SIRI JAGAN, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                  W.P.(C)No. 14913 of 2010\n               - - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 3rd day of June, 2010\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioner was doing business in shop room<\/p>\n<p>bearing No. CC 6\/104, owned by the 2nd respondent since<\/p>\n<p>1998, on rental basis. The shop was originally taken on<\/p>\n<p>lease by the petitioner&#8217;s uncle one Sri. E.A. Balakrishnan<\/p>\n<p>and after his death, the petitioner has been running the<\/p>\n<p>business in the said premises, allegedly with the sanction<\/p>\n<p>and knowledge of the 2nd respondent. The petitioner alleges<\/p>\n<p>that the 2nd respondent demanded arrears of rent from 1998<\/p>\n<p>-2003 as evidenced by Exts.P1 &amp; P2. The petitioner paid<\/p>\n<p>the same. Thereafter the lease agreement was allegedly<\/p>\n<p>renewed up to 2008. However the lease was not extended<\/p>\n<p>thereafter and rent was also refused to be received.<\/p>\n<p>According to the petitioner this was with the intention of<\/p>\n<p>evicting the petitioner, terming him as an unauthorized<\/p>\n<p>W.P.(C)No. 14913 of 2010<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><\/p>\n<p>occupant.        In the above circumstances the petitioner<\/p>\n<p>approached the Munsiff&#8217;s Court, Kochi and obtained an<\/p>\n<p>injunction. Subsequently that O.S. was disposed of by the<\/p>\n<p>Munsiff&#8217;s Court as per Ext.P10 judgment in the following<\/p>\n<p>terms:\n<\/p>\n<blockquote><p>      &#8220;1.   Plaintiff shall not be evicted without serving Section 4<br \/>\n            notice of the Kerala Public Buildings (Eviction of<br \/>\n            un-authorised occupants) Act, 1968.\n<\/p><\/blockquote>\n<blockquote><p>      2.    Ext.B5 notice is not a proper notice issued to the<br \/>\n            occupant of the rented premises as per the provisions in<br \/>\n            the Act.\n<\/p><\/blockquote>\n<blockquote><p>      3.    It is made clear that defendants have got every right to<br \/>\n            evict the plaintiff in accordance with the provisions in the<br \/>\n            Kerala Public Buildings (Eviction of Un-authorised<br \/>\n            Occupants) Act.\n<\/p><\/blockquote>\n<blockquote><p>      4.    Considering the nature and circumstances of the case I<br \/>\n            direct the respective parties to bear their respective<br \/>\n            costs in the suit.&#8221;<\/p><\/blockquote>\n<p>      2.    Petitioner now submits that contrary to the<\/p>\n<p>directions of the civil court, without completing proceedings<\/p>\n<p>under the Kerala Public Buildings (Eviction of unauthorised<\/p>\n<p>Occupants) Act, 1968 the petitioner has been forcefully<\/p>\n<p>evicted from the premises. Petitioner therefore seeks the<\/p>\n<p>following reliefs :\n<\/p>\n<p>      &#8220;1)    call for the records leading to Exhibit P11 show cause<br \/>\n             notice and quash the same by issuing a writ of certiorari.<\/p>\n<p>W.P.(C)No. 14913 of 2010<br \/>\n<span class=\"hidden_text\">                                     -3-<\/span><\/p>\n<p>      2)     Issue a writ of Mandamus or any other writ, order or<br \/>\n             direction to the respondents to restore the possession of<br \/>\n             the rented premises CC No.6\/104 in the boat jetty<br \/>\n             premises to the petitioner and allowing him to run the<br \/>\n             business in the shop and to renew the lease agreement<br \/>\n             in the name of petitioner after receiving the arrears of<br \/>\n             rent.&#8221;\n<\/p>\n<\/p>\n<p>      3.    On 18.05.2010, I passed the following interim<\/p>\n<p>order:\n<\/p>\n<blockquote><p>            &#8220;The learned Government Pleader shall get instructions<br \/>\n      as to whether the petitioner has been evicted from the<br \/>\n      preemies as alleged by the petitioner and if so, whether, before<br \/>\n      eviction, an order has been passed under the Kerala Public<br \/>\n      Buildings (Eviction of Unauthorized Occupants) Act, 1968.&#8221;<\/p><\/blockquote>\n<p>      4.    Today, the learned Government Pleader submits<\/p>\n<p>that although Section 4 notice has been issued to the<\/p>\n<p>petitioner no final orders have been passed before evicting<\/p>\n<p>the petitioner.       I am of opinion that, that is against the<\/p>\n<p>provisions of the Act and also Ext.P10 judgment of the civil<\/p>\n<p>court. It is unjust to evict the petitioner without passing a<\/p>\n<p>considered       order      under      the    Act.     In    the     above<\/p>\n<p>circumstances, the writ petition is disposed of with the<\/p>\n<p>following directions:\n<\/p>\n<p>W.P.(C)No. 14913 of 2010<br \/>\n<span class=\"hidden_text\">                                -4-<\/span><\/p>\n<p>      Possession of the shop room in question shall be<\/p>\n<p>      restored to the petitioner forthwith.      The 2nd<\/p>\n<p>      respondent shall pass final orders pursuant to<\/p>\n<p>      Section 4 notice under the Kerala Public Buildings<\/p>\n<p>      (Eviction of unauthorised Occupants) Act, 1968<\/p>\n<p>      after affording an opportunity of being heard to<\/p>\n<p>      the petitioner and communicate the order to the<\/p>\n<p>      petitioner. Only after two weeks from the date<\/p>\n<p>      when a copy of that order is served on the<\/p>\n<p>      petitioner coercive proceedings shall be initiated<\/p>\n<p>      for eviction if the order authorises the same. The<\/p>\n<p>      same would also be subject to the right of the<\/p>\n<p>      petitioner       to challenge   the    said   order<\/p>\n<p>      appropriately and to seek interims orders.<\/p>\n<p>                                                S.
