He, therefore, submitted that the<br \/>\n\tcomplaint has been filed falsely and the present application may be<br \/>\n\tallowed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Ms.Shah resisted the present application and submitted that<br \/>\n\tthough the agreement has been made, it has not been specifically<br \/>\n\treferred with regard to outstanding dues of the loan.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the applicant-accused and learned A.P.P.<br \/>\n\tfor the State and having considered the rival submissions including<br \/>\n\tthe agreement at Annexure-C referring to these aspects, the Court is<br \/>\n\tof the opinion that the present application deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.120\/2010<br \/>\n\tregistered with Mansa Police Station, District : Gandhinagar on his<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five Thousand Only) with one<br \/>\n\tsolvent surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till filing of the<br \/>\nchargesheet.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
