Since the  appeal\ndid  not come up for hearing for a long time, the  appellant\npreferred  another  application\t for  bail.   Allowing\t the\napplication, the Court,\nHELD  :\t No  practice  howsoever  sanctified  by  usage\t and\nhallowed by time can be allowed to prevail if it operates to\ncause injustice.  Every practice of the court must find\t its\nultimate  justification\t in the interest  of  justice.\t The\npractice  not  to  release on bail a  person  who  has\tbeen\nsentenced to life imprisonment was evolved on the basis that\nonce  a person has been found guilty and sentenced  to\tlife\nimprisonment,  he  should not be let loose so  long  as\t his\nconviction   and  sentence  are\t not  set  aside;  but\t the\nunderlying postulate of this practice was that the appeal of\nsuch  person  would  be\t disposed  of  within  a  measurable\ndistance  of  time so that if he is ultimately found  to  be\ninnocent, he would not have to remain in jail for an  unduly\nlong  period.\tThe rationale of this practice can  have  no\napplication where the court is not in a position to  dispose\nof the appeal for five or six years.  It would, indeed, be a\ntravesty of justice to keep a person in jail for a period of\nfive  or six years for an offence which is ultimately  found\nnot to have been committed by him.  So long as this court is\nnot in a position to hear the appeal of an accused within  a\nreasonable  period  of time, the  court\t should\t ordinarily,\nunless\tthere  are  cogent  grounds  for  acting  otherwise,\nrelease the accused on bail in cases where special leave has\nbeen granted to the accused to appeal against his conviction\nand sentence.\nIn  the\t instant  case, the very fact that  this  court\t has\ngranted to the appellant special leave to appeal against his\nconviction shows that, in the opinion of this court, he has,\nprima  facie,  a good case to consider and  in\tthe  circum-\nstances,  namely,  that he has been in jail  and  the  total\nperiod he has spent in jail so far is about 4-1\/2 years,  it\nwould  be  highly unjust to detain him in  jail\t any  longer\nduring\tthe hearing of the appeal and he should be  released\non bail. Sharma for the Respondent.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nBHAGWATI.   J.,-This is an application for bail pending\t the<br \/>\nhearing of an appeal by special leave.\t       The appellant<br \/>\nwas convicted by<br \/>\n<span class=\"hidden_text\">386<\/span><br \/>\nthe  Sessions Court for an offence under section 323 of\t the<br \/>\nIndian\tPenal  Code  and sentenced  to\tsuffer\tsix  months&#8217;<br \/>\nrigorous imprisonment.\tThere was also a charge against\t the<br \/>\nappellant  for\tan offence under section 302 of\t the  Indian<br \/>\nPenal  Code  but he was acquitted of that  offence  by,\t the<br \/>\nSessions  Court\t and  hence the State  preferred  an  appeal<br \/>\nagainst\t the  order of acquittal to the\t High  Court.\tThis<br \/>\nappeal was allowed and the High Court set aside the order of<br \/>\nacquittal  and convicted the appellant of the offence  under<br \/>\nsection\t 302  and sentenced him to suffer  imprisonment\t for<br \/>\nlife.\tThe appellant, thereupon, preferred a  petition\t for<br \/>\nspecial leave to appeal to this Court and special leave\t was<br \/>\ngranted\t to,  him on 28th February,  1974.   The,  appellant<br \/>\nfiled  an  application for bail pending the hearing  of\t the<br \/>\nappeal,\t but the application was dismissed on 10th  January,<br \/>\n1975.\tSince  the appeal did not reach hearing for  a\tlong<br \/>\ntime,  the appellant preferred another application for\tbail<br \/>\nand that is the application which is now being disposed\t &#8216;of<br \/>\nby this judgment.\n<\/p>\n<p>The appellant contends in this application that pending\t the<br \/>\nhearing\t of the appeal he should be released on bail.\tNow,<br \/>\nthe  practice  in  this Court as also in many  of  the\tHigh<br \/>\nCourts has been not to release on bail a person who has been<br \/>\nsentenced to life imprisonment for an offence under  section<br \/>\n302 of the Indian penal Code.  The question is whether\tthis<br \/>\npractice  should  be departed from and if so, in  what\tcir-<br \/>\ncumstances.   