Karanjawala, adv.,<br \/>\n     Ms. Nandini Gre, Ms. Seema Sapra,<br \/>\n     Mrs. Manik Karanjawala, adv.,<br \/>\nFor Respondent (s)<br \/>\n     Upon hearing counsel the Court made the following<br \/>\n\t\t\t O R D E R<br \/>\n     Mr. Arun  Jaitely, learned senior counsel appearing for<br \/>\nthe petitioner\thas drawn  our attention  to a\tjudgement of<br \/>\nthis court in Dresser Rand, S.A. Vs. K.G. Khosla Compressors<br \/>\nLtd. &amp;\tOrs (1995  Supp. (3)  SCC 181) and in particular, to<br \/>\nparagraph 2, which reads thus:\n<\/p>\n<blockquote><p>     &#8220;2. In  a\tmatter\tof  this  nature<br \/>\n     where question  of amenability of a<br \/>\n     dispute to internatinal arbitration<br \/>\n     arise it is not proper to let loose<br \/>\n     and  keep\t at  large   orders   of<br \/>\n     injuction of  this kind  for unduly<br \/>\n     long periods.  It\tis  inconsistent<br \/>\n     with   the\t  principles   governing<br \/>\n     international arbitration. It is of<br \/>\n     utmost importance\tfor the domestic<br \/>\n     courts   to   be\tcircumspect   in<br \/>\n     granting\t  such\t   interlocutory<br \/>\n     interdictions.  At\t any  rate,  the<br \/>\n     court  must   ensure  that\t  the  a<br \/>\n     matters are dealt with and disposed<br \/>\n     of with utmost despatch. &#8220;<\/p><\/blockquote>\n<p>     After hearing  Mr. Jaitely\t and perusing the record, we<br \/>\nare of\tthe opinion  that the issue relating to the vacation<br \/>\nor continuance of the stay order, which had been obtained by<br \/>\nthe respondent in Suit N. 3737\/91, as early as in 29.11.1991<br \/>\nand  is\t  still\t in   peratin\trequires   to\tbe   settled<br \/>\nexpeditiously. The  issue has  not been disposed of although<br \/>\nalmost seven  years have  elapsed.  In\tthe  nature  of\t the<br \/>\ndispute\t pending   before  the\t Court,\t issue\trelating  to<br \/>\ninterlocutory interdictions  need to  be  disposed  of\twith<br \/>\nutmost despatch.\n<\/p>\n<p>     While not\tbeing inclined\tto interfere  with an  order<br \/>\nadjourning  the\t  decisin  of\tissue  in  excersie  of\t our<br \/>\njurisdication under  Article  136  of  the  Constitution  of<br \/>\nIndia, we,  however, consider  it appropriate to request the<br \/>\nHigh Court to dispose of the issue concering the vacation or<br \/>\notherwise of  the injunction  expeditiously and\t as  far  as<br \/>\npossible before 31.12.1998.\n<\/p>\n<p>     With these\t observatins, the  special leave petition is<br \/>\ndisposed of.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Valvue Armaturen V.U.
