A [WCC] No.209 of 2006\n                ------------------------------------------------\n              Dated this the 24th day of September, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>Koshy, J<\/p>\n<p>      The     first         respondent              in       this  appeal<\/p>\n<p>sustained serious injuries in a motor accident<\/p>\n<p>during the course of employment. He was a<\/p>\n<p>Tanker lorry driver and while driving the<\/p>\n<p>Tanker      lorry         the        accident             occurred.    He<\/p>\n<p>sustained       serious          injuries            and       he claimed<\/p>\n<p>compensation           before           the         Commissioner       of<\/p>\n<p>Workmen&#8217;s         Compensation.                  Ext.A11         is   the<\/p>\n<p>disability certificate produced by him wherein<\/p>\n<p>the loss of earning capacity is assessed at<\/p>\n<p>40%. The above certificate reads as follows:-<\/p>\n<blockquote><p>    &#8220;1. Persistent post traumatic head ache.<\/p>\n<blockquote><p>      2. Anosmia.\n<\/p><\/blockquote>\n<blockquote><p>      3. Vertigo.\n<\/p><\/blockquote>\n<blockquote><p>      4. Diplopia.\n<\/p><\/blockquote>\n<blockquote><p>      5. Partial ankylosis of left hip flexion and extension<br \/>\n         motion limited to an arc from 900 flexion to 1800<br \/>\n         line abduction and adduction limited to an arc from<\/p>\n<p><span class=\"hidden_text\">M. F. A [WCC] No.209 of 2006             -2-<\/span><\/p>\n<p>                250 abduction to 150 adduction, rotation motion<br \/>\n                limited to an arc from 150 internal rotation to 250<br \/>\n                external rotation.\n<\/p><\/blockquote>\n<blockquote><p>                Functionally he is having difficulty (a) to squatt<br \/>\n                property (b) to climb up and getting down steps (c)<br \/>\n                for correct vision (d) to differentiate smell (d) to<br \/>\n                concentrate.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>             2.     Another       certificate          was    issued    by<\/p>\n<p>      another         specialised          Doctor        vide       Ext.A12<\/p>\n<p>      wherein        the      Doctor       certified        that      first<\/p>\n<p>      respondent is unable to work as a driver. It<\/p>\n<p>      reads as follows:-\n<\/p><\/blockquote>\n<blockquote><p>                     &#8220;Traumatic     diplopia       following    RTA,<br \/>\n             extraocular muscle paresis, a vision of 6\/6 partial, right<br \/>\n             eye and 6\/6 left eye and now his corrected vision is 6\/6<br \/>\n             partial in right eye and 6\/6 in left eye and watering and<br \/>\n             irritation. Because of diplopia he will see objects in<br \/>\n             double and cannot work as driver.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>             3. Questioning these medical certificates<\/p>\n<p>      appellant\/Insurance Company filed application<\/p>\n<p>      to refer the first respondent to a competent<\/p>\n<p>      Medical Board. Accordingly, the Medical Board<\/p>\n<p>      constituted by the Government Medical College<\/p>\n<p>      Hospital examined the first respondent and<\/p>\n<p><span class=\"hidden_text\">M. F. A [WCC] No.209 of 2006       -3-<\/span><\/p>\n<p>      certified that there is 60% loss of earning<\/p>\n<p>      capacity. He has completed 42 years as per the<\/p>\n<p>      school       certificate.    Therefore, compensation<\/p>\n<p>      was calculated on the basis of the formula<\/p>\n<p>      mentioned in the Workmen&#8217;s Compensation Act<\/p>\n<p>      taking Rs.3,900\/- as the monthly income.