      The petitioner herein seeks to quash Exhibit P2 proceedings<\/p>\n
of the University. A consequential direction is sought to allow the<\/p>\n
petitioner to appear for the 4th Semester B.Tech Degree IT<\/p>\n
Engineering Course.\n<\/p>\n
      2.   The petitioner is studying in the 4th respondent-<\/p>\n
College.   The 3rd Semester examination was commenced on<\/p>\n
9.11.2009 and he attended the examination for Engineering<\/p>\n
Mathematics-II paper on 9.11.2009.             On that day, Invigilator<\/p>\n
recovered the calculator that was being used by the petitioner<\/p>\n
and on verification it was found that on the lid of the calculator<\/p>\n
there were some inscriptions made using pencil. According to the<\/p>\n
petitioner, he was unaware of the same.              The calculator was<\/p>\n
borrowed by some of the senior students and he denied any<\/p>\n
involvement in respect of the inscriptions made by pencil. But<\/p>\n
the Invigilator, after recovering the calculator sent the petitioner<\/p>\n
out of the examination hall and thereafter he was not allowed to<\/p>\n
continue the examination. He was also prevented from appearing<\/p>\n

for the subsequent examinations for the 3rd Semester.<\/p>\n
      3.    This Writ Petition was filed when the 4th Semester<\/p>\n
examination was expected to be held in the last week of April,<\/p>\n
2010.    In the meanwhile, an enquiry was conducted into the<\/p>\n
alleged malpractice of the petitioner and Exhibit P1 is the copy of<\/p>\n
the enquiry report. It was concluded by the Enquiry Officer that<\/p>\n
the writing on the calculator is not connected with the<\/p>\n
examination Mathematics-II. On enquiry with the experts, they<\/p>\n
said that the writings is connected with the ‘C’ programming.<\/p>\n
The Enquiry Officer recommended that the petitioner may be<\/p>\n
permitted to write the next examination by cancelling the whole<\/p>\n
of the examination as a punishment.       Exhibit P2 is the show<\/p>\n
cause notice which was issued later, to which the petitioner<\/p>\n
submitted Exhibit P3 reply. The petitioner relies upon Chapter 14<\/p>\n
of the Examination Manual, a true copy of which has been<\/p>\n
produced as Exhibit P6. It is contended that even in the light of<\/p>\n
the Examination Manual, it is clear that the students appearing<\/p>\n
for the B.Tech Engineering Courses are entitled to carry a<\/p>\n
calculator and the same is permitted. Paragraph No.35 of the<\/p>\n
Manual provides that there shall not be any scribbling on the<\/p>\n

calculator directly or indirectly to facilitate any kind of<\/p>\n
malpractice in the examination.         Going by Chapter 14, the<\/p>\n
malpractice will be one if any material relevant to the<\/p>\n
examination is introduced. Accordingly, it is contended that the<\/p>\n
action cannot be supported.\n<\/p>\n
      4.    Heard the learned Standing Counsel for the University<\/p>\n
and the learned Standing Counsel for the College.<\/p>\n
      5.    Identical   question    was    considered     in W.P.(C)<\/p>\n
No.3831\/2010, a copy of which has been produced as Exhibit P7.<\/p>\n
Paragraphs 10 and 11 of the said judgment are reproduced<\/p>\n
below.\n<\/p>\n
            10. Herein, the respondents are relying upon<\/p>\n
            item 1 of clause 2 of Ext.P1, viz. introduction<\/p>\n
            of any material relevant to the examination<\/p>\n
            inadvertently and the punishment shows<\/p>\n
            debarring of one or two chances. As rightly<\/p>\n
            pointed out by the learned counsel for the<\/p>\n
            petitioner, what is described as malpractice is<\/p>\n
            “introduction of any material relevant to the<\/p>\n
            Examination, inadvertently.” There is no proof<\/p>\n
            that the petitioner has brought any material<\/p>\n
            relevant    for    the    examination     even<\/p>\n
            inadvertently which is supported by the<\/p>\n

