CHINNAPPA (J)\nSARKARIA, RANJIT SINGH\n\nCITATION:\n 1980 AIR  446\t\t  1980 SCR  (2)\t 53\n 1980 SCC  (1) 412\n\n\nACT:\n     Will-Testamentary Will, construction of-Jurisdiction of\nthe Court  in exercising  its curial draughtsmanship for the\ntestator  to  supply  the  specific  words  from  the  Will,\nexplained.\n\n\n\nHEADNOTE:\n     Evidence-Additional evidence  reception of\t by the High\nCourt-Supreme Court  cannot interfere with the discretionary\npower of  the High  Court, when the application is very much\nbelated.\n     The testator  Pearey Lal Singh Bhatia died on 30-3-1952\nleaving behind him a Will dated 8-4-44, a widow Lakshmi Devi\nbeing his second wife, a son Om Prakash by Lakshmi Devi, and\nthe widow  and daughters  (Manmohini, Raj  Kumari and Pramod\nKumari respectively)  of a predeceased son by a pre-deceased\nfirst wife.  Manmohini, the  daughter-in-law of the testator\nand her\t daughter Raj  Kumari had  left the family house and\nmoved away  to Mathura,\t while Pramod  Kumari stayed in with\nher grand  father and  was brought  by up him. Lakshmi Devi,\nwidow of Pearey Lal Singh died in 1958.\n     The suit  filed by Om Prakash for title to a sum of Rs.\n16,490\/- lying\tin deposit  with two  banks was dismissed by\nthe trial  Judge, who on a strict and narrow construction of\nthe will  came to  the conclusion  that Om  Prakash was\t not\nentitled to  succeed under the will and that on the death of\nLakshmi Devi  the amount had to be divided among Om Prakash,\nMan Mohini, Raj Kumari and Pramod Kumari. On appeal the High\nCourt of  Allahabad held  that on a true construction of the\nwill Om Prakash alone was entitled to the amount.\n     Dismissing the appeal by special leave, the Court,\n^\n     HELD :  1. A  reading of  the whole of the will clearly\nshows the unambiguous intention of the testator that his son\nOm Prakash  should succeed  to his estate after the death of\nLakshmi Devi  and none\telse was  to be\t the  owner  of\t the\nproperties. [57 A]\n     The testator  noticed the\texistence of  five  possible\nheirs :\t his wife,  Lakshmi Deve,  his son  Om Prakash,\t his\ndeceased son  Krishna Chandra's widow, Manmohini and Krishna\nChandra's daughters,  Raj Kumari  and Pramod  Kumari. He was\ndesirous that  Pramod Kumari should be brought up by himself\nand his wife and that they should also perform her marriage.\nHe was\talso desirous that a sum of Rs. 2000\/- should be set\napart for  the marriage\t of Raj\t Kumari. Apart from that, he\ndid make  it clear  that Man  Mohini, Raj  Kumari and Pramod\nKumari should  have no\tright or  interest  in\tany  of\t his\nproperties  under   any\t circumstances.\t On  his  death\t his\nproperties were\t to go\tto his\twife Lakshmi Devi who was to\nhave a\tlife interest  in them.\t If his\t wife  Lakshmi\tDevi\npredeceased him,  the properties  were to  go to  his son Om\nPrakash. [56 F-H]\n54\n     2. No  doubt, the\ttestator while\tspecifying  that  Om\nPrakash was  to take  the properties  in case  Lakshmi\tDevi\npredeceased the\t tester, did  not specify  that\t Om  Prakash\nshould take  the properties  after the death of Lakshmi Devi\nin case Lakshmi Devi survived the testator to enjoy the life\nestate given to her under the will. But this is a case where\nthe testator's\tintention  to  give  the  properties  to  Om\nPrakash in case Lakshmi Devi predeceased the testator was so\npatently and  reasonably  certain,  `no\t speculation  but  a\ncompelling conviction', that the Court would be justified in\nexercising its\tcurial draughtsmanship\tfor the testator and\nsupplying the  specific words  missing from  the  will.