<\/p>\n<\/blockquote>\n<blockquote><p>             4. This appeal is filed by the Insurance<\/p>\n<p>      Company on two grounds. First ground is that<\/p>\n<p>      the loss of earning capacity fixed is on the<\/p>\n<p>      higher side whereas the contention of the<\/p>\n<p>      claimant is that Doctors certified that in<\/p>\n<p>      view of the injury sustained he cannot work as<\/p>\n<p>      a driver and as far as he is concerned, his<\/p>\n<p>      loss     of     earning   capacity is  100%.  It is<\/p>\n<p>      further submitted that he was 42 years of age<\/p>\n<p>      at    the      time    of accident and it   will be<\/p>\n<p>      difficult for him to get any other job at this<\/p>\n<p>      point of time. Therefore, he should have been<\/p>\n<p>      granted 100% loss of earning capacity. But he<\/p>\n<p><span class=\"hidden_text\">M. F. A [WCC] No.209 of 2006        -4-<\/span><\/p>\n<p>      did not file any appeal due to financial<\/p>\n<p>      constraints. The appellant\/Insurance Company<\/p>\n<p>      filed application for assessing the loss of<\/p>\n<p>      earning capacity by a competent Medical Board<\/p>\n<p>      constituted by the Government Medical College,<\/p>\n<p>      Hospital, Thrissur and at the request of the<\/p>\n<p>      appellant, he was referred and the Medical<\/p>\n<p>      Board consisting of specialised Doctors of the<\/p>\n<p>      Government Medical College Hospital, Thrissur<\/p>\n<p>      forwarded the certificate assessing loss of<\/p>\n<p>      earning capacity to this Court. They certified<\/p>\n<p>      60% loss of earning capacity.\n<\/p><\/blockquote>\n<blockquote><p>             5.     Under     Section  4(1)(c)(ii)  of   the<\/p>\n<p>      Workmen&#8217;s Compensation Act, in the case of<\/p>\n<p>      nonscheduled          injuries,  the  Commissioner  is<\/p>\n<p>      bound to assess the loss of earning capacity<\/p>\n<p>      as      certified        by   a    competent   Medical<\/p>\n<p>      Practitioner.           Here,    the  Medical    Board<\/p>\n<p>      certified 60% loss of earning capacity. In any<\/p>\n<p><span class=\"hidden_text\">M. F. A [WCC] No.209 of 2006       -5-<\/span><\/p>\n<p>      event, awarding of compensation for 60% loss<\/p>\n<p>      of earning capacity based on Medical Board&#8217;s<\/p>\n<p>      assessment accepted by the Commissioner cannot<\/p>\n<p>      be set aside in an appeal proceedings.<\/p>\n<\/blockquote>\n<blockquote><p>             6. It is contended that Rs.3,900\/- fixed<\/p>\n<p>      as monthly income is on the higher side.<\/p>\n<p>      Injured was a Tanker lorry driver. He had a<\/p>\n<p>      heavy driving licence. It is his case that in<\/p>\n<p>      2001 a Tanker lorry driver would get more than<\/p>\n<p>      Rs.4,000\/- per month, but at the time of<\/p>\n<p>      accident, maximum wages that can be calculated<\/p>\n<p>      for     the     purpose    of compensation was  only<\/p>\n<p>      Rs.4,000\/-. Therefore, he claimed compensation<\/p>\n<p>      on the basis of monthly wages of Rs.4,000\/-.<\/p>\n<p>      In fact, the Commissioner ought to have fixed<\/p>\n<p>      Rs.4,000\/-          as  the monthly income.  In  any<\/p>\n<p>      event, it cannot be stated that Rs.3,900\/-<\/p>\n<p>      fixed       as       monthly income  for  a   Tanker<\/p>\n<p>      Lorry       driver      in  2001  is  excessive.  In<\/p>\n<p><span class=\"hidden_text\">M. F. A [WCC] No.209 of 2006    -6-<\/span><\/p>\n<p>      these circumstances, we see no ground in the<\/p>\n<p>      appeal. There is no substantial question of<\/p>\n<p>      law involved so as to maintain an appeal under<\/p>\n<p>      Section 30 of the Workmen&#8217;s Compensation Act.<\/p>\n<p>      Appeal fails and is dismissed accordingly.<\/p>\n<\/blockquote>\n<blockquote><p>                                              J.
