Whether the judgment should be reported in the Digest?\n\n\n\nPRESENT:            Mr. Ajit Atri, Advocate,\n                    for the petitioner.\n                          ****\n\nRANJIT SINGH, J.\n<\/pre>\n<p>             A widow has filed this petition to seek relief of ex-gratia<\/p>\n<p>amount of Rs.five lacs under Haryana Compassionate Assistance to<\/p>\n<p>the Dependents of Deceased Government Employees Rules, 2005<\/p>\n<p>(for short &#8220;2005 Rules&#8221;)on account of death of her husband. She<\/p>\n<p>herself is in the employment of Government. Question, thus, to be<\/p>\n<p>seen is whether she would be entitled to seek this ex-gratia<\/p>\n<p>compassionate assistance under the Rules or not.<\/p>\n<p>             Husband of the petitioner, Giarsi Lal, was employed as a<\/p>\n<p>Class IV employee (Sweeper) in Police Department and was serving<\/p>\n<p>at Police Line, Narnaul. He died on 24.2.2006, statedly after serving<br \/>\n CIVIL WRIT PETITION NO.12436 OF 2009                     :{ 2 }:\n<\/p>\n<p>for about 54 years. The petitioner thereafter applied for job for her<\/p>\n<p>son under ex-gratia scheme and in the alternative she asked for ex-<\/p>\n<p>gratia assistance. The petitioner claims that she has made number of<\/p>\n<p>rounds to the office of Superintendent of Police, Narnaul and had<\/p>\n<p>even gone to the office of D.G.P., Haryana but has not got any<\/p>\n<p>satisfactory reply. On 18.5.2006, the petitioner gave a written<\/p>\n<p>application in the office of D.G.P. for grant of job under ex-gratia<\/p>\n<p>scheme to her son. Neither the job has been given to the son of the<\/p>\n<p>petitioner nor any ex-gratia benefit otherwise released in her favour.<\/p>\n<p>The petitioner then served a legal notice for providing job on<\/p>\n<p>compassionate ground or financial assistance, which has now been<\/p>\n<p>replied on 19.2.2009. The petitioner has now been informed that she<\/p>\n<p>is already employed with Municipal Council, Narnaul, and she, thus,<\/p>\n<p>is not entitled to grant of job under ex-gratia scheme, her total<\/p>\n<p>emoluments being 6987\/-. The petitioner has accordingly impugned<\/p>\n<p>this communication seeking direction for ex-gratia assistance of<\/p>\n<p>Rs.five lacs.\n<\/p>\n<p>            Learned counsel for the petitioner submits that the<\/p>\n<p>respondents ought to have paid the financial assistance to the<\/p>\n<p>petitioner as she would be entitled to the same in terms of Rule 4 of<\/p>\n<p>2005 Rules. The counsel would refer to the provisions of Rule 4(1),<\/p>\n<p>which makes a provision for preference of option to be furnished<\/p>\n<p>within six months from the date of death of the Government<\/p>\n<p>employee praying for either ex-gratia appointment on compassionate<\/p>\n<p>ground or alternatively ex-gratia financial assistance to the family of<\/p>\n<p>the deceased. The reading of this Rule would clearly show that ex-<\/p>\n<p>gratia appointment on compassionate grounds to a member of the<br \/>\n CIVIL WRIT PETITION NO.12436 OF 2009                      :{ 3 }:\n<\/p>\n<p>family is for one who was &#8220;completely dependent&#8221; on the deceased<\/p>\n<p>employee and is in extreme financial distress due to the loss of the<\/p>\n<p>deceased. Similar is the position for payment of ex-gratia financial<\/p>\n<p>assistance which is in alternative to the ex-gratia appointment on<\/p>\n<p>compassionate ground. The condition of extreme financial distress<\/p>\n<p>due to the loss of deceased would equally apply for ex-gratia<\/p>\n<p>compassionate financial assistance as is the requirement in case of<\/p>\n<p>ex-gratia appointment on compassionate ground. Analysis of Rule<\/p>\n<p>4.1 (a) and (b) would make it appear so, which is reproduced below:-<\/p>\n<blockquote><p>           &#8220;(a) ex-gratia appointment on compassionate grounds to<\/p>\n<p>           a member of the family who was &#8220;completely dependent&#8221;<\/p>\n<p>           on the deceased employee and is in extreme financial<\/p>\n<p>           distress due to the loss of the deceased, namely, the<\/p>\n<p>           Government employee who dies in &#8220;service&#8221;.<\/p>\n<\/blockquote>\n<blockquote><p>           (b)   ex-gratia compassionate financial assistance to the<\/p>\n<p>           family of the deceased, over and above, all other service<\/p>\n<p>           benefits like ex-gratia grant due to his\/her family, to be<\/p>\n<p>           paid @ Rs.5(five) lacs in case of the family of the<\/p>\n<p>           deceased Government employee was of the age of 55<\/p>\n<p>           years or above, on the date of death); if the Government<\/p>\n<p>           employee dies at the age of 55 years or thereafter, his<\/p>\n<p>           family shall not be eligible for ex-gratia appointment.&#8221;<\/p><\/blockquote>\n<p>           The key words are &#8220;is in extreme financial distress due to<\/p>\n<p>loss of the deceased.&#8221;\n<\/p>\n<p>           This aspect would further be clear from the contents of<\/p>\n<p>Rule 8, which regulates the criteria for eligibility under 2005 Rules.