\t The\nCourt  has   undoubted\tjurisdiction  to  do  so.  Therefore\nnecessary words\t to that  effect can  and must\tbe read into\nwill. [57 A-C, 58-C]\n     William Abbott  v. Supreme\t Court cannot  interfere with the discretion\nexercised  by\tthe  High   Court  in  refusing\t to  receive\nadditional evidence  for which an application was made after\nseveral years. Goswami for the Appellant.\n<\/p>\n<p>     Mohan Behari  Lal and  Vishnu Mathur for Respondent No.\n<\/p>\n<p>1.<br \/>\n     The Judgment of the Court was delivered by<br \/>\n     CHINNAPPA REDDY, J.-The question in the appeal is about<br \/>\nthe construction  of a\twill. The facts which are now not in<br \/>\ndispute before\tus are as follows : The testator, Pearey Lal<br \/>\nSingh Bhatia died on 30-3-52 leaving behind him a will dated<br \/>\n8-4-1944, a  widow Lakshmi Devi being his second wife, a son<br \/>\nOm Prakash  by Lakshmi\tDevi and  the  widow  and  daughters<br \/>\n(Manmohini, Raj\t Kumari and Pramod Kumari respectively) of a<br \/>\npre-deceased son by a pre-deceased first wife. Manmohini and<br \/>\nher daughter  Raj Kumari had left the family house and moved<br \/>\naway to\t Mathura while\tPramod Kumari  stayed  on  with\t her<br \/>\ngrand-father and  was brought up by him. Lakshmi Devi, widow<br \/>\nof Pearey Lal Singh, died in 1958. We are now concerned with<br \/>\nthe title to a sum of Rs. 16,490\/- lying in deposit with the<br \/>\nState Bank  of India  and  the\tDistrict  Cooperative  Bank,<br \/>\nBulandshahr. Om\t Prakash claims\t the amount  under the\twill<br \/>\ndated 8-4-1944.\t The will,  a registered  one,\twas  in\t the<br \/>\nfollowing terms:-\n<\/p>\n<blockquote><p>\t  &#8220;I, Pyare  Lal Singh, son of Babu Ghanshyam Narain<br \/>\n     Saheb, by\tcaste Kshatriya\t Bhatia, resident of Mohalla<br \/>\n     Sheopuri, Bulandshahr, do declare as follows:-<br \/>\n\t  &#8220;I, the  executant, am  owner in possession of the<br \/>\n     property specified as given below in Schedules `A&#8217;, `B&#8217;<br \/>\n     and `C&#8217;. The<br \/>\n<span class=\"hidden_text\">55<\/span><br \/>\n     property given  in\t Schedules  `B&#8217;\t and  `C&#8217;  has\tbeen<br \/>\n     purchased by me the executant, with my own funds in the<br \/>\n     name of my wife Smt. Laksmi Devi and my son Om Prakash.<br \/>\n     In fact  I, the  executant, am the owner of it as well.<br \/>\n     The entire\t movable and  immovable property,  owned and<br \/>\n     possessed by  me, is  my self, acquired property and is<br \/>\n     not ancestral  property, and  I the executant, have all<br \/>\n     sorts of  rights to  make transfers in respect thereof.<br \/>\n     Now I, the executant, am about sixty years of age and I<br \/>\n     have a  wife, Lakshmi  Devi, a son, Om Prakash, and two<br \/>\n     dear grand-daughters,  Raj Kumari\tand  Pramod  Kumari,<br \/>\n     daughters\tof  my\tfirst  son  Krishna  Chandra  Singh,<br \/>\n     M.A.,LL.B., who has already died in June, 1932, leaving<br \/>\n     behind his\t widowed wife  Smt. Man Mohini Devi, besides<br \/>\n     these two daughters aforesaid. Both the daughters of my<br \/>\n     deceased son aforesaid, who are my grand-daughters, are<br \/>\n     still  minors.  