Justice P.R.RAMACHANDRA MENON\n\n Dated :23\/03\/2009\n\n O R D E R\n             P.R.RAMACHANDRA MENON, J.\n             ======================\n                   W.P.(C) No.1496 of 2007\n             ======================\n           Dated, this the 23rd day of March, 2009\n                      J U D G M E N T\n<\/pre>\n<p>       The petitioners have approached this Court mainly to<\/p>\n<p>restrain   the   first  respondent     from  operating    the<\/p>\n<p>Quarry\/Crusher unit in the property in question, since it is<\/p>\n<p>situated within the prohibited distance, particularly when<\/p>\n<p>the first respondent is stated as running the Unit quite<\/p>\n<p>illegally, without obtaining the necessary licence provided<\/p>\n<p>under the relevant provisions of law.\n<\/p>\n<\/p>\n<p>     2.    Earlier, taking note of the counter affidavit filed<\/p>\n<p>by the official respondents, it was observed by this Court,<\/p>\n<p>on 30.3.2007, that the concerned authorities have not<\/p>\n<p>issued any licence to the first respondent and in the said<\/p>\n<p>circumstances, this Court had passed an interim order<\/p>\n<p>staying the work in the Quarry run by the first respondent.<\/p>\n<p>Despite having entered appearance, the first respondent<\/p>\n<p>has not chosen to file any counter affidavit, nor has he<\/p>\n<p>produced the licence, if any, issued by the authorities under<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 1496\/2007          -:2:-<\/span><\/p>\n<p>the Explosives Act and Rules; the &#8216;consent to establish&#8217; and<\/p>\n<p>&#8216;consent to operate&#8217; given by the Pollution Control Board;<\/p>\n<p>the licence issued by the concerned local authority etc. It is<\/p>\n<p>also pertinent to note that the first respondent has not come<\/p>\n<p>forward seeking to review the interim order passed above<\/p>\n<p>two years ago. It is pointed out by the learned Senior<\/p>\n<p>Government Pleader appearing for the official respondents<\/p>\n<p>that the Quarry is not in operation as on this date.<\/p>\n<p>     3.
