The petitioners are before<br \/>\nthis Court making complaint against working of respondent No.6 herein\n<\/p>\n<p>&#8211; Shri Bileshwar Khand Udyog Khedut Sahakari Mandali Ltd.\n<\/p>\n<p>2.\t\tThe petitioners approached this<br \/>\nCourt by filing a petition being Special Civil Application No.12147<br \/>\nof 2009, which came to be disposed of by order dated 25.08.2010.  The<br \/>\norder is reproduced to bring home that the controversy involved in<br \/>\nthe earlier petition and the present petition is the same.  The order<br \/>\nreads as under:-\n<\/p>\n<p>&#8220;1.\tBy way of this<br \/>\npetition under Article 226 of the Constitution of India, petitioners<br \/>\nhave prayed for following reliefs.\n<\/p>\n<p>&#8220;(A)\tBe pleased to<br \/>\nissue a writ of mandamus or any other appropriate writ, order or<br \/>\ndirection, by commanding respondent Authorities to take immediate<br \/>\nsteps of removal of respondent No.6 and his committee in its entirety<br \/>\nand appoint an administrator to take charge of the affairs of the<br \/>\nBileshwar Khand Udyog Khedut Sahakari Mandli, Kodinar.\n<\/p>\n<p>(B)\tBe pleased to  issue<br \/>\nan appropriate writ, order or direction directing the respondents<br \/>\nAuthorities to forthwith initiate steps against the respondents No.6<br \/>\nand 7 and their associates essentially under the provisions of<br \/>\nSection 76-B of the Cooperative Societies Act as well as launch<br \/>\nprosecution and initiate appropriate penal action against erring<br \/>\nperson, who are in-charge of Shri  Bileshwar Khand Udyog Khedut<br \/>\nSahakari Mandli Ltd.\n<\/p>\n<p>(C)\tPending admission,<br \/>\nhearing and final disposal of the petition, be pleased to direct the<br \/>\nrespondent Authorities more particularly, Registrar (Sugar<br \/>\nCooperative Mandalies) to immediately seize the record of  Bileshwar<br \/>\nKhand Udyog Khedut Sahakari Mandli, Kodinar and consequently appoint<br \/>\na special auditor and submit the audit report before the Hon&#8217;ble<br \/>\nCourt for further action and in the meantime, be pleased to appoint<br \/>\nan administrator to take charge the affairs of the Mandali.&#8221;\n<\/p>\n<p>\tIt appears that during<br \/>\nthe pendency of the present petition, inquiry was conducted against<br \/>\nrespondent No.6 and as disclosed in the further affidavit dated<br \/>\n03.07.2010 filed by Joint Director of Sugar, Gandhinagar, the<br \/>\nshow-cause notice issued against respondent No.6 has been dropped<br \/>\npursuant to the order dated 27.05.2010.  In view of the above, if the<br \/>\npetitioners are aggrieved by any subsequent decision, more<br \/>\nparticularly, decision dated 27.05.2010 dropping the<br \/>\ninquiry\/proceedings\/show-cause notice against respondent No.6, they<br \/>\nare required to initiate appropriate independent proceedings.\n<\/p>\n<p>2.\tIn view of the above,<br \/>\nShri A.J. Shastri, learned advocate appearing on behalf of the<br \/>\npetitioners, under the instructions from the respective petitioners,<br \/>\nmore particularly, petitioner No.2 who is reported to be present in<br \/>\nthe Court, seeks permission to withdraw the present petition with a<br \/>\nliberty to file a fresh petition and\/or initiate appropriate<br \/>\nindependent proceedings challenging the order dated 27.05.2010 of the<br \/>\nDirector of Sugar, State of Gujarat, Gandhinagar.\n<\/p>\n<p>3.\tPermission<br \/>\nis, accordingly, granted.  Petition is dismissed as withdrawn.  As<br \/>\nand when such a petition is filed and\/or appropriate independent<br \/>\nproceedings are initiated challenging the order dated 27.05.2010 of<br \/>\nDirector of Sugar, State of Gujarat, Gandhinagar, the same may be<br \/>\nconsidered in accordance with law and on merits without in anyway<br \/>\nbeing influenced by the present order, as this Court has not<br \/>\nexpressed any opinion on merits in favour of either parties and has<br \/>\nnot gone into merits of the case.  All the questions inclusive of<br \/>\nother reliefs which are sought in the present petition, are kept<br \/>\nopen.   Notice discharged.\n<\/p>\n<p>2.1\tThis Court in para-3 observed<br \/>\nthat, &#8220;Permission<br \/>\nis, accordingly, granted.  Petition is dismissed as withdrawn.  As<br \/>\nand when such a petition is filed and\/or appropriate independent<br \/>\nproceedings are initiated challenging the order dated 27.05.2010 of<br \/>\nDirector of Sugar, State of Gujarat, Gandhinagar, the same may be<br \/>\nconsidered in accordance with law and on merits without in anyway<br \/>\nbeing influenced by the present order, as this Court has not<br \/>\nexpressed any opinion on merits in favour of either parties and has<br \/>\nnot gone into merits of the case&#8230;..