It  is  obvious  that  no\t practice  howsoever<br \/>\nsanctified  by usage and hallowed by time can be allowed  to<br \/>\nprevail if it operates to cause injustice. Every  practice<br \/>\nof  the\t Court\tmust  find  its\t ultimate  justification  in<br \/>\nthe interest of justice,. bail a person whohas\t      been<br \/>\nsentenced  to  life  imprisonment was evolved  in  the\tHigh<br \/>\nCourts and in this Court on the basis that once a person has<br \/>\nbeen  found  guilty and sentenced to life  imprisonment,  he<br \/>\nshould\tnot  be\t let loose, so long as\this  conviction\t and<br \/>\nsentence are not set aside, but the underlying postulate  of<br \/>\nthis  practice was that the appeal of such person  would  be<br \/>\ndisposed of within a measurable distance of time, so that if<br \/>\nhe is ultimately found to be innocent, be would not have  to<br \/>\nremain in jail for an unduly long period.  The rationale  of<br \/>\nthis practice can have no application where the Court is not<br \/>\nin  a  position\t to dispose of the appeal for  five  or\t six<br \/>\nyears.\t It would indeed be a travesty of justice to keep  a<br \/>\nperson\tin  jail for a period of five or six  years  for  an<br \/>\noffence which is ultimates found not to have been  committed<br \/>\nby  him.   Can\tthe  Court  ever  compensate  him  for\t his<br \/>\nincarceration  which is found to unjustified ?\tWould it  be<br \/>\njust  at  all  for the Court to tell a\tperson\t:  &#8220;We\thave<br \/>\nadmitted your appeal because we think you have a prima facie<br \/>\ncase, but unfortunately we have no time to hear your  appeal<br \/>\nfor  quite a few years and, therefore, ,until we  hear\tyour<br \/>\nappeal,\t you  must remain in jail, even though\tyou  may  be<br \/>\ninnocent  ?&#8221;  What confidence would such  administration  of<br \/>\njustice\t inspire  in the mind of the public ? It  may  quite<br \/>\nconceivably  happen,  and it has in fact happened in  a\t few<br \/>\ncases  in this Court, that a person may serve out  his\tfull<br \/>\nterm  of  imprisonment\tbefore his appeal is  taken  up\t for<br \/>\nhearing.  Would a judge not be overwhelmed with a feeling of<br \/>\ncontrition while acquitting such a person after hearing\t the<br \/>\nappeal ? Would it not be an affront to his sense of  justice<br \/>\n? Of what avail would the acquittal be to such a person\t who<br \/>\nhas already served out his term of impri-\n<\/p>\n<p><span class=\"hidden_text\">387<\/span><\/p>\n<p>sonment\t or  at\t any  rate a major part\t of  it\t ?   It\t is,<br \/>\ntherefore, absolutely essential that the practice which this<br \/>\nCourt  has been following in the past must  be\treconsidered<br \/>\nand  so long as this Court is not in a position to hear\t the<br \/>\nappeal\tof an accused within a reasonable period  of time,<br \/>\nthe Court should ordinarily, unless there are cogent grounds<br \/>\nfor  acting otherwise, release the accused on bail in  cases<br \/>\nwhere  special\tleave  has been granted to  the\t accused  to<br \/>\nappeal against his conviction and- sentence.<br \/>\nHere  in the present case, the appellant, after serving\t out<br \/>\nthe  sentence &#8216;of six months&#8217; rigorous imprisonment for\t the<br \/>\noffence\t under section 323 imposed upon him by the  Sessions<br \/>\nCourt,\twas  on bail throughout the duration of\t the  appeal<br \/>\nbefore the, High Court and since the appeal was allowed\t and<br \/>\nhe  was\t convicted  for the offence under  section  302\t and<br \/>\nsentenced  to  life  imprisonment,  he\tsurrendered   before<br \/>\npresenting his petition for special leave to appeal to\tthis<br \/>\nCourt.\t Since then, the appellant has been in jail and\t the<br \/>\ntotal period he has spent in jail so far is about four and a<br \/>\nhalf years.  The appeal is of 1974 ;and it is not likely  to<br \/>\ncome  up for hearing for at least another two  years  since.<br \/>\nthis  Court is at present hearing appeals preferred  in\t the<br \/>\nyear 1972.The  very fact that this Court has granted to<br \/>\nthe appellant specialleave     to  appeal  against   his<br \/>\nconviction shows that, in the opinion of thisCourt,  he<br \/>\nhas  prima  facie  a  good, case  to  consider\tand  in\t the<br \/>\ncircumstances  it  would be highly unjust to detain  him  in<br \/>\njail any longer during the bearing of the appeal.<br \/>\nWe, therefore, direct that the appellant be released on bail<br \/>\nto  the\t satisfaction  of  the\tChief  Judicial\t Magistrate,<br \/>\nPatiala.
