Advocate\n\nHon'ble Imtiyaz Murtaza,J.\n<\/pre>\n<p>Hon&#8217;ble Shri Kant Tripathi,J.\n<\/p>\n<p>Heard learned counsel for the petitioners and also learned<br \/>\nA.G.A. appearing for the State.\n<\/p>\n<p>The argument substantially is that fraught relation emanating<br \/>\nfrom matrimonial bickering escalated into launching of<br \/>\ncriminal proceeding vide F.I.R. which was registered at case<br \/>\ncrime No. 890 of 2009 under sections 498A, 323 IPC and<br \/>\nsection 3\/4 of the Dowry Prohibition Act, P.S Charthawal,<br \/>\nDistrict Muzaffar Nagar.\n<\/p>\n<p>Having considered the arguments advanced across the bar,<br \/>\nwe have a feeling that Court owes a duty to the society to<br \/>\nstrain to the utmost to repair the frayed relations between the<br \/>\nparties so that the wounded situation may be healed into a<br \/>\nhealthy rapprochement. The matter in hand also appears to<br \/>\nbe one of those cases in which reconciliation should be tried<br \/>\nbetween the disputing parties.\n<\/p>\n<p>While referring the matter to Mediation Centre with the<br \/>\nconsent of the petitioners, it is directed that Petitioners shall<br \/>\ndeposit a sum of Rs. 5000\/- with the Mediation Centre by way<br \/>\nof Bank draft drawn in favour of Opp party no.4. The Bank<br \/>\n draft aforesaid, it is further directed, shall be handed over to<br \/>\nthe Opp party No. 4 on her appearing before the Mediation<br \/>\nCentre on the date fixed. The amount aforesaid, it may be<br \/>\nclarified, are meant to meet expenses to be incurred for<br \/>\nattending mediation sessions at Allahabad for the Opp. Party<br \/>\nno. 4 and the person escorting her.\n<\/p>\n<p>The office upon deposit of the Bank draft shall issue notice<br \/>\nwithin one week to respondent no. 4 i.e the wife calling upon<br \/>\nher to appear in the Mediation Centre at Allahabad High<br \/>\nCourt on a date to be indicated in the said notice stating<br \/>\ntherein that the Bank draft deposited by the petitioner shall be<br \/>\ndelivered to her whenever she appears in the Mediation<br \/>\ncentre on the date fixed. The said notice shall be served upon<br \/>\nthe respondent no.4 through C.J.M concerned. It needs<br \/>\nhardly be said that both the parties shall appear either on the<br \/>\ndate fixed or on a future date as may be agreed before the<br \/>\nMediation Centre for reconciliation.\n<\/p>\n<p>The centre shall submit a report within one month from the<br \/>\ndate of parties appearing before it for reconciliation. The case<br \/>\nshall be listed in the second week of March 2010 alongwith<br \/>\nreport of Mediation Centre.\n<\/p>\n<p>In the meanwhile, the arrest of the petitioners in the aforesaid<br \/>\ncase shall remain stayed.\n<\/p>\n<p>It may made clear that in case, there occurs default by the<br \/>\nhusband either in depositing the amount or in appearing<br \/>\nbefore the Mediation Centre on the date or dates fixed, the<br \/>\n interim order staying arrest shall cease to be operative and<br \/>\nthe Mediation Centre shall immediately communicate with the<br \/>\noffice which in turn shall list the case within a week before the<br \/>\nBench concerned for passing appropriate order in the matter.\n<\/p>\n<p>It may be clarified that the case will not be treated as tied up<br \/>\nto this Bench shall be listed before the appropriate Bench.\n<\/p>\n<p>Copy of this order will not be issued unless steps are taken.\n<\/p>\n<p>Order Date :- 4.1.2010<br \/>\nMTA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Smt.
