JUSTICE HARBANS LAL\n\nPresent:-   Mr. Surender Deswal, Advocate for the petitioner.\n\n            Mr. Amit Kaushik, Assistant Advocate General, Haryana.\n                         ****\nJUDGMENT\n<\/pre>\n<p>HARBANS LAL, J.\n<\/p>\n<p>            This petition has been moved by Satbir under Section 482 of<\/p>\n<p>the Code of Criminal Procedure read with Article 226\/227 of the<\/p>\n<p>Constitution of India for holding that he has been illegally deprived of the<\/p>\n<p>benefit of pre-mature release and his further detention is violative of<\/p>\n<p>Articles 14, 19 and 21 of the Constitution of India and he is entitled to be<\/p>\n<p>released forthwith on usual terms and conditions.\n<\/p>\n<p>            The brief facts giving rise to this petition are that the petitioner<\/p>\n<p>was involved in FIR No.175 dated 12.11.1993 registered under Sections<\/p>\n<p>302\/201 IPC at Police Station Julana, District Jind. He was convicted and<\/p>\n<p>sentenced on 11.5.1996 by the Court of learned Additional Sessions Judge,<\/p>\n<p>Jind. The petitioner as per the details of period given in this petition has<\/p>\n<p>undergone more than 10 years of the actual sentence and more than 14 years<\/p>\n<p>of the sentence including remissions. While undergoing the sentence, he<br \/>\n Criminal Misc. No. M-1519 of 2009                              -2<\/p>\n<p>maintained good conduct. He was not involved in any other crime. He<\/p>\n<p>earned remissions on account of good conduct and enjoyed the benefit of<\/p>\n<p>parole and furlough. He is a well-behaved convict in the jail. As per<\/p>\n<p>Section 433-A of the Code of Criminal Procedure added on 18.12.1978, the<\/p>\n<p>life convicts who were found guilty for having committed an offence for<\/p>\n<p>which death is one of the punishment provided by law are required to<\/p>\n<p>undergo at least 14 years of imprisonment.        As per this Section, the<\/p>\n<p>appropriate government is fully competent to commute the sentence of<\/p>\n<p>imprisonment for life into imprisonment for a term not exceeding 14 years.<\/p>\n<p>In Maru Ram v. Union of India and others, (1981) 1 Supreme Court<\/p>\n<p>Cases 107, the provisions of the said Section have been upheld by the Apex<\/p>\n<p>Court. On 11.5.1996, when the petitioner was convicted, the government<\/p>\n<p>policy dated 4.2.1993 was in force. As per this policy, the petitioner was<\/p>\n<p>required to undergo 10 years&#8217; actual sentence and 14 years sentence<\/p>\n<p>including remissions.   The State of Haryana has failed to consider the<\/p>\n<p>petitioner&#8217;s case for grant of pre-mature release and deferred the pre-mature<\/p>\n<p>release case of the petitioner till he completes 14 years of actual sentence<\/p>\n<p>and 20 years&#8217; sentence including remissions but without following the<\/p>\n<p>observations rendered by the Apex Court in re: <a href=\"\/doc\/867169\/\">State of Haryana v.<\/p>\n<p>Mahender Singh and others<\/a>, 2007(4) Recent Criminal Reports<\/p>\n<p>(Criminal) 909.\n<\/p>\n<p>            In the joint written statement, filed on behalf of the<\/p>\n<p>respondents, inter-alia it has been pleaded that in case Maru Ram (supra)<\/p>\n<p>and in another case bearing caption Mohd. Munna v. Union of India and<\/p>\n<p>others, (2005) 7 Supreme Court Cases 417, it has been held that the<\/p>\n<p>sentence of imprisonment for life was nothing else than an imprisonment<br \/>\n Criminal Misc. No. M-1519 of 2009                               -3<\/p>\n<p>which lasted till the last breath. The sentence of imprisonment for life is a<\/p>\n<p>imprisonment for whole of the remaining period of the convicted persons&#8217;<\/p>\n<p>natural life, unless the same is commuted or remitted by appropriate<\/p>\n<p>authority under the relevant provisions of the Code of Criminal Procedure.