Jindal, J\n             Assailed in this petition is the judgment dated 22.1.2002 passed\nby the learned Additional Sessions Judge, Bathinda, dismissing the appeal\nfiled by the accused-petitioner (herein referred as 'the petitioner') against the\njudgment dated 29.10.1999 passed by the Additional Chief Judicial\nMagistrate, Bathinda, convicting and sentencing him to undergo rigorous\nimprisonment for 1- \u00bd years and to pay fine of Rs.5000\/- under Section 27\n(b) (ii) of the Drugs and Cosmetics Act, 1940, (herein referred as 'the Act')\nand further to undergo rigorous imprisonment for six months under Section\n28 of the Act.\n             In nutshell, the prosecution case is that on 29.7.1993,\ncomplainant Ajay Singla District Drugs Inspector, Bathinda, along with Dr.\nSadhu Ram Gupta, District Family Welfare Officer, Bathinda and Naginder\nPrashad Class IV employee went to the shop of the petitioner for inspection.\nHe introduced himself and other witnesses. He joined Mohan Lal as a\nwitness. On inspection, the petitioner was found stocking and exhibiting\nallopathic drugs for sale and distribution in the shop and he also failed to\nproduce any drugs licence or any valid Registered Medical Practitioner\ncertificate authorising him to keep the drugs for sale and distribution. He\nalso failed to disclose the names and addresses from where he acquired the\ndrugs stocked by him. Revision No. 141 of 2002                                          -2-\n\n                                      ***\n<\/pre>\n<p>was taken for test and analysis and prepared inspection form 17 at the spot.<br \/>\n12 types of drugs were also seized along with other articles and list was also<br \/>\nprepared on form No.16.        A sample was sent to Government Analyst,<br \/>\nPunjab Chandigarh for analysis and report was received that the drug was of<br \/>\nstandard quality. The complaint was filed in the court.\n<\/p>\n<p>              Pre-charge evidence was recorded. Finding a prima facie case<br \/>\nthe petitioner was charged for the offence under Section 27 (b)(ii) read with<br \/>\nSection 18-C and 18-A of the Act, to which he pleaded not guilty and opted<br \/>\nto contest.\n<\/p>\n<p>              In order to substantiate the charges, the prosecution examined<br \/>\nAjay Singla (PW1) and Dr. Sadhu Ram Gupta (DW2).\n<\/p>\n<p>              When examined under Section 313 Cr.P.C. the petitioner<br \/>\ndenied all the allegations and pleaded his false implication. He further<br \/>\nexplained that he is a registered medical practitioner from the State of Bihar<br \/>\nat Registration No. 42653 w.e.f.. 3.10.1985 and has right to practice of in<br \/>\nallopathic medicines.      In defence he tendered into evidence original<br \/>\ncertificate Ex.DA.\n<\/p>\n<p>              Arguments heard.\n<\/p>\n<p>              Both the courts below, have unnecessarily tried to enter into<br \/>\ncontroversy while holding the petitioner guilty of the offence.              The<br \/>\npetitioner admittedly is a &#8220;vaid&#8221;, authorised practitioner in Ayurvedic and<br \/>\nUnani system of medicines. The certificate (Ex.DA) issued by Ayurvedic<br \/>\nand Unani Medical Board, Bihar reveals that he was registered with the<br \/>\naforesaid Board on 3.10.1985. Learned counsel has placed reliance on the<br \/>\nDrugs &amp; Cosmetics Rules framed by the Central Government under the Act.<br \/>\nRule 2 (ee) (ii) reads as under :-\n<\/p>\n<blockquote><p>              &#8220;2.(ee)     Registered Medical Practitioner means a person\n<\/p><\/blockquote>\n<blockquote><p>              (i)x   x    x      x     x      x\n<\/p><\/blockquote>\n<blockquote><p>              (ii)registered or eligible for registration in a medical register<br \/>\n                of a State meant for the registration of persons practising<br \/>\n                the modern scientific system of medicine excluding the<br \/>\n                Homeopathic system of medicine.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Crl. Revision No. 141 of 2002                                           -3-<\/span><\/p>\n<blockquote><p>                                       ***<\/p>\n<p>               The words &#8220;eligible for registration in a medical register of a<br \/>\nState&#8221; means that he may be eligible or has been registered as medical<br \/>\npractitioner of any State and not necessarily with the State where he is<br \/>\npracticing .<\/p><\/blockquote>\n<p>               It is not challenged by the prosecution that the petitioner holds<br \/>\na certificate of registration from the State Ayurvedic and Unani Medical<br \/>\nCouncil, Bihar and was duly registered as such in Bihar. By virtue of<br \/>\nSchedule 1 to the Punjab Ayurvedic and Unani Practitioners Act, 1963,<br \/>\neverybody who is holding a degree or diploma of any Ayurvedic or Unani<br \/>\ncollege recognized by the faculty within Punjab or outside would be eligible<br \/>\nfor being registered as a medical practitioner in the State of Punjab and<br \/>\nHaryana. In view of the aforesaid rule, the petitioner comes within the<br \/>\ndefinition of registered medical practitioner and as such he was entitled to<br \/>\nkeep allopathic medicines for practice, therefore, he cannot be held guilty<br \/>\nfor violating the provisions of Section 18 (c) and 27 (b) of the Act. Similar<br \/>\nobservations were made by this Court in case <a href=\"\/doc\/419325\/\">Phul Singh vs. State of<br \/>\nHaryana,<\/a> 1986 (1) R.C.R. (Criminal) 532.\n<\/p>\n<p>               In view of the matter, the lower appellate court appears to have<br \/>\nfallen in error in holding the petitioner guilty who is already registered with<br \/>\nthe Ayurvedic &amp; Unani Medical Board, Bihar.\n<\/p>\n<p>               Resultantly, I accept the revision petition, set aside the<br \/>\nimpugned judgment and acquit the petitioner of the charges framed against<br \/>\nhim. Bail bond and surety bond furnished by him stand discharged. Fine, if<br \/>\nany deposited by him, be refunded.\n<\/p>\n<pre>May 19, 2009                                               (A.N.
