Justice M.SASIDHARAN NAMBIAR\n\n Dated :07\/09\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.3520 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner was the fifth accused in Crime Nos.<\/p>\n<p>239\/CR\/01    and    95\/CR\/92    of    CBCID    CFS,<\/p>\n<p>Thiruvananthapuram, registered   for  the  offences<\/p>\n<p>under Sections 120B and 489B and C read with<\/p>\n<p>Section 34 of Indian Penal Code. Final report<\/p>\n<p>submitted under Section 173(2) of Code of Criminal<\/p>\n<p>Procedure was taken cognizance as S.C.No.501\/2006.<\/p>\n<p>As petitioner failed to appear subsequently and the<\/p>\n<p>sureties failed to produce him, bail granted to the<\/p>\n<p>petitioner  was  cancelled  and  proceedings   were<\/p>\n<p>initiated under Section 446 of Code of Criminal<\/p>\n<p>Procedure and penalty was imposed on the sureties.<\/p>\n<p>The case against the petitioner was split up.<\/p>\n<p>Later, petitioner appeared and the case was re-<\/p>\n<p>filed as S.C.No.582\/2009. Petitioner was released<\/p>\n<p>on bail. Again, petitioner failed to appear and<\/p>\n<p>when the sureties were directed to produce the<\/p>\n<p><span class=\"hidden_text\">CRMC 3520\/10              2<\/span><\/p>\n<p>petitioner, he filed an application along with the<\/p>\n<p>medical certificate. Public Prosecutor objected to<\/p>\n<p>the application, disputing the medical certificate.<\/p>\n<p>Learned Sessions Judge issued summons to the Doctor<\/p>\n<p>and examined the Doctor, who gave evidence that<\/p>\n<p>signature of the person, who approached for the<\/p>\n<p>medical     certificate, is   different  from   the<\/p>\n<p>signature shown in the vakalath. Learned Sessions<\/p>\n<p>Judge reported that the person, who appeared before<\/p>\n<p>the doctor to obtain the medical certificate, is<\/p>\n<p>not   the    petitioner. Learned   Sessions  Judge,<\/p>\n<p>thereafter,    cancelled the bail  and  issued  non<\/p>\n<p>bailable warrant. This petition is filed under<\/p>\n<p>Section 482 of Code of Criminal Procedure to direct<\/p>\n<p>the Sessions Judge to release the petitioner on<\/p>\n<p>bail on his surrender and moving an application for<\/p>\n<p>bail.\n<\/p>\n<p>    2. As it was represented that 12 witnesses were<\/p>\n<p>examined in S.C.No.501\/2006 and trial of S.C.No.<\/p>\n<p>582\/2009    was  directed with S.C.No.501\/2006  and<\/p>\n<p><span class=\"hidden_text\">CRMC 3520\/10             3<\/span><\/p>\n<p>petitioner is being asked to cross-examine the<\/p>\n<p>witnesses from PW12 onwards, a report was called<\/p>\n<p>for from the learned Sessions Judge as to how many<\/p>\n<p>witnesses    have already been  examined  for   the<\/p>\n<p>prosecution in S.C.No.501\/2006, has the trial in<\/p>\n<p>S.C.No.582\/2009 been started and if so, what is the<\/p>\n<p>stage and if 11 prosecution witnesses were examined<\/p>\n<p>in S.C.No.501\/2006, how could S.C.No.582\/2009 be<\/p>\n<p>posted along with S.C.No.501\/2006. Report of the<\/p>\n<p>learned Sessions Judge shows that S.C.No.582\/2009<\/p>\n<p><span class=\"hidden_text\">is the split up case of S.C.No.501\/2006 and 9<\/span><\/p>\n<p>witnesses were examined in S.C.No.501\/2006 and as<\/p>\n<p>petitioner appeared, trial was stopped and S.C.No.<\/p>\n<p>501\/2006 is rescheduled. Learned Sessions Judge<\/p>\n<p>reported that it was in view of the evidence of the<\/p>\n<p>doctor, non bailable warrant was issued to the<\/p>\n<p>petitioner.\n<\/p>\n<p>    3. If trial of S.C.No.501\/2006 was commenced<\/p>\n<p>and some of the witnesses were already examined,<\/p>\n<p>S.C.No.582\/2009 cannot be tried along with S.C.No.<\/p>\n<p><span class=\"hidden_text\">CRMC 3520\/10             4<\/span><\/p>\n<p>501\/2006, unless all the witnesses already examined<\/p>\n<p>are   again  examined  in  the   presence  of   the<\/p>\n<p>petitioner. I do not find that learned Sessions<\/p>\n<p>Judge would insist the petitioner to cross-examine<\/p>\n<p>the  witnesses  from  PW12  onwards  as  has   been<\/p>\n<p>represented. The report of the learned Sessions<\/p>\n<p>Judge shows that petitioner failed to appear, even<\/p>\n<p>though he was released on bail after proceedings<\/p>\n<p>were   initiated under  Section  446  of  Code   of<\/p>\n<p>Criminal Procedure and penalty was imposed on the<\/p>\n<p>sureties. In such circumstances, I do not find that<\/p>\n<p>a direction is to be issued to the Sessions Judge<\/p>\n<p>to release the petitioner on bail as sought for. It<\/p>\n<p>is up to the learned Sessions Judge to consider the<\/p>\n<p>application for bail as and when petitioner appears<\/p>\n<p>and pass appropriate order in accordance with law.<\/p>\n<p>It is also made clear that if presence of the<\/p>\n<p>petitioner is procured and S.C.No.582\/2009 is to be<\/p>\n<p>tried with S.C.No.501\/2006, learned Sessions Judge<\/p>\n<p>must recall all the witnesses so far examined and<\/p>\n<p><span class=\"hidden_text\">CRMC 3520\/10              5<\/span><\/p>\n<p>examine them in the presence of the petitioner<\/p>\n<p>granting liberty to cross-examine them.