<\/p>\n<p>The remission and commutation of sentence is not a fundamental right of a<\/p>\n<p>convict. The Government has framed the pre-mature release policy dated<\/p>\n<p>13.8.2008 in which it has been categorically mentioned that the policy shall<\/p>\n<p>be applicable to all pre-mature release cases of life convicts with effect from<\/p>\n<p>the date of notification irrespective of their date of conviction. The date for<\/p>\n<p>consideration of pre-mature release of a convict would be the date of<\/p>\n<p>completion of his requisite sentence mentioned in the policy. The petitioner<\/p>\n<p>has undergone only 11 years, 2 months and 1 day of the actual sentence and<\/p>\n<p>a total sentence of 14 years, 3 months and 7 days including remissions. He<\/p>\n<p>does not qualify the conditions of pre-mature release as per Para 2(b) of<\/p>\n<p>Haryana Government Pre-mature Release policy dated 13.8.2008. Lastly, it<\/p>\n<p>has been prayed that this petition may be dismissed.\n<\/p>\n<p>            I have heard the learned counsel for the parties, besides<\/p>\n<p>perusing the record with due care and circumspection. Learned counsel for<\/p>\n<p>the parties have reiterated the averments as enshrined in their respective<\/p>\n<p>pleadings. In Mahender Singh&#8217;s case (supra), Maru Ram as well as<\/p>\n<p>Mohd. Munna&#8217;s cases were also considered. Their Lordships in re:<\/p>\n<p>Mahender Singh (supra) were pleased to hold that `Although no convict<\/p>\n<p>can be said to have any constitutional right for obtaining remission in his<\/p>\n<p>sentence, he in view of the policy decision itself must be held to have right<\/p>\n<p>to be considered therefor.     Whenever, thus a policy decision is made,<\/p>\n<p>persons must be treated equally in terms thereof. A `fortiori&#8217; the policy<br \/>\n Criminal Misc. No. M-1519 of 2009                              -4<\/p>\n<p>decision applicable in such cases would be which was prevailing at the time<\/p>\n<p>of his conviction. Furthermore, if the Punjab Rules are applicable in the<\/p>\n<p>State of Haryana in view of the State Re-organisation Act, no executive<\/p>\n<p>instruction would prevail over the statutory Rules.       The Rules having<\/p>\n<p>defined `convicts&#8217; in terms whereof a `life convict&#8217; was entitled to have his<\/p>\n<p>case considered within the parameters laid down therein, the same cannot be<\/p>\n<p>taken away by reason of an executive instruction by redefining the term `life<\/p>\n<p>convict&#8217;.&#8221; It has also been observed that in Mohd. Munna&#8217;s case, Maru<\/p>\n<p>Ram&#8217;s case (supra) was not considered. Further in re: <a href=\"\/doc\/327616\/\">State of Haryana v.<\/p>\n<p>Bhup Singh and others<\/a>, 2009(1) Recent Criminal Reports (Criminal)<\/p>\n<p>654, the Apex Court observed as under:-\n<\/p>\n<blockquote><p>            &#8220;We, therefore, are of the opinion that keeping in view the<\/p>\n<p>            decision of this Court in Mahender Singh (supra), the<\/p>\n<p>            impugned judgment should be modified directing the appellant<\/p>\n<p>            to consider the cases of the respondents.        It is, therefore,<\/p>\n<p>            directed that if the respondents have not already been released,<\/p>\n<p>            the State shall consider their cases in terms of the judgment of<\/p>\n<p>            this Court in Mahender Singh&#8217;s case (supra) having regard to<\/p>\n<p>            the policy decision as was applicable on the date on which they<\/p>\n<p>            were convicted and not on the basis of the subsequent policy<\/p>\n<p>            decision of the year 2002.&#8221;<\/p><\/blockquote>\n<p>            Adverting to the facts of the instant case, there is no gainsaying<\/p>\n<p>the fact that the petitioner was convicted and sentenced on 11.5.1996 in case<\/p>\n<p>FIR referred hereinbefore.\n<\/p>\n<p>            In view of the preceding discussion, the respondents are<\/p>\n<p>directed to consider the case of the petitioner in terms of Mahender Singh<br \/>\n Criminal Misc. No. M-1519 of 2009                               -5<\/p>\n<p>and others&#8217; case (supra) as well as Bhup Singh and others&#8217; case (supra),<\/p>\n<p>having regard to the policy decision as was applicable on the date on which<\/p>\n<p>he was convicted within one month from the date of receipt of the certified<\/p>\n<p>copy of this judgment.