By\t way  of  prudence  and\t for  future<br \/>\n     management I, the executant, make a will as under :-<br \/>\n\t  That I,  the executant,  till I  am  alive,  shall<br \/>\n     remain  owner   of\t my  entire  movable  and  immovable<br \/>\n     property, cash  etc., which  I possess  at\t present  or<br \/>\n     which may\tbe added to it during my life time and which<br \/>\n     I, the executant, leave behind at the time of my death.<br \/>\n     After my  death, if  my wife  Smt. Laxmi  Devi  remains<br \/>\n     alive, she\t will become  owner of my entire estate with<br \/>\n     life interest,  but she shall have no power to transfer<br \/>\n     any movable  and immovable\t property. If  my wife\tSmt.<br \/>\n     Lakshmi  Devi   predeceases   me,\t then\tunder\tsuch<br \/>\n     circumstances, after  my death  my son  Om Prakash, who<br \/>\n     has now  appeared at the examinations of the X class of<br \/>\n     the English  School and  who is  18 years of age, shall<br \/>\n     become permanent  owner  in  possession  of  my  entire<br \/>\n     estate and\t he shall  be bound  by the  conditions laid<br \/>\n     down in this will. I and my wife shall be duty-bound to<br \/>\n     maintain and perform marriage etc. of my grand-daughter<br \/>\n     Pramod Kumari  and\t my  son  Om  Prakash  and  it\twill<br \/>\n     incumbent upon  me and  my wife to discharge that duty.<br \/>\n     My second\tgrand-daughter Raj  Kumari  lives  with\t her<br \/>\n     mother at\tMathura. After\tthe death of her father, she<br \/>\n     or her mother did not come to me and remained under the<br \/>\n     guidance of her maternal grand-father and grand-mother.<br \/>\n     Therefore, it  is the  duty of  the mother of my grand-<br \/>\n     daughter Rajkumari, who is a teacher in a girl&#8217;s school<br \/>\n     in Mathura\t City,\tto  maintain  her  and\tperform\t her<br \/>\n     marriage. Even then I lay down for her as well that<br \/>\n<span class=\"hidden_text\">56<\/span><br \/>\n     a sum  upto Rs.  2000\/- may  be given  or spent for her<br \/>\n     marriage. Appropriate  expenses are to be incurred over<br \/>\n     the education  and marriage of my second grand-daughter<br \/>\n     Pramod Kumari  and my  son Om  Prakash, who  are living<br \/>\n     with me  and are  getting education. My daughter-in-law<br \/>\n     Smt.  Manmohini   Devi  aforesaid\t or  her   daughters<br \/>\n     aforesaid or  my any  other relation shall not have any<br \/>\n     right  or\t share\tin   my\t  any\testate\t under\t any<br \/>\n     circumstances.  Only   the\t expenses   of\tmaintenance,<br \/>\n     marriage etc.  of my both the grand-daughters aforesaid<br \/>\n     and later\ton the\texpenses of  their bringing here and<br \/>\n     sending  off  shall  be  met  according  to  custom  in<br \/>\n     accordance with  the directions given above. It is also<br \/>\n     my will  that after  my death,  a sum of about Rs. 20\/-<br \/>\n     per mensem\t out of\t the income  from rent\tof shops and<br \/>\n     houses  and  other\t field\tproperty  may  be  sent\t for<br \/>\n     charitable purposes in the following manner :-<br \/>\n\t  I shall  continue to\tdo all\tthe charitable\tacts<br \/>\n     aforesaid during  my life\ttime. After  my death, if my<br \/>\n     wife remains  alive, she  shall, and after her death my<br \/>\n     son Om  Prakash, may  he live long, shall be duty-bound<br \/>\n     to continue  this charitable  act. I  have strong hopes<br \/>\n     that my  wife Lakshmi  Devi and my son Om Prakash shall<br \/>\n     execute this  will of mine in every way and in this way<br \/>\n     they shall\t cause benediction to my soul, and that they<br \/>\n     shall make\t additions to  my estate and shall not allow<br \/>\n     it to be under charge or to decrease in any way.