The        sole     petitioner,    who      was<\/p>\n<p>                   complainant     before       the   court   below,    has<\/p>\n<p>                   approached this Court with a prayer to direct<\/p>\n<p>                   the learned Judicial Magistrate, Ist Class,<\/p>\n<p>                   Gopalganj to take cognizance for the offence<\/p>\n<p>                   under   Sections      406,    498A,   494\/34    of   the<\/p>\n<p>                   Indian Penal Code. It has not been disputed<\/p>\n<p>                   that learned Magistrate has taken cognizance<\/p>\n<p>                   of offence under Section 323 of the Indian<\/p>\n<p>                   Penal Code. In this case, earlier complaint<\/p>\n<p>                   was   filed    by    the   sole    petitioner   against<\/p>\n<p>                   opposite party nos.3 to 8 for an allegation<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>of commission of offence under Sections 406,<\/p>\n<p>379, 498A, 494\/34 of the Indian Penal code.<\/p>\n<p>           The    only       grievance,        which     has    been<\/p>\n<p>raised    by     Shri       Ram    Chandra      Singh,    learned<\/p>\n<p>counsel for the petitioner is that despite<\/p>\n<p>the fact that there were sufficient materials<\/p>\n<p>before the learned Magistrate, he had taken<\/p>\n<p>cognizance of offence only under Section 323<\/p>\n<p>of the Indian Penal Code. It has been alleged<\/p>\n<p>that the learned Magistrate was required to<\/p>\n<p>take   cognizance           for        other   offences,       which<\/p>\n<p>were alleged in the complaint petition.<\/p>\n<p>           Shri Chandrakant, learned counsel has<\/p>\n<p>appeared on behalf of some of the opposite<\/p>\n<p>parties        particularly               husband        of      the<\/p>\n<p>petitioner-complainant.\n<\/p>\n<p>           The court is of the opinion that the<\/p>\n<p>grievance,       which       has        been   raised     by    the<\/p>\n<p>learned counsel for the petitioner can well<\/p>\n<p>be     raised          at         an      appropriate          stage<\/p>\n<p>particularly at the stage of charge.