&#8221;\n<\/p>\n<p>3.\t\tLearned Advocate for<br \/>\nthe petitioners vehemently submitted that the petitioners are rightly<br \/>\nbefore this Court by filing the present petition.  Be that as it may,<br \/>\nthe challenge in this petition is to order dated 27.05.2010.\n<\/p>\n<p>4.\t\tLearned Advocate for<br \/>\nthe petitioners submitted that because the Director was at the fag<br \/>\nend of his carrier, he passed this order without applying his mind<br \/>\nand without taking into consideration the contentions raised by the<br \/>\npetitioners.  Learned Advocate for the petitioners read the entire<br \/>\norder.\n<\/p>\n<p>5.\t\tIn the opinion of<br \/>\nthis Court, the order is a well considered one.  The Director has<br \/>\ntaken into consideration all relevant material which was placed<br \/>\nbefore him for deciding the question involved in the matter.\n<\/p>\n<p>5.1\t\tA show cause notice<br \/>\nwas issued to Sahakari Mandali Ltd. &#8211; respondent No.6 herein on<br \/>\n11.12.2009.  The Director has set out in detail the accommodation<br \/>\ngranted to the parties in hearing of this show cause notice and<br \/>\nthereafter, he has dealt with every single aspect of the show cause<br \/>\nnotice in detail, setting out the reason as to why has he not found<br \/>\nany substance either in the complaint made by the present petitioners<br \/>\nor in the show cause notice.  Finally, the Director deemed it proper<br \/>\nto withdraw the notice and close the chapter.\n<\/p>\n<p>6.\t\tLearned Advocate for<br \/>\nthe petitioners vehemently submitted that he is supplied certain<br \/>\npapers by petitioner No.2 herein only yesterday, i.e. 08.12.2010,<br \/>\nwhich were obtained by petitioner No.2 in response to an RTI<br \/>\napplication.  The learned Advocate for the petitioners submitted that<br \/>\nas petitioner No.2 has suffered heart attack, he was not able to<br \/>\nsupply these papers to the learned Advocate and that is why, the<br \/>\nlearned Advocate could not produce these papers before this Court.\n<\/p>\n<p>7.\t\tTaking<br \/>\nout of sentiments from the submission that<br \/>\npetitioner No.2 has suffered heart attack, it was inquired from the<br \/>\nlearned Advocate for the petitioners as to when an application under<br \/>\nRTI was made.  He submitted that the application was made on<br \/>\n 01.09.2010<br \/>\nand the documents were supplied on  12.10.2010.<br \/>\n Today it is 09.12.2010.\n<\/p>\n<p>8.\t\tLearned Advocate for<br \/>\nthe petitioners tried to explain this inaction for about two months<br \/>\nby submitting that, &#8216;petitioner No.2 is suffering for last two and<br \/>\nhalf months&#8217; and therefore, he could not send these papers to the<br \/>\nlearned Advocate.\n<\/p>\n<p>9.\t\tLearned Advocate for<br \/>\nthe petitioners was then inquired as to where petitioner No.1 is<br \/>\nresiding.  To that, learned Advocate submitted that from the address<br \/>\nset out in the petition it appears that both the petitioners are<br \/>\nresiding in the same town.  If that is so and if both the petitioners<br \/>\nhave a common interest in pursing the matter, they must be close<br \/>\nenough to inquire the well-being of each other and if that is taken<br \/>\ninto consideration, there was no reason for petitioner No.2 to<br \/>\nwithhold these papers till yesterday and not to send the same to the<br \/>\nlearned Advocate along with petitioner No.1.  Therefore, the attempt<br \/>\nto appeal to the Court on the ground of petitioner No.2 having<br \/>\nsuffered heart attack is misplaced and misdirected.\n<\/p>\n<p>9.1\t\tLearned Advocate<br \/>\nfor the petitioners wanted the matter to be adjourned and therefore,<br \/>\nhe repeated this request for not less than half a dozen time, which<br \/>\nwas declined.\n<\/p>\n<p>9.2\t\tThe petition was<br \/>\nfiled on 15.10.2010.  Incidentally, the affidavit is affirmed by<br \/>\npetitioner No.2 &#8211; Balubhai J.Jadav.  If that is so, the story<br \/>\nthat petitioner No.2 was suffering for two and half months is found<br \/>\nto be without any substance.  All this is required to be set out<br \/>\nbecause an unreasonable stand is taken by the petitioners.\n<\/p>\n<p>10.\t\tAs set out<br \/>\nhereinabove, the order passed by the Director is found to be just and<br \/>\nproper, no interference is required at the hands of this Court.  The<br \/>\npetition is found to be without any substance and hence, it is<br \/>\ndismissed.
