Justice M.C.HARI RANI\n\n Dated :30\/05\/2008\n\n O R D E R\n        K.BALAKRISHNAN NAIR &amp; M.C.HARI RANI JJ.\n        -----------------------------------------------------\n                       R.P.NO.818 OF 2004\n                                 IN\n                   W.P.(C)No.28650 OF 2004\n           -----------------------------------------------------\n           DATED THIS THE 30th DAY OF MAY, 2008\n\n                            O R D E R\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>     The petitioner prays for review of the judgment on the<\/p>\n<p>ground that this Court proceeded on the assumption that the<\/p>\n<p>respondents have filed a counter affidavit and they have raised a<\/p>\n<p>contention therein that there were not sufficient number of<\/p>\n<p>vacancies available for considering the petitioner who is a<\/p>\n<p>Preventive Officer for promotion to the post of Superintendent<\/p>\n<p>(Customs).    The petitioner points out that in fact no counter<\/p>\n<p>affidavit was filed and therefore the respondents could not have<\/p>\n<p>taken any defence that there were not sufficient number of<\/p>\n<p>vacancies to consider the petitioner for promotion.<\/p>\n<p>     2.    We notice that in this writ petition no counter affidavit<\/p>\n<p>was filed by the respondents. Therefore the assumption made by<\/p>\n<p>this Court that the respondents have filed a counter affidavit is<\/p>\n<p>wrong. It is an error apparent on the face of the record. We feel<\/p>\n<p><span class=\"hidden_text\">R.P.NO.818 OF 2004              -2-<\/span><\/p>\n<p>that the case of the petitioner should be considered after the<\/p>\n<p>respondents filed a counter affidavit in the writ petition. Accordingly,<\/p>\n<p>the judgment under review is recalled.