            findings in Ext.P3 enquiry report which shows<\/p>\n
            that the candidate has never used any of the<\/p>\n
            inscriptions. Even as per the report of the<\/p>\n
            invigilator recorded in Ext.P3,     it reads that<\/p>\n
            “on    verification  it was   found    that  the<\/p>\n
            inscriptions were not related     or relevant to<\/p>\n
            the subject, Basic Electrical Engineering. The<\/p>\n
            written   matter    is  not   easily   readable.”<\/p>\n
            Therefore, going by the conclusions arrived at<\/p>\n
            by the enquiry commission, as items 2 and 3,<\/p>\n
            the petitioner has never used any of the<\/p>\n
            inscriptions.    It cannot be termed that the<\/p>\n
            same will be a malpractice as referred to in<\/p>\n
            clause 1 of Chapter 14. In the absence of any<\/p>\n
            finding that the petitioner has resorted to<\/p>\n
            unfair means for getting undue advantage in<\/p>\n
            the      valuation,    there  cannot    be   any<\/p>\n
            punishment      by way of debarring of one or<\/p>\n
            two chances, coming within item 1 of clause<\/p>\n
            2.    He has not introduced any material<\/p>\n
            relevant to the examination, in the light of the<\/p>\n
            finding that the inscription has nothing to do<\/p>\n
            with the paper he has written, viz. Basic<\/p>\n
            Electrical Engineering.\n<\/p>\n
            11.      Then the further question to be<\/p>\n
            considered is whether the reliance placed on<\/p>\n
            Statute 3 (xxi) of Chapter 6 of             M.G.\n<\/p>\n
            University First Statutes, is correct. It applies<\/p>\n

            only when a candidate is found guilty of using<\/p>\n
            or attempting to use unfair means at an<\/p>\n
            examination.     As evident from the facts<\/p>\n
            revealed above, the same is not evidently<\/p>\n
            attracted as no such allegations are proved.<\/p>\n
            The Syndicate is given power to cancel the<\/p>\n
            examination in such cases and also debar the<\/p>\n
            candidate from appearing in one or two<\/p>\n
            examinations.    What is emphasised in the<\/p>\n
            counter affidavit is that the act of the<\/p>\n
            petitioner will amount to a malpractice.     As<\/p>\n
            already found by me earlier,      bringing of a<\/p>\n
            calculator in the light of Regulation 35 of the<\/p>\n
            Examination Manuel, cannot be a malpractice<\/p>\n
            at all. Therefore, the punishment granted by<\/p>\n
            the Syndicate as per Ext.P5 has no nexus with<\/p>\n
            the items of punishment provided in Ext.P1<\/p>\n
            and Statute 3(xxi) of Chapter 6 of the<\/p>\n
            Statutes.     In the      absence of proven<\/p>\n
            misconduct     or   malpractice   against   the<\/p>\n
            petitioner, such a punishment cannot be<\/p>\n
            granted. The punishment should have nexus<\/p>\n
            with the gravity of offence and cannot be one<\/p>\n
            unrelated to the proven acts of the students.<\/p>\n
            The violation pointed out as item 3 in Ext.P3<\/p>\n
            that the candidate brought his calculator with<\/p>\n
            some inscriptions, cannot also be supported<\/p>\n
            in the light of the findings therein that the<\/p>\n

            candidate     has never used any of the<\/p>\n
            inscriptions. Even if it amounts to a technical<\/p>\n
            violation of the Regulations, in the light of the<\/p>\n
            explanation offered by the petitioner and the<\/p>\n
            findings contained in the enquiry report, that<\/p>\n
            cannot lead to a punishment like this.<\/p>\n
Since the position herein is the same, the said finding applies to<\/p>\n
the facts of this case also.\n<\/p>\n
      6.    In that view of the matter, the reason shown in the<\/p>\n
show cause notice may not be supportable.              Therefore, there<\/p>\n
will be a direction to the University to pass an appropriate order<\/p>\n
in the light of the findings rendered in Exhibit P7 judgment which<\/p>\n
are applicable to the facts of this case also, within a period of six<\/p>\n
weeks from the date of receipt of a copy of this judgment. The<\/p>\n
result of the examination attended to by the petitioner will be<\/p>\n
published depending upon the order to be passed by the<\/p>\n
University.\n<\/p>\n
      The Writ Petition is disposed of as above. No costs.<\/p>\n
