niece of the transferor.&#8221;<\/p>\n<p>Going by the same, after the default in payment of arrears of public<\/p>\n<p>revenue, transfer of immovable property concerned shall not be<\/p>\n<p>binding upon the Government if the same is with the intend to defeat<\/p>\n<p>or delay the recovery of such arrears of public revenue.               If such<\/p>\n<p>transfer is not binding on the Government, as rightly pointed out by<\/p>\n<p>the learned Government Pleader, this Court                   cannot issue a<\/p>\n<p>mandamus to a servant of the Government to effect mutation of the<\/p>\n<p>property in the name of the transferee. Further, clause 7(2)(ii) of the<\/p>\n<p><span class=\"hidden_text\">W.P.C. No. 6248\/10                   -: 3 :-<\/span><\/p>\n<p>Transfer of Registry Rules reads thus:\n<\/p>\n<\/p>\n<pre>     \"(7) (1)                   xx            xx           xx\n\n          (i)                   xx            xx           xx\n\n<\/pre>\n<p>            (ii) The Village Officer furnishing the required details shall<br \/>\n     also certify in the statement in Form &#8216;A&#8217; whether the lands involved<br \/>\n     therein are owned by Scheduled Castes or Scheduled Tribes and<br \/>\n     whether the transfer of registry is in favour of the same<br \/>\n     community.     It shall also be ascertained and reported whether<br \/>\n     there is any prohibition in the original document against alienation<br \/>\n     of the property by the transferor or his predecessor in interest.<br \/>\n     Village Officers should certify in Form &#8216;A&#8217; Statement to the effect<br \/>\n     that the property is not pledged as security for loans etc., and it<br \/>\n     has not been attached by Government.&#8221;\n<\/p>\n<p>\nThat is also an indication which would go to show that if the property,<\/p>\n<p>in respect of which mutation is prayed for, is pledged as security for<\/p>\n<p>loans etc., and attached by the Government, mutation cannot be<\/p>\n<p>effected in respect of that property.\n<\/p>\n<p>      In the above circumstances, the petitioners are not entitled to<\/p>\n<p>the reliefs prayed for and accordingly the writ petition is dismissed.<\/p>\n<p>                                              Sd\/- S.
