By ad interim order, there shall be stay<br \/>\nagainst the execution and implementation of the award on the<br \/>\ncondition that the applicant-appellant deposits the entire awarded<br \/>\namount with costs and interest with the Tribunal qua its own<br \/>\nliability before the returnable date.&#8221;\n<\/p>\n<p>(3)\tThe<br \/>\nlearned counsel for the applicant states that the amount has been<br \/>\ndeposited and the condition has been complied with. Under the<br \/>\ncircumstances, ad-interim order shall stand confirmed.\n<\/p>\n<p>(4)\tThe<br \/>\nopponents-claimants were not served but vide order dated 23.06.2011<br \/>\npassed by this court in Civil Application No.5618 of 2011, service<br \/>\nwas permitted to be effected through public notice. Today, an<br \/>\naffidavit dated 28.07.2011 has been filed on behalf of the applicant<br \/>\nwherein it is stated that the public notice was published in &#8216;Gujarat<br \/>\nSamachar&#8217; daily newspaper, Kheda\/Anand edition on 19.07.2011 and in<br \/>\nVadodara edition on 20.07.2011. None has appeared on behalf of the<br \/>\nclaimants.\n<\/p>\n<p>(5)\tUnder<br \/>\nthe above circumstances, we have not considered the aspect of<br \/>\npermitting of withdrawal of the amount or otherwise at this stage but<br \/>\nit is directed that the amount deposited by the applicant shall be<br \/>\ninvested by the Tribunal in fixed deposit, initially for a period of<br \/>\n01 (one) year and such investment shall be renewed from time to time<br \/>\nuntil further orders. It is also observed that the original claimants<br \/>\nshall be at liberty to move appropriate application for withdrawal of<br \/>\nthe amount, as may be permissible in law.\n<\/p>\n<p>(6)\tThe<br \/>\napplicant is disposed of accordingly.