&#8221;<\/p><\/blockquote>\n<p>     The testator, it is seen, noticed the existence of five<br \/>\npossible heirs\t: his wife, Lakshmi Devi, his son Om Praksh,<br \/>\nhis deceased  son Krishna  Chandra&#8217;s  widow,  Manmohini\t and<br \/>\nKrishna Chandra&#8217;s  daughters, Raj  Kumari and Pramod Kumari.<br \/>\nHe was\tdesirous that  Pramod Kumari should be brought up by<br \/>\nhimself and  his wife  and that they should also perform her<br \/>\nmarriage. He  was also\tdesirous that  a sum  of Rs.  2000\/-<br \/>\nshould be  set apart  for the  marriage of Raj Kumari. Apart<br \/>\nfrom that,  he did make it clear that Man Mohini, Raj Kumari<br \/>\nand Pramod Kumari should have no right or interest in any of<br \/>\nhis properties\tunder any  circumstances. On  his death\t his<br \/>\nproperties were\t to go\tto his\twife Lakshmi Devi who was to<br \/>\nhave a\tlife interest  in them.\t If his\t wife  Lakshmi\tDevi<br \/>\npredeceased him,  the properties  were to  go to  his son Om<br \/>\nPrakash. Directions  were given\t for  the  carrying  out  of<br \/>\ncertain charitable objects. His wife Lakshmi Devi and after<br \/>\n<span class=\"hidden_text\">57<\/span><br \/>\nher death,  his son  Om Prakash were enjoined to perform the<br \/>\ncharitable acts.  A reading of the whole of the will clearly<br \/>\nshows that it was the intention of the testator that his son<br \/>\nOm Prakash and none else was to be the ultimate owner of the<br \/>\nproperties. No\tdoubt, the testator while specifying that Om<br \/>\nPrakash was  to take  the properties  in case  Lakshmi\tDevi<br \/>\npredeceased the\t testator, did\tnot specify  that Om Prakash<br \/>\nshould take  the properties  after the death of Lakshmi Devi<br \/>\nin case Lakshmi Devi survived the testator to enjoy the life<br \/>\nestates given  to her  under the  will. But  this is  a case<br \/>\nwhere the  testator&#8217;s intention to give the properties to Om<br \/>\nPrakash in case Lakshmi Devi predeceased the testator was so<br \/>\npatently and  reasonably  certain,  `no\t speculation  but  a<br \/>\ncompelling conviction&#8217;, that the court would be justified in<br \/>\nexercising its\tcurial draughtsmanship\tfor the testator and<br \/>\nsupplying the  specific words  missing from  the  will.\t The<br \/>\nCourt has undoubted jurisdiction to do so.\n<\/p>\n<p>     In William\t Abbott v.  Eliza Middleton(1),\t the testaor<br \/>\ngave an annuity of &amp;2000 to his widow, and set apart, out of<br \/>\nhis personal  property, a  sum sufficient to provide for its<br \/>\npayment. He  directed that,  on the  death of his widow, the<br \/>\nsum so\tset apart  was to  go to his son George for his life<br \/>\nand on\this death to George&#8217;s children, but he directed, &#8220;in<br \/>\ncase of\t my son\t dying before  his mother,  then and in that<br \/>\ncase the  principal sum\t to be divided among the children of<br \/>\nmy daughter&#8221;.  On the  date of\tthe  will,  George  was\t not<br \/>\nmarried. He married subsequent to the will and had a son. He<br \/>\ndied before  the testator.  The testator&#8217;s  widow died\tsoon<br \/>\nthereafter.  