<\/p>\n<p>This Rule says that the eligibility under these Rules is when the<br \/>\n CIVIL WRIT PETITION NO.12436 OF 2009                      :{ 4 }:\n<\/p>\n<p>family is indigent and deserves immediate assistance for relief from<\/p>\n<p>financial destitution and dependent upon the deceased\/missing<\/p>\n<p>Government employee. Thus, relief from financial destitution of the<\/p>\n<p>dependents is the requirement and the underline aim being<\/p>\n<p>immediate assistance to the family, which is indigent. The Rule has<\/p>\n<p>further specified that the income of the family shall not exceed<\/p>\n<p>Rs.6,000\/- per month from all sources, other than family pension.<\/p>\n<p>Obviously, it means that if income is more than this amount, the<\/p>\n<p>family can not be taken to be indigent, which would deserve<\/p>\n<p>immediate assistance for relief from financial destitution.         Specific<\/p>\n<p>provision further is made in this Rule that where the spouse of the<\/p>\n<p>deceased\/missing Government employee is already in Government<\/p>\n<p>service, then no other dependent member shall be eligible for<\/p>\n<p>appointment or ex-gratia compassionate financial assistance.<\/p>\n<p>            In view of these specific provisions, there is hardly any<\/p>\n<p>scope left to interpret the Rules as sought by the petitioner to see her<\/p>\n<p>eligibility to receive this compassionate assistance. The submission<\/p>\n<p>made by the counsel that the criteria of income, as referred to in Rule<\/p>\n<p>8(b) is to be considered for the purpose of appointment and not for<\/p>\n<p>grant of ex-gratia compassionate financial assistance, if accepted,<\/p>\n<p>would certainly lead to doing violation to the provisions made in the<\/p>\n<p>Rule which is worded in unambiguous and simple language. The<\/p>\n<p>provisions of Rule 8(b) and Rule 8(d) would need to be read<\/p>\n<p>together. It is so very clearly provided that when spouse of a<\/p>\n<p>deceased Government employee is already in Government service,<\/p>\n<p>then no dependent member shall be eligible either for appointment or<\/p>\n<p>for ex-gratia     compassionate financial assistance. For ready<br \/>\n CIVIL WRIT PETITION NO.12436 OF 2009                       :{ 5 }:\n<\/p>\n<p>reference provisions of Rule 8 (a) to (d) are reproduced below:-<\/p>\n<blockquote><p>           &#8220;(a) The family is indigent and deserves immediate<\/p>\n<p>           assistance for relief from financial destitution and<\/p>\n<p>           dependent upon the deceased\/missing Government<\/p>\n<p>           employee.\n<\/p><\/blockquote>\n<blockquote><p>           (b)      The monthly income of the family shall not exceed<\/p>\n<p>           Rs.6000\/- per month, from all sources other than family<\/p>\n<p>           pension. For this purpose, the income of the entire family<\/p>\n<p>           of the deceased\/missing Government employee will be<\/p>\n<p>           taken into account and not just the income of the<\/p>\n<p>           dependent      who    has   applied    for   appointment   on<\/p>\n<p>           compassionate grounds.\n<\/p><\/blockquote>\n<blockquote><p>           (c )     The applicant for appointment should be eligible<\/p>\n<p>              and suitable for the post in all respects under the<\/p>\n<p>              provisions of the relevant requirement rules.<\/p>\n<\/blockquote>\n<blockquote><p>              (d)     Where     spouse    of     the    deceased\/missed<\/p>\n<p>              Government employee is already in Government<\/p>\n<p>              service, no other dependent member shall be eligible<\/p>\n<p>              for appointment or ex-gratia compassionate financial<\/p>\n<p>              assistance.&#8221;<\/p><\/blockquote>\n<p>           In fact, the submission made by the counsel for the<\/p>\n<p>petitioner would be against the very concept and the spirit behind the<\/p>\n<p>enactment of these Rules. The object of Rules, as can be seen from<\/p>\n<p>Rule 2, is to assist the family of the deceased\/missing Government<\/p>\n<p>employee in tiding over the emergency situation resulting from the<\/p>\n<p>loss of bread earner by giving either of the options of ex-gratia<\/p>\n<p>appointment or ex-gratia compassionate financial assistance to the<br \/>\n CIVIL WRIT PETITION NO.12436 OF 2009                      :{ 6 }:\n<\/p>\n<p>family. Once the spouse is in a Government service, the family would<\/p>\n<p>not be in any emergent need or situation, which would normally result<\/p>\n<p>from the loss of a bread earner as such a family would be having a<\/p>\n<p>member who is earning and, thus, the family could not be termed to<\/p>\n<p>be indigent which would deserve immediate assistance for any relief.<\/p>\n<p>Incidentally, it may need a notice that 2005 Rules have since been<\/p>\n<p>repealed on issuance of new Rules w.e.f 1.8.2006. The criteria as<\/p>\n<p>laid down in Rule 8 would clearly rule out the eligibility of the<\/p>\n<p>petitioner to receive this ex-gratia          compassionate financial<\/p>\n<p>assistance.
