And Others\nPetitioner Counsel :- Ravi Shanker Mishra\nRespondent Counsel :- C.S.C.\n\nHon'ble Sanjay Misra,J.\n<\/pre>\n<p>Heard Sri Ravi Shanker Mishra, learned counsel for the petitioner<br \/>\nand learned Standing Counsel for the respondents.\n<\/p>\n<p>Counter and rejoinder affidavits have been exchanged between the<br \/>\nparties and this writ petition is being decided finally at this stage<br \/>\nitself.\n<\/p>\n<p>The petitioner claims to have submitted the form for admission to<br \/>\nBTC 2004 and to have received a letter from respondent no. 3,<br \/>\nPrincipal, D.I.E.T., Chitrakoot for submitting the original<br \/>\ncertificates since the petitioner claims to have obtained necessary<br \/>\nquality point marks for being granted admission. According to the<br \/>\npetitioner earlier when her candidature was not considered, she<br \/>\nhad filed a Writ Petition No. 32352 of 2009 (Km. Madhulika Vs.<br \/>\nState of U.P. &amp; others) and this Court by the order dated 3.7.2009,<br \/>\ndirected the Principal, D.I.E.T to examine the claim of the<br \/>\npetitioner and take a decision thereupon in accordance with law.<br \/>\nLearned counsel states that by virtue of the aforesaid direction the<br \/>\nimpugned order dated 14.9.2009 has been passed by the Principal,<br \/>\nD.I.E.T. granting admission to the petitioner in BTC 2004 in the<br \/>\nArt category. The grievance raised in this writ petition is that the<br \/>\npetitioner ought to have been granted admission in the BTC, 2004<br \/>\nScience category.\n<\/p>\n<p>The basis for challenge of the aforesaid decision is that the<br \/>\npetitioner has passed B.Sc. (ITA) with the subject of science<br \/>\nnamely Physics and Mathematics as also Electricity &amp; Magnetism<br \/>\nand therefore, she was a candidate for BTC Science and had also<br \/>\npassed High School and Intermediate with science subjects.\n<\/p>\n<p>Learned Standing Counsel on the other hand has referred to<br \/>\nparagraph 2 (C) of the counter affidavit and submits that a<br \/>\nclarification was sought by the Principal from the Director<br \/>\nS.C.E.R.T., Lucknow and in reply he was informed by the letter<br \/>\ndated 24.6.2009 that if a candidate has passed B.Sc. (ITA) with the<br \/>\n subjects of Physics, Chemistry, Mathematics and Biology, he<br \/>\nwould be considered as a candidate for admission to BTC Science.<br \/>\nLearned Standing Counsel has also referred to the aforesaid letter<br \/>\ndated 24.6.2009 filed as Annexure-3 to the counter affidavit. He<br \/>\nstates that when the petitioner was not having the subjects of<br \/>\nPhysics, Chemistry, Mathematics and Biology in B.Sc. (ITA)<br \/>\ncourse, she could not be considered as a candidate for admission in<br \/>\nBTC Science and hence the learned Standing Counsel has justified<br \/>\nthe impugned order dated 14.9.2009.\n<\/p>\n<p>Having considered the submissions of learned counsel for the<br \/>\nparties and perused the record, it appears that the petitioner had<br \/>\npassed High School and Intermediate examination with science<br \/>\nsubjects namely Mathematics, Science-2, Physics and Chemistry.<br \/>\nIn the Course of B.Sc. (ITA), the petitioner has passed foundation<br \/>\ncourse on Physics and foundation course on Mathematics<br \/>\nalongwith Electricity &amp; Magnetism as subject and therefore, her<br \/>\nclaim is for admission to BTC Science.\n<\/p>\n<p>From the record, the requirement of having Physics, Chemistry,<br \/>\nMathematics and Biology does not appear to be satisfied in case all<br \/>\nthe four science subjects are required to be in the course of B.Sc<br \/>\n(ITA) inasmuch as the petitioner admittedly did not have<br \/>\nChemistry and Biology as subject in B.Sc. (ITA). However, the<br \/>\ngrievance raised by the petitioner requires consideration inasmuch<br \/>\nas the instruction dated 24.6.2009 does not clarify as to whether a<br \/>\ncandidate must have all the four science subjects in B.Sc. (ITA)<br \/>\ncourse or having two science subject in the B.Sc. would suffice for<br \/>\nadmission in BTC science. Such decision can be taken by the<br \/>\nauthority which has issued the instruction on 24.6.2009 by giving<br \/>\nclarification on that account. This Court would therefore, not<br \/>\ninterpret the instruction dated 24.6.2009 and it is appropriate to<br \/>\nleave it to be decided by the competent authority.\n<\/p>\n<p>Learned counsel for the petitioner is permitted to implead the<br \/>\nDirector, S.C.E.R.T., Lucknow as respondent no.5 for whom<br \/>\nlearned Standing Counsel has appeared.\n<\/p>\n<p>In view of the aforesaid circumstances, it would be appropriate<br \/>\nthat the petitioner should file a certified copy of this order before<br \/>\nthe respondent no.5 within a period of two weeks from today and<br \/>\nupon the said being filed, the respondent no. 5 is required to take a<br \/>\ndecision as referred to above on the instruction issued by him on<br \/>\n24.6.2009 by clarifying whether admission to BTC science would<br \/>\nrequire a candidate to pass all the four science subjects or pass<br \/>\nonly two science subject in B.Sc. (ITA) which would suffice for<br \/>\n admission in BTC science.\n<\/p>\n<p>It is made clear that this Court has not expressed its opinion on the<br \/>\ninterpretation of instruction dated 24.6.2009 and that has to be<br \/>\ndone by the respondent no.5.\n<\/p>\n<p>Incase the respondent no.5 finds that the petitioner is qualified for<br \/>\nadmission to BTC Science, suitable action be taken by him<br \/>\nforthwith within two weeks thereafter.\n<\/p>\n<p>The petitioner will file a self addressed, registered post duly<br \/>\nstamped envelop before the respondent no.5 alongwith a certified<br \/>\ncopy of this order for communication of his decision to the<br \/>\npetitioner.\n<\/p>\n<p>The writ petition stands disposed of finally.\n<\/p>\n<p>No order is passed as to costs.\n<\/p>\n<p>Order Date :- 5.7.2010<br \/>\nLbm\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Km.
