At this stage,<\/p>\n<p>there does not appear to be any chance of reconciliation on account<\/p>\n<p>of certain apprehensions in the minds of both the parties.<\/p>\n<p>                  Heard on merits.\n<\/p>\n<p>                  Petitioner-wife seeks the transfer of a petition<\/p>\n<p>under Section 9 of the Hindu Marriage Act, pending in the Court of<\/p>\n<p>Additional Civil Judge (Sr.Divn.), Nakodar, to a Court of competent<\/p>\n<p>jurisdiction at Hoshiarpur, on the ground that she is employed at<br \/>\n<span class=\"hidden_text\"> T.A. No.20 of 2009                                 -2-<\/span><\/p>\n<p>Tanda, and it will be convenient for her to attend the dates of hearing<\/p>\n<p>at Hoshiarpur.\n<\/p>\n<p>                     Counsel for the respondent has contended that a<\/p>\n<p>similar application was filed by the petitioner for transfer when on an<\/p>\n<p>earlier occasion, a petition under Section 9 of the Hindu Marriage<\/p>\n<p>Act, had been filed by the respondent-husband at Nakodar. After<\/p>\n<p>taking into consideration the facts and circumstances, this Court had<\/p>\n<p>transferred    the   proceedings   to    Jalandhar.      Said   proceedings<\/p>\n<p>culminated into a compromise. On account of subsequent events, the<\/p>\n<p>respondent had to file a fresh petition under Section 9 of the Hindu<\/p>\n<p>Marriage Act, at Nakodar. The petitioner present in the Court doubts<\/p>\n<p>the bona fides of the respondent in filing the application under<\/p>\n<p>Section 9 of the Hindu Marriage Act, claiming that the said<\/p>\n<p>proceedings might have been filed, in order to create a defence in<\/p>\n<p>the criminal proceedings initiated by her under Sections 406 &amp; 498-A<\/p>\n<p>IPC.\n<\/p>\n<p>                     Without expression of any opinion regarding the<\/p>\n<p>intentions    of   the   respondent,    taking   into    consideration   the<\/p>\n<p>convenience of the parties, it is deemed appropriate to transfer the<\/p>\n<p>proceedings under Section 9 of the Hindu Marriage Act, pending at<\/p>\n<p>Nakodar to Hoshiarpur.\n<\/p>\n<p>                     File of the case, complete in all respects, be<\/p>\n<p>forwarded by Additional Civil Judge (Sr.Divn.), Nakodar to District<\/p>\n<p>Judge, Hoshiarpur, so that the same may be entrusted to an<\/p>\n<p>appropriate Court for proper adjudication in accordance with law.<br \/>\n<span class=\"hidden_text\"> T.A.
