PUBLIC PROSECUTOR for Respondent(s) :\n2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tthis application under section 397 read with section 401 of the Code<br \/>\n\tof Criminal Procedure, 1973 (the Code), the applicant has challenged<br \/>\n\torder dated 21st<br \/>\n\tNovember<br \/>\n\t2003 made by the learned Judge, Family Court No.2, Ahmedabad,<br \/>\n\trejecting the application made by the applicant under section 125 of<br \/>\n\tthe Code.\n<\/p>\n<p>The<br \/>\n\tfacts stated briefly are that the applicant herein is the wife of<br \/>\n\tthe respondent No.1. The marriage between the applicant and the<br \/>\n\trespondent had taken place in the year 1995 according to Hindu rites<br \/>\n\tand rituals. According to the applicant, she had been subjected to<br \/>\n\tsevere harassment and maltreatment with a view to extract more dowry<br \/>\n\tfrom her parents and that the respondent and his parents used to<br \/>\n\tquarrel with the applicant and had severely beaten her and<br \/>\n\tthreatened her, and that, ultimately, she had been kicked out from<br \/>\n\tthe matrimonial house. The applicant, therefore, filed an<br \/>\n\tapplication seeking maintenance under the provisions of section 125<br \/>\n\tof the Code on 22nd<br \/>\n\tNovember, 2000.\n<\/p>\n<p>Vide<br \/>\n\tthe impugned order, the learned Judge of the Family Court has<br \/>\n\trejected the application for maintenance giving rise to the present<br \/>\n\tapplication.\n<\/p>\n<p>As<br \/>\n\tcan be seen from the impugned order made by the learned Judge,<br \/>\n\tFamily Court No.2, the learned Judge has recorded that the applicant<br \/>\n\therein had made serious allegations of maltreatment against her<br \/>\n\thusband and parents in-law and had also alleged that they had<br \/>\n\tdemanded dowry of Rs.2 lakhs, that she had been beaten up and thrown<br \/>\n\tout of the house, that several attempts had been made for<br \/>\n\treconciliation, however,<br \/>\n\tthe respondents had threatened to kill her in case she attempted to<br \/>\n\tenter their house.  The learned Judge has further recorded that if<br \/>\n\tthe applicant herein desires to reside with her husband, it was open<br \/>\n\tfor her to go and reside with him in light of the fact that there<br \/>\n\twas a decree of restitution in favour of the husband and that as per<br \/>\n\tthe decision of the Gujarat High Court, once an order of restitution<br \/>\n\thad been obtained, it was not permissible to pass any order of<br \/>\n\tmaintenance. According to the learned Judge, even if the application<br \/>\n\tfor restitution had been made that the intention not to incur the<br \/>\n\tliability of paying maintenance, once a decree of restitution had<br \/>\n\tbeen passed, the applicant had lost the right to claim maintenance.<br \/>\n\tThe learned Judge has further recorded that the respondent had by<br \/>\n\tway of documentary evidence as well as in his reply, stated that he<br \/>\n\twas willing to maintain his wife properly; that considering the fact<br \/>\n\tthat in the year 2002, an order had been made for restitution in<br \/>\n\tfavour of the respondent, it could not be said that the respondent<br \/>\n\twas not willing to maintain the applicant herein. The learned Judge<br \/>\n\twas, accordingly, of the view that the applicant was not in a<br \/>\n\tposition to make out any case for grant of maintenance or for<br \/>\n\tresiding separately and as such, the application was liable to be<br \/>\n\tdismissed.  It is in the background of the aforesaid facts, that the<br \/>\n\tlearned Judge has rejected the application for maintenance.\n<\/p>\n<p>From<br \/>\n\tthe facts noted hereinabove, it is apparent that while the applicant<br \/>\n\thas claimed maintenance under section<br \/>\n\t125 of the Code on the ground of ill-treatment, both physical and<br \/>\n\tmental, the respondent husband had filed proceedings seeking<br \/>\n\trestitution of conjugal rights and had succeeded. Accordingly there<br \/>\n\tis a decree of restitution is operating in favour of the respondent,<br \/>\n\twhich fact has not been disputed by the applicant. In the<br \/>\n\tcircumstances, it cannot be said that the learned Judge has<br \/>\n\tcommitted any infirmity in following a decision of the<br \/>\n\tjurisdictional High Court, and holding that in view of the fact<br \/>\n\tthere is a decree of restitution operating in favour of the<br \/>\n\trespondent husband, the applicant wife is not entitled to<br \/>\n\tmaintenance under section 125 of the Code. In the circumstances, no<br \/>\n\tcase is made out for any intervention by this Court.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application fails and is, accordingly,<br \/>\n\trejected.