A\tquestion  arose\t whether  George&#8217;s  son\t was<br \/>\nentitled to  take the  sum after the death of the testator&#8217;s<br \/>\nwidow. He  could so  take if  the words &#8220;without leaving any<br \/>\nchild&#8221; could  be supplied  after the  word  &#8220;dying&#8221;  in\t the<br \/>\ndeposition  relating  to  the  final  gift  over.  The\tLord<br \/>\nChancellor observed,  &#8220;where there  is an  uncertainty as to<br \/>\nthe meaning  of any  part of a will, the right of a Court of<br \/>\nconstruction even  to introduce words, in case of necessity,<br \/>\nis clearly  stated by  Lord St.\t Leonards,  in\tthe  passage<br \/>\nquoted from  Eden v.  Wilson(2), and  declared the  right of<br \/>\nGeorge&#8217;s son to the sum.\n<\/p>\n<p>     Re Smith(3),  re Cory(4) and re Riley&#8217;s Will Trusts(5),<br \/>\nare other  instructive cases  where words have been supplied<br \/>\nby Courts  because of &#8220;so strong a probability of intention,<br \/>\nthat an\t intention contrary  to that which is imputed to the<br \/>\ntestator cannot be supposed&#8221;.\n<\/p>\n<p><span class=\"hidden_text\">58<\/span><\/p>\n<p>     In Jarman On Wills, 8th Edn. 592, it is said :-<br \/>\n\t  &#8220;Where it  is clear on the face of a will that the<br \/>\n     testator has not accurately or completely expressed his<br \/>\n     meaning by\t the words he has used, and it is also clear<br \/>\n     what are  the words  which he  has omitted, those words<br \/>\n     may be  supplied in  order to effectuate the intention,<br \/>\n     as collected from the context.&#8221;\n<\/p>\n<p>     As already observed by us, we do not have the slightest<br \/>\ndoubt in  the  present\tcase  that  it\twas  the  clear\t and<br \/>\nunambiguous intention  of  the\ttestator  that\this  son  Om<br \/>\nPrakash should\tsucceed to  his estate\tafter the  death  of<br \/>\nLakshmi Devi. Necessary words to that effect can and must be<br \/>\nread into the will.\n<\/p>\n<p>     The  learned  trial  Judge,  on  a\t strict\t and  narrow<br \/>\nconstruction of\t the will,  came to  the conclusion  that Om<br \/>\nPrakash was  not entitled to succeed, under the will, on the<br \/>\ndeath of  Lakshmi Devi and that the amount had to be divided<br \/>\namong Om  Prakash, Man Mohini, Raj Kumari and Pramod Kumari.<br \/>\nOn appeal,  the High  Court of Allahabad held that on a true<br \/>\nconstruction of\t the will  Om Prakash  alone was entitled to<br \/>\nthe amount.  In the  view that\twe have taken, we agree with<br \/>\nthe conclusion of the High Court.\n<\/p>\n<p>     Before  the   High\t Court,\t  Pramod  Kumari   filed  an<br \/>\napplication  for   reception  of  additional  evidence.\t The<br \/>\nprincipal additional  evidence sought  to be  adduced was an<br \/>\nalleged letter\tsaid to have been written by late Pearey Lal<br \/>\nSingh to  the bank  nominating Pramod  Kumari as  the person<br \/>\nentitled to  the amount in deposit with the Bank. The letter<br \/>\nitself was  not filed  along  with  the\t application  but  a<br \/>\nrequest was  made to  summon the  letter from  the Bank. The<br \/>\nHigh Court  rejected the application. The application to the<br \/>\nHigh Court  was made very many years after the suit had been<br \/>\nfiled, and  also quite\tsome years after the appeal had been<br \/>\nfiled before  the High\tCourt, and  we do  not think that we<br \/>\nwill  be   justified  in  interfering  with  the  discretion<br \/>\nexercised  by\tthe  High   Court  in  refusing\t to  receive<br \/>\nadditional evidence  at that  stage.
