The
\n\tpresent acquittal Appeal is filed by the appellant – State
\n\tthrough food inspector Mr. P.R. Panchal, under Section 378(4) Cr.
\n\tP.C., against the Judgment and order dated 9.4.2010, rendered in
\n\tCriminal Case No. 1115 of 1998 by the learned 4th
\n\tAdditional Chief Judicial Magistrate, Godhra. The said case was
\n\tregistered against the present respondent – original accused
\n\tfor the offence under Sections 2(1-A) (A) & (B) and Section 7(1)
\n\t& 16  of the Prevention of Food Adulteration Act (for short “PFA
\n\tAct”) in the Court of learned 4th Additional Chief
\n\tJudicial Magistrate, Godhra. The said Judgment of the trial Court
\n\thas been challenged by the State on the ground that the Judgment and
\n\torder passed by learned Magistrate is against the law and evidence
\n\ton record.\n<\/p>\n
According
\n\tto the prosecution case on 1.10.1997 at about 2:45 p.m., the
\n\tcomplainant visited the business premises of the respondent –
\n\taccused, along with Panch and took the sample of “Chutki
\n\tGutka” for the purpose of analysis. Thereafter, after
\n\tcompleting the necessary procedure, the complainant sent one sample
\n\tto the Public Analyst, for analysis. The Public Analyst submitted
\n\tthe report in which it has been found that “the sample was not
\n\tin accordance with the standard laid down under the provisions of
\n\tthe Prevention of Food Adulteration Rules, 1955. Upon receipt of the
\n\treport the complainant, after obtaining sanction, filed complaint
\n\tagainst the respondent – accused for the offences under
\n\tSections  2(1-A) (A) & (B) and Section 7(1) & 16  of the Act
\n\tin the Court of learned 4th Additional Chief Judicial
\n\tMagistrate, Godhra, being Criminal Case No. 1115 of 1998.\n<\/p>\n
At
\n\tthe conclusion of trial and after appreciating the oral as well as
\n\tdocumentary evidence, the learned Magistrate vide impugned Judgment,
\n\tacquitted the respondent – accused.\n<\/p>\n
Learned
\n\tCounsel Mr. H.L. Jani, appearing on behalf of the appellant –
\n\tState has contended that the Judgment and order of acquittal is
\n\tcontrary to law and evidence on record and is not proper. He has
\n\tcontended that the learned Magistrate has not considered the
\n\tevidence adduced on behalf of the prosecution. He has contended that
\n\tthe Public analyst has unequivocally rendered his opinion that the
\n\tfood article in question was adulterated and the certificate issued
\n\tby the Public analyst is conclusive proof of adulteration. He has
\n\tcontended that the proper procedure was followed by the Food
\n\tInspector during the raid. He has contended that from the oral as
\n\twell as documentary evidence it is already established beyond
\n\treasonable doubt that the prosecution has followed the mandatory
\n\tprovision of law.\n<\/p>\n
I
\n\thave gone through the papers produced in the Case. I have also gone
\n\tthrough the evidence led before the trial Court as well as the
\n\tExpert Opinion. I have also gone through the Judgment of the trial
\n\tCourt.  From the perusal of the documentary evidence, it appears
\n\tthat the mandatory provisions of law is not followed by the
\n\tprosecution and also the prosecution has failed to prove provisions
\n\tof Section 10(7) of the act.  From the Judgment of the trial Court
\n\tit clearly appears that the complainant, in his cross examination,
\n\thimself has admitted that the sample of “Chutki Gutka”was
\n\tdifferent. Panch has also not supported the case of prosecution. In
\n\tthe facts of the case I am in complete agreement with the reasons
\n\tassigned by the trial Court.\n<\/p>\n
It
\n\tis settled legal position that in acquittal Appeal, the Appellate
\n\tCourt is not required to re-write the Judgment or to give fresh
\n\treasonings when the Appellate Court is in agreement with the reasons
\n\tassigned by the trial Court acquitting the accused. In the instant
\n\tcase, this Court is in full agreement with the reasons given and
\n\tfindings recorded by the trial Court while acquitting the respondent\n<\/p>\n
\t– accused and adopting the said reasons and for the reasons
\n\taforesaid, in my view, the impugned Judgment is just, legal and
\n\tproper and requires no interference by this Court at this stage.
\n\tHence, this Appeal requires to be dismissed.\n<\/p>\n
In
\n\tthe result, the Appeal is hereby dismissed. The impugned Judgment
\n\tand order dated 9.4.2010 passed by the learned 4th
\n\tAdditional Chief Judicial Magistrate, Godhra in Criminal Case
\n\tNo.1115 of 1998, acquitting the respondent – accused, is
\n\thereby confirmed.\n<\/p>\n
