           The appeal is preferred by the Government and<\/p>\n
the memorandum of Cross Objection is instituted by the<\/p>\n
claimants.   The lands under acquisition were situated in<\/p>\n
Kavilumpara village of Kozhikode Taluk. The acquisition was<\/p>\n
for the purposes of Kavilumpara Grama Panchayat pursuant<\/p>\n
to Section 4(1) notification published on 04.6.2002.    The<\/p>\n
purpose of the acquisition was for the construction of a bus<\/p>\n
stand for the Panchayat. The Land Acquisition Officer fixed<\/p>\n
land value at Rs.3,684\/- per cent. The Reference Court under<\/p>\n
the impugned judgment, on the basis of the evidence which<\/p>\n
came on record, re-fixed the land value at Rs.20,000\/- per<\/p>\n
cent. In the appeal preferred by the Government, the above<\/p>\n
re-fixation is challenged as highly excessive, while in the<\/p>\n
memorandum of Cross Objection preferred by the claimant it<\/p>\n
is urged that the land value re-fixed by the court is<\/p>\n
inadequate.\n<\/p>\n

\n                                2<\/span><\/p>\n
      2.    The memorandum of Cross Objection raised two<\/p>\n
important claims. The first claim is that the claimants should<\/p>\n
have been awarded compensation for injurious affection of<\/p>\n
the unacquired property of the claimant which extends to<\/p>\n
below 25 cents of land. It is contended that the unacquired<\/p>\n
portion is L-shaped property having a width of 3 metres and<\/p>\n
hence cannot be utilised for putting up buildings. The other<\/p>\n
claim which is urged through the memorandum of Cross<\/p>\n
Objection is that neither the LA Officer nor the court below<\/p>\n
awarded any compensation for the compound wall which<\/p>\n
existed on the property under acquisition. The contention is<\/p>\n
that for the compound wall the court below should have<\/p>\n
awarded the amount recommended by the Advocate<\/p>\n
Commissioner on the basis of an inspection conducted by<\/p>\n
her.\n<\/p>\n
      3.    Sri. V.N. Ramesan Nambisan, learned counsel for<\/p>\n
the cross objector, Sri.C. Jayachandran, learned counsel for<\/p>\n
the requisitioning authority, and Sri. Basant Balaji, learned<\/p>\n
senior Government Pleader for the Government addressed us<\/p>\n
in detail.   Mr. Ramesan Nambisan drew our attention to<\/p>\n
Ext.X1 commission report and X2 plan submitted by the<\/p>\n
commissioner.      According to him, adequate compensation<\/p>\n

should have been awarded for the injurious affection of the<\/p>\n
remainder property, the extent of which was approximately<\/p>\n
25 cents.       He referred to the commission report and<\/p>\n
submitted that no reason has been assigned by the court<\/p>\n
below for declining compensation for the substantial<\/p>\n
compound walls which existed on the property under<\/p>\n
acquisition.     Mr. Nambisan would lastly submit that the<\/p>\n
claimant will have to be satisfied with the land value of the<\/p>\n
25 cents re-fixed under the impugned judgment.            The<\/p>\n
submissions of Mr. Nambisan were resisted by Mr.<\/p>\n
Jayachandran, counsel for the requisitioning authority. Mr.<\/p>\n
Jayachandran was supported in all his submissions by the<\/p>\n
learned senior Government Pleader.        According to Mr.<\/p>\n
Jayachandran, certain documents have been produced by the<\/p>\n
Panchayat in this appeal and those documents will reveal<\/p>\n
that even after the acquisition, market value of the land in<\/p>\n
the locality remained far lesser than the rate presently fixed<\/p>\n
under the impugned judgment. He justified the action of the<\/p>\n
court below in declining any compensation for injurious<\/p>\n
affection of the remainder property. According to him, the<\/p>\n
commission report was not acceptable regarding the value of<\/p>\n
the compound walls and hence in the absence of evidence no<\/p>\n

compensation could have been awarded for the compound<\/p>\n
walls. Mr. Jayachandran requested that the matter may go<\/p>\n
back to the reference court so that documents produced in<\/p>\n
this court can be produced by the requisitioning authority so<\/p>\n
that, the LAR court would be able to decide the question of<\/p>\n
correct market value payable for the property under<\/p>\n
acquisition.\n<\/p>\n
      4.    Having anxiously considered the rival submissions<\/p>\n
we are of the view that there is considerable merit in the<\/p>\n
submission of the learned counsel for the claimant\/cross<\/p>\n
objector that the claimant\/cross objector is entitled for<\/p>\n
compensation for injurious affection for the unacquired<\/p>\n
property which extends to 24 to 25 cents of land. Ext.X1<\/p>\n
commission report would clearly show that the remainder<\/p>\n
property has been reduced to two strips long in the form of<\/p>\n
‘L’ with a width of 3 metres only. We are of the view that the<\/p>\n
remainder property has been injuriously affected at least to<\/p>\n
the extent of 10%.        The same is the position regarding<\/p>\n
grievance     voiced    by  the  cross  objector    regarding<\/p>\n
compensation payable for the compound wall.             Some<\/p>\n
compensation should have been awarded for the walls which<\/p>\n
existed on the property under acquisition. The court below<\/p>\n

was not justified in declining any compensation for the wall.<\/p>\n
As for the market value of the land we are of the view that<\/p>\n
the said issue is to be reconsidered by the reference court<\/p>\n
giving liberty to both sides to produce whatever documents<\/p>\n
they want to including documents produced before this court<\/p>\n
by the Panchayat.\n<\/p>\n
      5.    The result of the above discussions is as follows:<\/p>\n
      The judgment and decree under appeal are set aside.<\/p>\n
LAR.4\/2005 is remanded to Subordinate Judge’s Court,<\/p>\n
Vadakara. That court is directed to permit all parties to<\/p>\n
adduce whatever further evidence they want to in the<\/p>\n
context of the various claims raised in the LAR including the<\/p>\n
claim for compensation for injurious affection and the claim<\/p>\n
for value of the compound wall and market value of the land.<\/p>\n
The learned Subordinate Judge is directed to complete the<\/p>\n
enquiry and pass revised judgment at the earliest and at any<\/p>\n
rate within four months of parties entering appearance<\/p>\n
before that court pursuant to this judgment.          Since the<\/p>\n
Panchayat is also desirous of an order of remand we are not<\/p>\n
inclined to impose any condition which will deprive the<\/p>\n
claimant of the benefit of receiving interest under Section<\/p>\n
28 of the Act. We are also not inclined to refuse refund of<\/p>\n

the court fee remitted on the memorandum of Cross<\/p>\n
Objection.     The entire court fee remitted on the Cross<\/p>\n
Objection will be refunded to Sri.Ramesan Nambisan,<\/p>\n
learned counsel for the cross objectors.\n<\/p>\n
      Appeal and Cross Objection are allowed. Parties will<\/p>\n
appear before the reference court on 22.3.2010.<\/p>\n
